Our K1 was filed August 2013....my fiancee arrived August 2014 the day after she got the visa......k1 took 1 year....I thought it would never happen, but my new wife is sitting beside me today in California as I type....its all fades into the past once its over.

Yours sounds like a technical glitch...

It seemed hopeless to us at times....hang in there....find out why this happened and try again and lets hope that later phases of your process proceed more quickly.....

If she is your soulmate as you feel, then it will be fine...but try to visit here there as much as you possibly can...

Appeal is just wasted of money and time. And even so he could try, the OP should know why the petition got denied at first place otherwise he will stuck in limbo.

I agree appeals can take up to a year and cost more than the I-29F petition, once OP gets the denial then refile would be the better option

It was a single RFE. They asked for my fiancee's divorce certificate. Originally we had sent notary papers of divorce and certificate of no marriage. In response to the RFE we sent the proper divorce certificate in Chinese and a professional translation. To the best of my knowledge it was done as they asked.

It was just one RFE, I just noted the time of each message, whether it was text, email or hard copy.

I have a copy of what she sent. It looked perfect to me. We will see if that is the reason, hopefully I get the hard copy of the decision this week.

The problem could be that the divorce certificate had only attached a professional translation. Every formal document should be translate for "an official translator" and the signature of this translator should be certificate for the notary. I believe in China she could go to those firms that have the translator and the notary in the same office.

Look like that you had miss the translator's certification that he or she is competent to translate the foreign language into English.

In the past I had guide somebody that had divorce in South Korea, and her document was done in the same way I am telling you, also it was accepted for USCIS withouth any problem.

After 5-1/2 months of waiting we have been denied. I don't know what it could be, just have to wait to get the hardcopy to know the reason. Our love is strong, this is just a bump in the road and I'm prepared to fight for my baby.

The translation was done correctly along with certificate of accurate translation and performed by a U.S. Based company. I had so many other things translated, hotel receipts, train tickets, birth certificates and so on since nearly everything was in Chinese. There cannot be any AWA trouble since I have zero criminal history much less anything bad involving children. I just have to wait and see what the hard copy says. It has to be a mistake. I've seen others appeal over minor things from RFEs and get approved in less than a month. I'm just hoping to get lucky for once.

The one RFE I got was in regards to my fiancées divorce certificate. I really believe that it something as simple as an inexperienced adjucator reading my fiancées Chinese divorce booklet and not feeling it was sufficient. The wording in those books is not as verbose as what we see here in the U.S. The booklets just list both person's names, a divorce date and say it is an official book. I just hope we don't have to start all over again and go back to the TSC.

We sent both. We sent the notarial certificate at first. Then in response to the RFE we sent the decree (Chinese divorce booklet). That's why I'm drawing a blank as to what went wrong.

You don't need to get all you documents professionally translated and notarized. If you speak the language you can translate it yourself with a statement on the translation that you're competent to do so. Notary is a waste of money on a translation.

OP- Your fiancee's house book doesn't count as a divorce certificate. Two different things. The house book is like a never ending census. I ran into a similar problem in Vietnam. The house book will mention the divorce but the divorce was filed at the ministry of justice which is where I had to go in Vietnam. It can't be much different in China.

You need to ask the question of how to obtain an original divorce certificate in China on that portal.
