Advance Parole, Any problems returning to USA?

Hello Everyone,

Getting to the end of my K1 Journey finally. Our K1 took almost a full year before it got approved. We are now happily married for 5 months. We filed for Advance Parole when we did the paperwork and my wife got it. She received a combo card from the USCIS that says it is for employment AND advance parole. But there was a letter that came with it talking about how she may or may not be allowed back into the country when using it. I saw some older posts but nothing in the last year about this. Should we be worried at all? She wants to go home and see her brand new nephew (born on Christmas). But we are worried she might have difficulty travelling back into the USA. Any advice or past experiences here would be greatly helpful. I want her to go home and visit, but I need to make sure she can come back to me. :)

You are asking a question that no one can answer. Whether or not she can come back is up to the immigration officer at the POE; however, it is doubtful they will not let her back in. They are just covering their *#&@ for the less than 1% chance a POE officer wants to get on his/her high horse and refuse entry to someone for whatever reason. She should be good to go with her AP.

One thing I have noticed here on VJ is that using AP does cause you to be put thru a secondary screening process and the time required for that depends on the POE. So I would allow some extra time to clear the CBP and Customs when returning to the US. Just so you know, no one without a blue passport is assurred entry to the US. How often does CBP deny entry to people with a valid AP or GC or visa? They usually warn the person when they are allowed to enter. The problems reported here on VJ have been with poorly trained airline employees at a major carrier or using a cheap carrier that does not know about immigration laws and what is considered a valid entry document. I would check with your airline to see if the recognize the AP before purchasing a ticket with them.

As others have said it is ultimately up to the POE officers. My wife and I got married last year and were concerned about a family cruise to the Bahamas since the cruise line was very vague. My wife and daughter both had their AP and we had no issues with customs returing to USA. Customs did pull the three of us aside into another room, reviewed their AP documents (took about 20 minutes) and then thanked us and let us on our way. To be safe we had copies of every document we could think of but the only thing they asked us for was their AP card/papers. Again this was our experience and I'm not sure how it may be for you or anyone else.

Timeline

Was outside the USA last year for 5 weeks, went with EAD AP card, when returning had no problems, all fast and smooth. Make sure when she travels she has all necessary papers to come back to the USA (marriage certificates, EAD AP card, in case if some border control officer in Moldova does not speak english i recommend to have marriage papers translated and with apostille in case if in Moldova they have questions).

So my question is after getting the probationary or provisional permission is she stuck here in the US for 2 years..?

No. She will become a LPR when the GC is approved and arrives. She can then travel just like any LPR and uses the GC to re-enter the US.
