question, once we get married when can she go back on vacation.

Lets say we get married in march 2013. What needs to happen before she can go back and visit her parents for December in Ecuador? Like what does she needs to have done? What would be the last thing she would need? And is there enought time?

10/31/2012 - I-129F Sent
11/05/2012 - NOA1 (email/text)
11/08/2012 - NOA1 (paper)
05/10/2013 - NOA2 (paper) for some reason, they didn't text me this time.
05/17/2013 - NVC received package.
05/24/2013 - NVC Sent package to Ecuador embassy (I called and they told me that)
05/28/2013 - Received mail from NVC notifying they have send my package to Ecuador.
05/31/2013 - Ecuador Consulate mail package to my fiancée.(I've already scheduled the interview before this)
07/15/2013 - Visa approved!
11/30/2013 - POE (smooth process, she was done in 1 hr)
12/21/2013 - We got married!
12/24/2013 - Applied for SSN

03/27/2014 - Sent out AOS, EAD, and AP
04/03/2014 - Received NOA for all 3
04/08/2014 - Received appointment for Biometrics
04/30/2014 - Received RFE (need proof of income)
05/06/2014 - Did Biometrics appointment
05/07/2014 - Sent RFE
06/14/2014 - Received EAD/AP combo card
07/10/2014 - Notice of Potential Interview Waiver Case

02/23/2015 - Opened a Case Inquiry "Outside Normal Processing Time"

03/09/2015 - USCIS responded with a letter, and pretty much said "keep waiting, we'll get to you"

03/24/2015 - "Card was ordered to be produced"

04/03/2015 - Greencard in hand!

At the minimum she would have to have Advance Parole (AP) approved and in hand before departing the country. However, realize that even with AP she is not guaranteed to be allowed back into the country. Approval times for AP vary but is usually estimated to be about 3 months from the date requested.

The AP can be done in conjunction with or after the Adjustment of Status (AOS) request. The Employment Authorization Document {EAD} can also be requested at the time of or after the AOS request. There is no cost for filing for the AP and EAD if done at the time of or after the AOS request, otherwise there is a fee for the AP filing.

AOS (and AP, form -131) needs to be filed and she needs to have AP in hand before leaving the US. It'll take about 2-3 months from submitting papers until AP in hand.

In order to submit AP(and AOS) you'll need to have everything ready. If she has all vaccinations and medical is still valid, all you need would be the copy of marriage certificate and other supporting documents. When you have those, you can basically submit AOS.

If you marry in March 2013 and submit AOS, I131 and I765 within a month, she'll most likely have EAD/AP combo card in hand by june/july/august - well before christmas. BUt it's fine to submit it and have extra time in case an RFE is generated.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

File for the GC, AP, and EAD ASAP after the marriage. She can travel on the AP card or the GC. One would hope 9 months would be enough to receive the GC, but there are some people waiting for almost a year. The AP should arrive in about 3 months and she can travel on that.

No. Because without pending AOS, she'll be considered departuring and definitely can't come back because she won't be entering with a valid visa nor AP or any AOS pending for that matter. Waste of money to even file AP before AOS.

After reading a few forums I noticed that after aos the green card comes next. Shouldn't that be enought for her to go back and forth as she pleases as long as she has the Greene card? Or even with a green card she will need to fill out forms to go on vacation?

You cannot file for AP without filing for AOS.

After reading a few forums I noticed that after aos the green card comes next. Shouldn't that be enought for her to go back and forth as she pleases as long as she has the Greene card? Or even with a green card she will need to fill out forms to go on vacation?

Work authorization(EAD) and advance parole(AP) are filed for at the same time as you file the I-485 to get the green card. The form fees for the EAD and AP are waived when filing with a pending I-485. It will typically come in an EAD/AP combo card that is good for employment and re-entry to the US when traveling. It can also be used to get a state drivers license or ID. They take 2-3 months to receive after filing your AOS paperwork and are used while waiting for the green card approval. Once the green card is approved, they are no longer valid or needed. Follow the guide here on VJ for filing AOS.

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
