    I can tell you some things.
    She is not eligible to adjust status in the US because she arrived on a K-1 visa and can only adjust based on current marriage to the petitioner. So you theoretically could file I-130 for her, which is the first step in obtaining a spousal visa, but she would have to leave the country and by doing so she would incur a 10-year ban for overstaying. You would then have to file a hardship waiver and get it approved for her to come back (not an easy task). Filing an I-130 by itself does not give any legal benefit (I am not sure what you think it does, or why you bring up DCF... you don't live in her country).
    I can't say much about her asylum case, but it would help for advice to know what country she is from. USCIS does not like frivolous asylum cases AT ALL, so if she just filed based on some random story but really she was just trying to buy time in the US, then she will have trouble.
    It sounds from the circumstances that a VAWA claim would have been much more appropriate in her case than an asylum case.
    You will also have to figure out how she has been working. Is she ever claimed to be a US Citizen to get her job, then she is toast.

    You can definitely file from abroad.
    Most people here do not use a visa service, this is a DIY site, but if you are not god at filing in paperwork or following detailed instructions, it's not a bad idea.
    You are only going to be there 60 days- even if you post the package off within a few days of arrival, you are unlikely to hear anything other than NOA1 before you return, so no need to do anything or worry about having to correspond with USCIS.

    His visa did not expire. His visa was CANCELLED when he stepped off the plane. It was replaced by the I-94. If you were married before the I-94 expired you are fine. There is no particular deadline to file AOS
    Worse case? The package gets returned and you send it out again. Slight delay.
    Go back to sleep.

    You are right. Worse case this is a several day delay in the green card, nothing more.

    Either because the K2's were over 14 years old, or because they didn't know any better and just paid the full fees.
    To the OP - read the pinned thread about K2's. It will explain the differences between the K1 and K2 AOS procedures. They are very similar but not identical. Read the entire thread because some things have changed since that thread started, and those changes have been mentioned in the thread.

    Re-consideration now accepted visa approved on December 13,2011. I want to thank everyone for Your comments, I took some the advice here and I also went to other forums. Things I did, I e-mailed the manila embassy and explained the situation in facts such as I explained that If I was planing on defrauding the US Immigration would I have made up a story of staying with My Fiancee for 48 hours and I was in the Philippines 9 days? Would've just said 9 hello. The next thing I did was I explained that I have joint custody of My 2 kids, I have My son full time and My daughter summer months of odd years so I cannot travel in odd years that's why there was no return in 2011 and then I submitted Certified custody papers. Next I explained that In April 2011 I was diagnosed with stage 1a cancer on my right kidney and had surgery to remove a Th of my kidney and couldn't travel and submitted My diagnosis papers and surgical papers, and last I started contacting congressmen and senators and every e-mail I sent to them I would CC the Embassy so they could see that I'm very Serious about My Fiancee. done deal visa approved, Jan 20 or 27 or Feb 3rd are that arrivals dates we are thinking of!! thanks Visa Journey!! This post if from the Fiance so You see I only post in facts and never took anything here personal :thumbs:

    Yes, you can wait until the baby is born to file for AOS, but you really don't have to do that. The medical exam is not invasive or risky to pregnancy, and if you were to need vaccinations that are not recommended to be taken while pregnant you can get those later. However, should you choose to wait until after the baby comes, that is fine too.
    Once USCIS received your application, you enter into a new period of authorized stay. Your B2 status becomes irrelevant. You are then allowed to be in the US legally until you have a decision on your GC application, which usually takes around 5-6 months from filing the papers.

    Don't get mad. Get EVEN!
    Stop letting this game play on with you on the bench pleading "put me in coach! (your husband)". Time to get on the field and wreak havoc!
    1. Eat her food
    2. Label your food.
    3. Take her kid to whatever party (she is) and leave.
    4. Borrow some of her clothes and "accidentally" stain them.
    5. Search her room for drugs / paraphernalia and if found, have her arrested for possession or even better... possession with intent to distribute.
    6. Pack up some belongings and tell your husband you are going to stay at a friends house to think things over. DO NOT BRING YOUR CHILD WITH YOU!!!
    Do all of this and....
    7. Get a voice activated digital recorder... be prepared to call police... have her arrested for assault and battery (when she finally snaps).
    In this type of situation....the good guys finish last and cheaters always win.
    Tear up her world to save yours!!!

    3. There will be biometrics (fingerprints and photos) and there MAY be an interview (some do, some don't). Only time will tell.
    4. Yes it can. Moving can really cause issues. There have been many cases where people have moved and their mail gets lost and they don't find out till they're denied. I suggest if you're planning on moving, to put a PO Box as your initial mailing address. Once you move file the proper paperwork (AR-11) for the immigrant, and have a friend check your mail for you. Government mail should NOT be forwarded. People have gotten lucky but it's not supposed to happen so it's rare. If you want to wait to file after you've moved (I did), that is safer but of course it will be longer till your spouse gets their EAD/AP/AOS and they'll be out of status once their I-94 expires.
    5. In the instructions. Also, there's an AOS thread in my signature that should help you.
    6. Be patient but also vigilant. More people than I think is "normal" have waited MONTHS without hearing. I've read at least 2 waiting more than 2 years. The standard lately (can be quicker but at worst) seems to be a month for NOA1, another month for biometrics, a 1-3 months for a scheduled interview OR approval without interview. If you hit 6 months and haven't heard, that is odd and should be followed up.

    You still have to bring his latest ITR and W-2s. BUT also bring proof of sustaining income like pay stubs and an employment letter where his current yearly income is stated.
    If your fiance is a fresh graduate or currently studying, there's a chance that US Embassy Manila might allow a co-sponsor. Have one ready just in case.

    then move out and let them on their own. there is nothing to save if your husband cant stand by your side to protect you from being slaved & used. if he even care or love you, he would be so concern of what you feel. and looks to me he doesnt care at all. all he wants is for you t be there and feed him and his daugther and have you pay their bills. i know this sound harsh and it hurts but theres nothing painful than what youre going thru right now. think of your self and your young kids that still depending on you. you have to stand up for them and be strong for them.

    If what you say is true, that you have talked to your husband "a billion times", then it's obvious he isn't going to do anything, or change anything. I know it sounds harsh, but after talking with him a billion and one times, you need to get away from these people!!! Now, before you become a human slave. What you describe isn't love. Good luck!

    I think your husband need to grow up and need to be little smart lol. He is concern about his adult daughter, but seems like did'nt think about your young children who really need to be taking care of first and need his support. But since he is currently still jobless and can't provide anything for the young kids, and your the one who supporting the family, then the least that he can do is talk to his daughter to save money and move out as possible as she can. About your quistion # 3, I will do more research about that online, coz I also heard about that before that you can't just evict someone who lives long enough with you, even so... I'm sure you probably have more legal rights, specially if you have a reason for kicking her out. should be more easier and possible for you if your husband is gonna support you about this, because he care also about you and your younger children than his 25 y.o daughter.
    BUT.. if he really gonna insist that his daughter should really stay.. I guess you have to decide if you still willing stay and tolerate it or leave and stand for your self coz you think you have enough. Also it seems like you already done alot for him and for your marriage. It's his turn to do something for it.

    "Oh, your baby is so cute" that was the first word that came out from the CO's mouth. The CO was so kind that he had fun with my little buddy the whole time, he was laughing so hard with my baby then after a couple of minutes he gave me a sad face telling me about something and makes me so worry. He told me that my fiance's income is not enough for 6 people cause they have to add my kids from my first husband even if they will not accompany me right now, adding that if my case was handled with other CO he don't think they would give my case a consideration. He also told me that even if i can provide them a co-sponsor they would not allow it cause its a K1 visa. After a moment of looking at my fiance's W2 he then told me okay you have 90 days to marry your fiance , I didn't get what he means cause i was praying so hard that may our good Lord touch his heart at that time so I asked "Sir, am i approved?" then he smiled and replied me " Yes and wELCOME" . I got teary eyed after i said "thank you sir".. it was an early xmas gift for me.
    God really works in mysterious ways..

    I really don't want to say this, but when I read that you met her for three days and you "support her 100%", first reaction is SCAM.
    And this is us VJers, the CO probably thinks this, only worse. You really need to spend more time with her in order to get approval.

    When i had my CFO seminar i went to PRISM center, it was so fun and filled with laughter i really didnt expect it that way. I always hear CFO seminar is such a pain in the butt aside from the fact that its another rip off trick of the phil government. But after my seminar i didnt really feel so sorry. I left with a smiling face although there was a 22year old girl who wasnt able to get her certificate becoz they were asking for a parental letter from her parents, still that wasnt too bad. She had her mom send her a scanned letter thru email, went back the next day and viola! she got it.
    Just give them what they wanna see and add more if you can. After that there should be no reason for them to not give your cert. otherwise insist to talk to their superiors.

    If they havent cashed your cheque it means theyre not going to work on your case.They will mail you back the entire packet together with your payment enclosed with instruction on what was wrong, how to correct it and a yellow paper that you will mail back again with right amount. Call again tomorow, sometimes those customer service agent doesnt even know what theyre talking about. tell your fiance to ask to be escalated to a supervisor, someone that can tell him more about the case

    Before I tell our story.. Just a quick update, she recieved her visa yesterday from the courier service. She texted me all excited and I called her soon after. We are both thrilled that our three year journey is about over.
    This a long story and hope anyone who reads this have some time on their hands..
    Way before I met my fiancee.. One of my uncles told me I need to go the Philippines to find a good wife. I thought he was nuts and even though he and my dad's other brother are married to filipino women. I thought of them being too bossy and one of my filipina aunts is the BOSS of her house. It's her way or no way.. The other one is not that way at all, just a sweet and loving person. I was afraid to take a risk and decided to marry someone close to home. It turned out to be five and a half years of pain.. As my divorced was getting finalized and I dated a few women along the way and got hurt time and time again. The same uncle of mine told me to go the "Filipino" route again. This time, I figured I give it a try.
    I looked over the internet and found some dating/penpal sites. I decided on Cherry Blossoms and put in a ad. I was amazed how many hits I got.. There was many I chatted with who kept asking me about my job and of course, "How much money you make"... I finally decided on one lady and after a few months I grew tired of her getting mad at me for not giving her money like she wanted. I did help her get a plane ticket to Dubai and she got a good job now. We remain friends to this day.
    I went back to Cherry Blossoms and eventually found my soulmate, Rizel. Her ad was pretty straightforward and said, she "wanted to be loved and have a family." Her picture of her sitting on a couch and looking so beautiful really caught my eye. Little did I know then, she was even more beautiful on the inside too. We emailed back and forth.. We finally started chatting and even though she saw me on webcam, I never saw her face until 2 - 3 months later. She was worried that I wouldn't like what I see, but she was even more beautiful than in her pictures. I discussed my trip to the Philippines with my aunts and they gave me alot of advice and some emergency contacts with their family there, in case Rizel and I didn't hit it off.
    I haven't flown at that time since a few months before 9-11-2001 and it changed in a big way since. All the extra security checks and my longest flight at that time was from Little Rock to San Diego roundtrip. I can tell you, flying twenty-something hours was truly painful ! The whole time I was questioning myself, but so anxious to meet her. I finally arrived at Cebu and while I was in line to go through customs. I saw a beautiful lady staring at me. I thought she looked familiar and when she smiled, I knew it was her and I waved at her, she waved back. When we finally met, I didn't feel nervous and felt so comfortable with her. Only thing I was worried about was meeting her family and being in a strange country far from home.
    Soon as we were outside, the humidity hit me like a ton of bricks ! It was very hot there and when I left home it was in the 50's. It felt like I was in the middle of August again ! I rode with her family to our hotel and it was nice to finally get some rest from that long flight. After our second day I finally proposed to her in private, just between us. Maybe kind of quick, but I knew she is one of a kind. After a few days in the city, we went to the province and stay for several days. I met her mom & dad and her other siblings. They are wonderful people and of course, I got many stares from people in the province. At first I didn't care for it, but I gotten used to it. I guess they don't see many foreigners come their way. I see how many people live in primitive conditions there. I seen houses no bigger than my living room and no electricity. Even though they lack some of the things we have here, I always see them smiling. Makes you appreciate what you have.
    After the second day at the province, I asked her dad for her hand in marriage. I studied the words that Rizel told me to say and he gave me his blessing. Even appreciated I tried to learn their language and I continue to learn much as I can. I bonded with her daughter and so glad she liked me. We went to the Simala later on and it was amazing. I never been inside a catholic church before and all the decor, the artifacts and the painting of the Lord's Supper on the ceiling blew me away. We went back to the city for a few more days before going home. It was hard leaving her behind, but I knew it wasn't forever and we will be together soon. So I thought anyway.
    I hired an agency to do our paperwork and by the the time I paid the fee and two months later it was completed. I was about sign it and send it in, when they called me about my fiancee's birth certificate was incorrect. It's not like here, you go to your local govt office and have it changed in a few weeks or much less. It took us nearly two years ! Our first lawyer was a crook and never did file one piece of paper. My fiancee would go see him and he would ignore her. She would call and he just yell at her for bothering him. I even called him and he assured me that he was working on it. By the time I went back to see her a second time, I called him and he would say, "The other lawyer you want is in Makati" and I knew it was him. I called him back the next day and he never would answer. I was angry and part of me wanted to give up, but I knew if I did, I would never find anyone like her again. So, I waited and she hired a different attorney. It took another year before they finally corrected her birth certificate. After that, we finally got the ball rolling again. I did see her again for a third time and spent two weeks with her like the last two times. Every time I left, it hurt more than the last time. I finally broke down into tears. I finally sent off the paperwork and waited & waited.. We prayed and hoped the Vermont Service Center would approve our petition pretty quick. It was faster than some others and I can't complain about waiting as much as other people who waited alot longer. After the NVC letter, it went along pretty fast and finally hearing that she was approved for her visa was the best news I had in three years !
    As I look back.. All the money spent on flights, hotels, money sent on Xoom, and all the other fees that I had to pay to get to this point. Some of my friends and some family telling me I wasted my time & money on her.. Would I do it again ? Do I really want to go through that headache one more time ? I would.. only for her. I truly love my gwapa Rizel with all my heart & soul. She will be here in December and it will be truly, a Christmas gift I would always cherish for the rest of my life.
    If you truly love someone.. good things will come to those who wait. I never believed in those words before... I did when I met my Rizel. Take care and God bless everyone here on visajourney.

    it really depends. some get their visa in as soon as 5working days some get it 15working days. so just be patient. if didnt ask you any additional docs and it means you just have to wait
