Others have provided information about why you shouldn't bother submitting a fee waiver request, and why it wouldn't be approved. Their advice is correct, but there is a more definitive answer since USCIS introduced the I-912 Fee Waiver Request form. The instructions for the I-912 list the types of petitions for which a fee waiver will be accepted. Neither the I-129F nor the I-130 are listed - they are not eligible for a fee waiver.

Please go home to the PH before you overstay your Visa . There are so many honest Fiance's who must suffer the waiting pains and endure Manila so they can come to be with their beloved! You took a very valuable seat away from them, and the time of our American CO. That was nothing but greedy and selfish by you and your family.

Agree 100% with the bolded part .
People who are in OT , I'm pretty sure are not there looking for immigration advice. the forum does serve a purpose, though...imo.
If you look at the posters in OT, they are mainly comprised of folks that have either filed and are waiting out the next step, completed all their immigration stuff and are enjoying the discussions on current events/ GW ( ugh)/ or merely chit chatting with folks that are at the same stage of the process as them.
'Friendships' have formed and it's a way for folks to connect without cluttering up the immigration parts of the site with OFF TOPIC discussion/disagreement/opinion.

The moderators seem to spend a disproportionate time in OT/PR.
Why?
Moderators are needed in the upper forums! There are more TOS violations there than in OT/PR combined.
-Name calling.
-Unlicensed legal Advice
-Immigration fraud advice
-there is currently a big hate fest directed at beneficiaries from certain countries
...just to name a few.
Please explain to me why on an immigration forum the mods seem to devote so much time to OT/PR- and lay the heavy mod hand down there for the slightesi infringement, carpet banning folks for the weakest of reasons...editing their posts.........-yet let so much #######/TOS violation go in the upper forums?
Then don't click there.

How are K1ers any worse that people that marry and then cry that they deserve to be with their spouse and get pregnant and complain about not meeting the poverty lines with a kid on the way. Getting married doesn't improve personal responsibility one bit. In fact from what I have seem on VJ it seems to make them feel more entitled to loopholes to not being a public charge. If you want to put a price on family based immigration let the petitioner put up a million dollar bond that will be released when the beneficiary is past the affidavit of support requirements.

Perhaps you are projecting too much of your experience onto the matter without realizing not everyone does a K1 for the reasons you assume.
SOme people are separated due to military duty, some people have religious considerations.
SOme countries have requirements for marriage which makes it much more simpler to marry State-side.
Some people just want to be married in the Good ole USA for what ever reason.
THe real question should be, "is there a problem with the K1 type visa, ..high failure rate? High fraud?
Other than your opinion is there any other reason to do away with the K1?
If there is, I might agree, but I am not aware of any overwhelming reason to not allow it.

Few would be deterred. The majority would marry in the beneficiary's country and pursue a CR1, an (overall) quicker and cheaper route to permanent residence.
You'd really just end up discriminating against those in unfortunate circumstances.

Your situation really saddens me with a heavy heart. There must be a safe house for abused women near you, and they allow children to come with their mothers. The nearest Mosque or Church facility would probably help you find one. Please do not feel ashamed to go and seek help there. I know some churches have a benevolence fund to help with situations like yours; ours has helped so many. Is there a Mosque or Church you can walk to?
I want to acknowledge your spirt through this. Your willingness to go to work and be a good mother to your child is exemplary! From your letter to us, I saw your wanting to be responsible for the rent and bills, and the desperate need for food and care of your baby. Plus, I loved the fact you ran off that dirty drug dealer who sat down next to you and your husband in the mall! Good Girl! That was courageous in my eyes.
I will pray for you and baby until I see your next post that says, "WE ARE SAFE, WARM, HEALTHY and PROTECTED" ..... because I believe God will cover you.

I'm going to share something with you, and you and your fiancee can discuss it.
I knew before I filed the petition that the consulate in HCMC sometimes conducts Stokes interviews. I also knew that they were a relatively rare exception and not the general rule, like at some other high fraud consulates. The consulate in HCMC is one of the busiest in the world - I think I remember them claiming they were the 5th busiest. They don't generally want to spend any more time on any one case then they absolutely have to. They'd rather hand your fiancee a white denial slip and send her out the door then spend any additional time with her. And like I said before, this is the first time I've ever heard of an interview being scheduled after the visa had already been denied, and that required the petitioner to be present. I think there's a good chance this is going to be a Stokes interview.
My wife (fiancee at the time) and I discussed the possibility of a Stokes interview before I ever sent the petition. In fact, we discussed pretty much all of the possible scenarios. We decided how much we would be willing to take and where we would draw the line. Ultimately, we decided that a Stokes interview was crossing the line. We decided that if we were called in for a Stokes interview that we'd tell the consulate to get stuffed, and we'd walk out. We'd deal with the returned petition after USCIS got it back. I'll deal with any amount of bureaucratic delays or any reasonable amount of scrutiny, but I was not going to allow any government bureaucrat to force me or my wife to beg or to humiliate us.
This doesn't mean I would have given up. Far from it. I would have fought tooth and nail to keep USCIS from revoking the approval of the petition. If that failed then I would married her and started again with a spousal visa. If that ultimately failed then I would have gone to court. If I exhausted every possible avenue then I would have said goodbye to my family in the US, and moved to Vietnam.
I'm not telling you that this is what you should do. That's a personal choice only you and your fiancee can make. But you should discuss this with her, and decide where you'll draw the line. A Stokes interview can be very a very traumatic event, especially if you or your wife don't have a strong personality and the willpower to deal with it.

Friend Bruce: For as long as I've been a member of VisaJourney, I've been envious of (and, truthfully, awed by) the knowledge and supportiveness of the Vietnam members. Two of the very best (Jim and Anh Map) have weighed in here. Coralie has provided information about a Stokes interview (albeit for AOS and not for K-1, although the principles are the same), and the respected Pushbrk and Rebecca Jo are also keeping an eye on your situation via this thread.
If you can duplicate the exact text of the denial letter and the recent appointment letter -- omitting personal information, but otherwise verbatim and not paraphrased -- it may help us to help you. I also believe that you should consult Marc Ellis, the attorney, as a highest priority. Tell him that you're a VisaJourney member (as is he -- member name ellis-island).
Precisely because this sounds like a new situation in regard to the HCMC embassy, it's crucial that you chronicle every detail of what you learn from various sources, and of what happens. I wish that we Ecuador filers had had someone as potentially communicative as you, before WE got blindsided as we did. You'll be doing other Vietnam members a great service, and your words will be instructive to others, too.

Respectfully ... no they are not saying anything of the sort.
You are free to marry anyone you want. But your spouse is bound by the laws of The United States of America and he or she needs a visa in order to enter legally. Let's try to remember that these visas are a benefit (not a right) of OUR citizenship and NOT a right that is given to our Fiancées or spouses. If they tried to apply for one themselves it would take years to get ... if ever.
We all remember the frustrations and pain of waiting for our loved ones. Keep your eye on the prize... the day will come. Once it does, all the frustration you feel towards USCIS will dissipate.
Then get ready for AOS! I found it a much easier process and the fact that your loved one is with you makes it a much less painful experience.

What a great opportunity to say something unpopular!
According to the latest census, there are currently about 310,828,691 people living in the US. Although the Census doesn't tell you how many of those are of Russian descent (if this is what rocks your boat), it's fair to assume that there are more potentially suitable spouses for you than you can possibly check out in your lifetime.
The US Government does not regulate who you can marry, as long as it's a human being (no space robots, no animals) of the opposite gender. What you asked the US Government (not the State) for is to import yet another foreigner from a country that was the US's largest enemy for a very long time, shortly after a Russian Spy ring was exposed.
It is only reasonable for a government, any government, to secure its country's borders and make sure that no unauthorized aliens can enter it or live with it. The US Government takes this mandate very seriously.
