Never Recived the NOA2 and my petition expired

HI there,

I never recived the NOA2 and my i129F expired on june 2010. I did recived a letter that said it was approved but there arent any expiration dates on it. What can i do?

The NOA 2 is the letter that says your petition is approved and being forwarded to the NVC or consul.

Nothing you can do now its expired. File again and start all over, hope you made copys of everything.

:bonk: I am very confused....I did a K1 originally, and after noa2, it automatically goes to nvc, then off to the embassy overseas....am I wrong?? He would have had a letter from NVC, then once the embassy got it, would send stuff to the beneficiary...How could all this time pass without hearing a thing?? :huh:

sorry, just going by what the op saying the letter said approved....then that is noa2

The state department's national visa center has recently recived an approved I-129F petition filed on behalf of your fiance. This is to let u know that within a week the petition will be forwarded to the appropiate visa-issuing post where your visa interview will take place.

It gives me a cdj# but there is not an expiration date anywhere. My fiance is finishing her degree that is why we took so long if i knew there was an expiration date we would have gone over to Juarez before it expired.

My impression was they were approved for NOA2 and then had not had any communication sine June. They should have heard from NVC and the embassy by now.

exactly what I was thinking...unfortunately since the original petition has expired, you will need to refile....but am very, very surprised you never heard from the consulate..

k1's only have a 4 month validity date...so you wouldn't get the expiration date on the letter that you got....it would be on the original noa1.... Also, before you refile, you need to find out what happened to the first petition...make sure it is truly dead, then move forward!

You said in your opening post that the petition expired in June, 2010. If all you got was the NVC letter then how do you know when the petition expired? Before you got the letter from the NVC you should have gotten a letter from USCIS informing you that the petition was approved. That letter IS the NOA2.

Your timeline is also screwed up. It says you got the NOA2 on the same day that the consulate got the petition, and that packet 3 was received from the consulate last May. Where did you get these dates from? Did your fiancee receive anything from the consulate? Did she send anything to the consulate?

Actually, the expiry date is shown on the approval notice AKA the NOA2. Not sure if you just made a typo but I didn't want the OP to be even more confused.

I thought the letter he stated was from the NVC, I didn't think they showed expiry dates on that....that is what I meant...thank you for clearing it up though..because I wouldn't want to give misleading info!

Since the petition was approved and forwarded to NVC which then assigned a Ciudad Juarez case number to your petition, your fiancee should have received a packet with information on how to proceed (when and how to get her medical examination, police clearance, forms to be filled out, etc.) Are you saying that your fiancee never received suck packet or that you guys just ignored it and its intructions?
