    So we got the biometrics and picture taken during the appointment and they issues 1-year ADIT stamp! Cant believe it worked out!

    Thank you. I called to and made a request for appointment in the local office even though I was told by the officer on the phone that they might not stamp ADIT without biometrics. We got appointment for tomorrow 9am and officer on the phone now say that as long as we take all relevant documents (flight details, etc.) we should be able to get the stamp. 
     
    Will she be able to get the ADIT without having biometrics done?

    Hi there.
    I order to send AOS and supporting documents, both fees have to be shown as PAID.
    Call NVC in order to be sure on whether you're pivot or not (CEAC has been down for 12 days and a couple of non pivot cases recently changed to pivot).
    Pivot= upload documents online
    Nonpivot = mail documents to NVC
     
    What you can do for now is to make sure all documents are ready and translated if needed

    Here's the thing, if she's already in the US and you thought about filing AOS for her at the spur of the moment, that is fine. No visa fraud there because her intentions were purely tourism at the time of entry.
     
    Now if she has an upcoming trip planned to visit you and you're already pre-planning to file AOS for her while she's there, that means she would be entering with a B2 with intent to stay or adjust. That, is visa fraud.
     
    If you haven't filed the I-130 and you still want her to make a successful trip, perhaps let her make the trip and get home first before you file. With a I-130 pending, she might receive more scrutiny than usual at the POE. Can be stressful for an older person. Just my 2 cents.
     
    ETA: Please ignore the bolded part because you already filed for I-130 You're asking about filing AOS.

    The problem isn't the AOS process itself - it's entering with immigrant intent on a visa that doesn't permit immigrant intent.
     
    CBP will assess her intent at POE. Having a pending I-130 is not a cause for denial by any means (many people travel with a pending I-130 fine), but it does set a higher bar to show that she will return back home instead of staying/adjusting while in the US.

    Hi,
    It's ok to buy your ticket, everyone gets their certificate on the date of the oath. The only thing that I can think of that would affect you, is if you commit a crime that would void the moral character part of the citizenship, but only you would know that lol.
    Don't be concerned. As a matter of fact, if you have to travel and you don't have your passport you can always go in person to the passport office with proof of travel. You're here in NYC, the office is downtown, I think on Hudson St, I was there back in 2012.
    The passport by mail can take like 6 to 8 weeks especially for first time passport, so be sure you have this time from the date of the oath to the date of the trip. If not you will have to request an expedite and pay the extra fee if you do it by mail. In order to apply in person, it's the same thing, there's an extra $60 fee. Good luck.

    Also, just to note, in order to request an expedite the trip has to be in the next 2 weeks. So you would be able to mail it in for normal processing, but you won't be able to request the expedite until there's 2 weeks left before your trip.

    I had my interview on July. On that day the IO asked about what documents I brought to the interview.
    I gave to her (copies):
    - The last bills (ConEdison and Cablevision). Both of them, my Wife and my name are on the bills.
    - The last statements from our Saving and Checking Accounts (2 different banks). Both of them, my Wife and my name are on the Statements.
    - Our last Jointly tax return (Transcript from IRS).
    The IO told me that those documents were enough and even congratulate me for been well organized.
    Do not forget to take with you, whatever else they are asking in the Interview letter.

    Neither rain nor snow, nor sleet nor dark of night shall keep us from keeping an appointment with the USCIS. They put a noose around our necks, and keeping those appointments was the only way to get rid of it.
    It's the only agency I encountered where you cannot mutually agree on an appointment, even the IRS let's you agree on an appointment. USCIS must have used the German Gestapo book of holy hell to set up their procedures.

    Yes, the difference is I can count on my hand the number of countries one needs to apply for visa as a Canadian citizen and I can also count on my hand, the number of countries one does NOT need a visa as a Pakistani

    Stop being belligerent Ivriesling! You could go about this a different way suggesting the change of wording rather than complaining it's wrong. The VJ forums/community do offer a great service that's voluntary.

    This is not correct. If you naturalized while you were under 18 years of age you would have only gotten your US Passport, not the Naturalization certificate. You need to submit form N-600 to the USCIS after turning 18 to get your naturalization certificate. It is NOT required for you to have a naturalization certificate. I had the I-130 approved for me with just the US Passport. The Islamabad Consulate will be satisfied with your US Passport as well. No worries on the Naturalization certificate.

    US citizens get engaged and married to Pakistanis every day and have no problem meeting their significant others beforehand. There is an entire thread full of people here from Pakistan going through the process, many are not of the same religion. All have met the requirement of meeting within 2 years.

    Can you get a letter from accountant to acknowledge that mistake, and attach that letter with the application? There's always this "what if" - what if USCIS doesn't pay that close attention to , what if they do, then you have explanation letter.

    HAA HOO if your lawyer is planning on presenting a human rights watch packet as her case for asylum - that is something I would PAY to see.
    This woman sounds like a complete train wreck and if you don't follow her to whatever country she goes back to you'll probably be dodging a bullet. She ignored her every legitimate chance at a life in the US and now she's paying the price. Lots of fraudsters seem to ease through ICE's cracks so I, for one, am glad they nabbed this one.
