Nigel&Meggie reacted to Gary and Alla in Adding Proof of Relationship after NOA1
Your disagreement makes you strongly WRONG.
You need ONLY submit proof of meeting in person at least one time within two years of filing the petition. You do not need ANY proof of "relationship". You could have "met" at a "social", had NO relationship other than shaking hands, exchanging names and posing for a photo and it is sufficient for the petition.
I sent exactly ONE photo and a two sentence description of how we met in person the first time and copies of my passport stamps and boarding passes. That is ALL. No receipts, nothing. There is absolutely NO requirement that you do so.
"Proof of Relationship" is submitted at the interview. SOME people like to provide additional information with the I-129f for the benefit of the consulate (particularly with difficult consulates) and this procedure is called "front-loading" but it is NOT needed for petition approval and has no beneficial affect for the consulate in Kiev, Ukraine, which is not a difficult consulate.
The OP was asking if he needed to (or should) send additional proof of relationship for the I-129f petition. The correct answer is "NO"
If he did not include the required proof of meeting in person, he will get an RFE

Nigel&Meggie reacted to KittyPollitt in question about visa k1
Less than one year ago, you were posting about expediting a petition because your wife in the USA was pregnant and you wanted to come here sooner and help her. A few months after that, you were posting about co sponsors.
You're coming on here telling us now that the entire time your pregnant wife was struggling here in America, you've been chatting with another American woman online, YOU have been paying for long distance calls to talk to her (when you have a wife and child to support in the US), and you have this other woman coming to Morocco to visit you!?
Perhaps you should tell this other woman that you're married to another American and have a child here, instead of trying to scam her by telling her you're eligible for a K1.
You'd never get past the consulate in Casablanca anyway. Go ahead and try all you want.

Nigel&Meggie reacted to Meg and Nigel in Dealing with financial issues
A question for ladies with male fiances/spouses? As in, it is natural for men to send money to support their female partners, but a man should be able to take care of himself? The old-fashioned idea that men should pay for everything should have been left behind when women started working. I expect my fiance to support me in every way, including financially. I also intend to support him exactly the same. He gave up everything to come be with me. He sold his house, sold his car, gave up everything he had worked his whole life to accumulate. After a three month stay with me here in the states, he has returned home and is having a very difficult time finding a job, due to factors directly related to the visa process. If he can't find a job and runs out of money, I will send him some. I trust that he is a dependable man that will work and help support our family when he comes home to me. In the meantime, I will help him financially, because at the moment, I am the financially stronger partner. I am not saying that everyone should take this approach. Money is a complicated issue and different things work for different people. I know couples that love and trust each other very much but mutually chose to keep their finances separate. I am simply answering the question of what I would do in the situation, as well as expressing an opinion. If you aren't comfortable sharing finances now or ever, there is nothing wrong with that. But I personally don't see that withholding money only because he is male and should be able to take care of himself is very fair. Especially if you expect him to eventually get a job and share his money with you.

I can't believe that anyone would be thinking of marrying ANYONE else after only 4 weeks?
Are you kidding me??????

Nigel&Meggie reacted to ceadsearc in US Fiance died.. can she marry another person?
She can marry whoever she wants. She can never adjust her status, unless she returns home. If her fiance just died and she is already trying to find someone else to "start all over again" with, then she's almost certainly looking for a fraudulent marriage to get benefits from, and will probably be denied even if she does return home and "start over." She should return to her home country, period.

Nigel&Meggie reacted to NigeriaorBust in My Brain Storm
That would be unfairly prejudiced towards those that lack computer access and there are all sorts of rules about non verified access to computer databases that contain personal identifying information. Just to upgrade the computer systems and provide a method of secure validated login would probably double or triple the current costs. There would also be waits as all the original documents you have to provide would have to be matched up to the electronic files. It also prohibits the uploading of files from unknown sources inside the US not to mention that allowing foreign nationals on such a system is strictly prohibited. ( USCIS contracts the underlying database and all the rules would make your head spin )

If you have the funds and available time then you should meet as many times as you can. Don't feel that just because other people can't you shouldn't. Not everyone has that luxury and you are very lucky :-)

Nigel&Meggie reacted to JimVaPhuong in inspected by immigration officer in the airport
Your son is not eligible for a derivative visa because you and your husband were married after he turned 18. As YuAndDan stated, he would have been eligible for a K2 if you were applying for a K1, but you're already married so it's too late for that. Even if you weren't already married, it's highly unlikely you could get a K1 visa for yourself and a K2 visa for him, and come to the US and adjust his status before he's 21.
After you get your green card then you can petition for your son. However, he MUST NOT GET MARRIED. There are two classes of visas for a child of a permanent resident. FB2A is for a spouse or for an unmarried child under 21 years old. FB2B is for an unmarried child 21 years old or older. The chances of you getting a green card and submitting a petition for your son before he's 21 years old is practically zero. You simply don't have enough time.
Unlike visas for immediate relatives of US citizens, visas for relatives of permanent residents are strictly rationed. Only about 114 thousand such visas are issued each year in the FB2 category, with no more than 7% being issued in any one country. There is a waiting list for these visas. USCIS will assign a "priority date" to your son's visa petition, which is the date USCIS receives the petition from you. When the priority date becomes current then your son is at the front of the line, and can apply for a visa at the consulate in Saigon. The current priority date for FB2B visas with beneficiary's in Vietnam is April 15, 2003. This means you can expect to wait about 8 years, based on the current USCIS backlog. The wait time may get shorter or longer as the backlog changes. If he gets married during this time then he's no longer eligible for any visa as the married son of a permanent resident.
If you remain married to your US citizen husband then you will be eligible to become a US citizen three years after you get your first green card. At that point, you can have your son's petition promoted to FB1 since he will be the unmarried adult son of a US citizen. That will cut about two years off the waiting time for his priority date to become current. If he gets married then he'd still be eligible for an FB3 as the married adult son of a US citizen, but the wait time would be two years LONGER than the wait time for an unmarried adult son of a permanent resident.

Nigel&Meggie reacted to Brother Hesekiel in inspected by immigration officer in the airport
Mr. Thai,
yes, you are correct, you have a problem, and it's a big one.
See, the B1/B2 is a non-immigrant visa. Not only have you been inspected, but you have been pulled into what is known as "secondary" inspection. The fact that you have such documents with you on a vacation indicates immigration intend. You were specifically asks about this and you . . . uhhh . . . lied when telling CBP that you felt insecure leaving those documents at home.
I am absolutely sure that CBP entered your statement, and that's what that is, into the computer under your file. The way I understand your post, you now got married and are planing to adjust status. If you do that, you will be denied based on material misrepresentation. It carries a lifetime ban from the United States.
If I were you, I would return to Vietnam and take the CR-1 route. Seriously.

You don't even have a timeline so I don't really know how far off from NOA2 you are. The information should be "recent" however you want to interpret that. Estimate your interview will be two months after your NOA2. And I've written a lot of information in that K1 London guide if you would read it. There's a whole page on the I-134.

Nigel&Meggie reacted to dogspot in RFE after almost 5 months.....
This isn't necessarily true. See Ashex's example above - specify the state where you plan to marry? C'mon...that's not mentioned in any guide. There have been other examples of ridiculous RFEs over the years that no guide here or anywhere is going to help you avoid.
The way I see it, an RFE is a good thing. At least they didn't deny you. Reply to the RFE and you'll likely be approved the same day they receive it.

Nigel&Meggie reacted to leigh in Approved and ready to go!
Hello again everyone.
Well, the London Embassy received our file on 20 October, but we didn't hear anything from them so I called them on 20 November and was told when they had received my file. As I already had everything ready for sending off Packet 3 to the Embassy, I went ahead and made my appointment for a medical, which I had on 2 December. The staff were fantastic, polite and friendly and everything went well. A few days later, the Embassy finally sent Packet 3 by email and so I filled in the forms and sent everything off by recorded delivery post. I was aware that they give you 4 weeks notice for interview, but asked for their earliest appointment anyway, and was surprised to hear from them by letter on 22 January saying my interview date was 2 February! I went along with a large file full of evidence of relationship, sponsor information - just about anything they might want. My appointment was at 9am and I arrive outside the Embassy at 8.40am to find that you have to go through security OUTSIDE the building (just like the airport, have to put your bag through an x-ray machine and go through a metal detector. I already knew I wouldn't be able to take my phone, so I left it behind. Lots of other people were being redirected to a local pharmacy to deposit their phones etc before they could go through security. I got into the Embassy at 8.55 and was given a number. I sat and waiting for 10 minutes before my number was called, and a nice girl at the window took my original birth certificates etc and went through the papers in my file. She was very friendly, and asked me to pay the fee at another window, and then took my fingerprints. This took about 15 minutes, then she told me to sit back down and wait for my call for interview. I sat another 40 minutes and then was called up to speak to a lovely young man who made small talk with me while tapping some things into his computer. After about 1.5 MINUTES, he said Congratulations, your visa is approved! Didn't ask me for a single piece of paper, or even ask me any questions of note. Just pleasantly chatted to me about how I met my fiance, and what he does, etc. I was beginning to wonder when my interview would start when he told me I was done! After a brief further stop to give my address details to have my passport/visa couriered to me, I left. I was in the building about an hour and 15 minutes. Lovely! I've booked my flight for 1 March. My passport was delivered to me today with my visa inside, along with a large sealed envelope with instructions not to open it, but to hand it over when I enter the US. My point of entry will be Atlanta, so now all I need to do is find out from this forum if anyone has experience of entering in Atlanta, and what kind of reception they got. HAPPY HAPPY HAPPY!

Nigel&Meggie reacted to Brother Hesekiel in Dont want to get married
Hi, Peter,
sure you can get just a civil marriage. No need for anything church-related. You both keep your given names, don't need to have children, and be 50/50 partners in everything. It is a civil union, except they call it marriage here.

Nigel&Meggie reacted to sarah et luc in Impacts of TSC to CSC transfers in Oct/Nov/Dec applicants?
As a transfered filer I don't think anyone hates YOU. We hate USCIS. Your files will probably be on pause for a little bit (we were guaranteed an action by March 1). But CSC files over 20,000 petitions a month. Some of the transfered cases will/have been approved at TSC and some shipped back to CSC. I'm sure you wont feel the difference. They only had 36,000 to begin with. And CIS is doing mass approvals. (Probably not even reading what's on the petitons for transfered filers that is).

Nigel&Meggie reacted to CarlosAndSveta in Getting a bit hopeless
I am in my 37th year of working for the IRS so I think I have a pretty good idea of how government works. I know how the IRS handles Congressional inquiries and I know that they divert resources from other work. So to take care of the squeaky wheel other taxpayers suffer. In the IRS this may not be bad for other taxpayers since I work for the audit function but for USCIS it means that those that don't complain get worse service.
