Well, its official, after almost 5 months of feeling confident that the forms, pictures, phone records, and hotel bill would get me to my baby, an RFE is released in our names. Still havent seen the list of things they need, but I am not sure what else we can do to prove to them that we are in a comitted relationship.....

I do think it's BS that showing receipts from dinner and movies and gass bills are accepted forms of primary evidence, yet time stamped photos are secondary along with phone records.... It shows us together, and how often we talk to eachother..... :(

I have seen stories of other people on here with less evidance getting accepted, and it disheartens me to see my RFE. I can't really show passport stamps, because they just give me a quick scan and send me on my way.... what else can we include to prove beyond a shadow of a doubt we are together, and want to be for years to come?

I filed my petition in November so I am still waiting. I only sent pictures so I know we will get RFE. The instructions for petition say: provide copies of evidence that you and your fiance met in the last two years. I didn't know anything about primary and secondary evidence until I found VJ. It seems like people get approved really fast after you send back what they ask for so don't worry and it may be something else they need.

The problem for us is that I don't have much to send them when we do get RFE. We both drive, I didn't keep any receipts from tolls in the US (doesn't prove anything) or from the bridge and as you know they don't stamp your passport. The only thing I thought of is the possibility of getting a printed list from the border of all the times I have entered and exited the country...this is probably not an option but I don't have much more even though we visit once a month :(

Yeah, it's really upsetting getting an RFE. But if it helps, once you send in the requested information it really doesn't take them long to process it. Once they had recevied our RFE reply it only took them one day! Unfotunately, USPS lost our reply letter in the post for 1 week inbetween grrrrr. Of all the letters to lose :bonk:

Anyway, what I'm trying to say is, return the RFE info soon as you can and it shouldn't take long :)

uscis is only concerned with determining eligibility for the petition to be approved. phone records of how long you talk does not help in any of the categories for determining petition approval eligibility

Hi I seen your post and wanted to give you my story along with a little friendly advice.

Our case was complete on January 31, 2011. We filed the I130 on June 13th, 2010. At the 5 month mark we recieved an RFE.

I went crazy!!! :wacko: I cried so much and Ahmed said calm down baby, let us wait and see what they want. I said but I gave them EVERYTHING, everything they asked for I gave. I did not send in an overwhelming amount of evidence, I simply sent in my passport pages (copies) I sent in my plane ticket stubs, and that was all the evidence I gave the USCIS. But if you look carefully they do not ask for an overwhelming amount of evidence.

So when the snail mail letter arrived I ripped open the envelope only to discover our RFE was only to ask me to sign the G325! :whistle: Yes! That's right I looked over everything and made sure to send all they requested, but in my hurry I did not sign the form!!! :bonk:

So I of course immediately signed the form and ran to the post office to send back the form express mail, and within one week we got our NOA2, and since then we sailed smoothly thru the rest of the process. Of course Ahmed was always so sure to remind me to sign the forms! :rofl:

In saying all this I hope you feel a little encouraged to see that maybe it is just something so simple and you will take care of it quickly and be back on track so fast! :thumbs: Please try to relax and just wait for the snail mail, this journey is not always smooth and easy, but in the end one can overcome it all by being as calm as possible, and ALWAYS REMEMBER TO SIGN THE FORMS! :whistle:

Know how you feel and we too got RFE. We filed 129f last Feb and got RFE in June gathered what they wanted did it all over the weekend and sent it back pronto express mail.(my now husband falied to put pics, letter of intent :no:) We were approved within a week. SO don't worry till you get it and then read it slowly and send back what they want and bingo you will be approved.:thumbs:

Just to chime in with what some of the others have said, it may not be about the evidence you sent. Maybe some field got accidentally left blank, or some other minor mistake. You won't know until you get it and see exactly what they're asking for. Most of all, just turn it around quick and I'm sure you'll see your approval soon.

AN RFE is not really bad news. Sure an NOA2 would be much better, but what is worse? Getting an RFE, getting the adjudicator what he wants and getting your NOA2 2 to 4 weeks later, or having your petition continue to sit and rot on a shelf until Lord knows when?

I know how it feels to get an RFE after waiting so long, but like everyone else says, the turn-around is really quick and when approved, then things can really start moving!!! It almost takes you by surprise!! Concentrate on hope!!! :)

Don't stress! I got an RFE last week and it was because of me missing anything. They wanted to know what state we were getting married in. Now that's frustrating!

Seriously? The State? I dont even remember talking about that with her when we were filling in the papers... :S

Maybe it was just some omitted detail... I dunno. It just sucks they dont explain it for #######.... :(

They will state everything in the hard copy you will receive.

Relax. Now get to work. Get out one of those complete copies of your entire submission you made (as stated in the VJ Guides......You did follow the Guides, didn't you?) and predetermine for yourself what the omission is. This really isn't rocket science; you have the Guides and if you had followed them to the letter and signed and completed the forms using the Example Forms you wouldn't be in this quandry. Nothing you can do about it but move forward.....or cancel the petition. It is all up to you.

A few issues confused here. For a K-1, you need to prove that you met in the last two years in person. Phone records actually show that you were not physically together, but rather had to talk on the phone. TIme stamped photos can be forged easily. Receipts from a dinner in a place where both petitioner and beneficiary are known to have been is primary evidence. Gas bills is evidence for a bona fide marriage (which the K-1 doesn't have yet)... the couple are willing to connect their SSNs on a bill and get credit-score ticked if it isn't paid. This sort of evidence is not for a K-1 case, but good for AOS. At embassy stage, where the couple needs to show that the relationship is real, then phone records will be good primary evidence. Different evidences for different purposes.

Don't worry too much about the RFE though :) Once you send your response back, then they will send your NOA2 to you soon! At least someone is looking at your file now. Good luck.

Forgot about that one important thing there..... Thank you for making me see that while I am in a bit of a spot, at least there is more progress than before.... :)

But I brought up the phone records as a way of showing it has been ongoing. Thank god Rogers has the unlimited North America plan, and I snapped it up when I did... LOL
