On here I have seen maybe 2 cases? involving messy divorces where the beneficiary has tried to bring in the I 134, well thrown the kitchen sink at it and have been told it is not enforceable and their Lawyer needs to respond accordingly.

Different visa's have different requirements and the only way of making a sensible comment would be in connection with the specific basis. It does not appear you have a ban but that call would be down to the CO. If you did overstay by more than 6 months you have a 3 year ban, a year is a 10 year ban.

The most important thing about the I 134 is that it is not legally enforceable. So it really means nothing. That might help get somebody else clearly approvable on board. The I 134a is weirdly worded, very unspecific, and I have not seen any feedback on marginal cases. Big plus is that it is free so nothing at risk. Throw everything in and see.

There does not seem to be a magic term, I prefer Adjusting Status, obviously I went through this and there is no real difference between GC and having AP/EAD, being out of status is a different ball game.

You are in the grey area, EAD allows you to work. Obtain SSN, DL etc. You are not out of status. I have never heard of age being a factor.
