  1. Normally the spouse would move under SOFA and then you would file using your US address. To redirect you would contact NVC, if it is there and she is in Germany or ask Frankfurt to take it on if it has got to her Consulate.

I am not sure why this was raised, there is nothing to suggest it would be applicable here and in numerous prior discussions on this subject people far more familiar with religious practices than I am have conformed it is not an issue. I have seen one waiver granted I remember, a very different situation to this.

  9. That is one of the disadvantages of long distance relationships, time and cost, I assume here we are talking very long distance. Being blunt that is your issue to resolve, a different job?
  10. I am not currently using a lawyer as they are very expensive. Certainly not normal to DIY a WoM but it has been done. I am not saying it is impossible, there is a potential route very much depends how USCIS and the Consulate react.
  11. Never do anything on the first visit. I do not like the K1 anyway but obviously in this sort of case there are issues with the Family agreeing for a daughter to leave unmarried. Get a visit in and look to go the marriage route.
  12. l participated in your thread a year ago. Nothing has changed and it seems that the Parents were not petitioned. The Sibling is 31 so would be looking at retiring in the US through the F4 route.
  13. To state the obvious she swore under oath twice that she was married. Probably does not help that you did not know, questions the relationship. I assume they returned the case to USCIS as they approved the I 130 not knowing about these issues. There are two options in my mind. Refile an I 130 being upfront about her past situation. File a Writ of Mandamus to get action on the current case. Either way this is going to be a long and expensive process with possibly an insoluble road block. I would also be working on a plan B.
  14. Normally a Consulate would issue a RFE for the missing document, in this case the Divorce Certificate from the prior marriage. If they believe that she was not married previously then they would refuse the visa bot give the opportunity of filing a waiver, most well prepared waivers are approved. I do not think I have heard of a case being returned, well not for this reason, certainly for other reasons. Do you know why the case was returned. Which Consulate?

  18. I am not an Immigration Lawyer by any stretch but know a now ex Immigration Judge (retired), went to his retirement do, very interesting. So the one thing that was very apparent, and now this is Denver but I would place a quite reasonable amount on it being the same elsewhere, is that they all seemed to know each other, they deal with each other most days and it is for them a Job, Business nothing personal. So I would use a Lawyer who was well versed with the local USCIS office, knows the head honcho, has been to the sort of event I went to numerous times, and see if they can get it sorted on the basis of we really do not want to do this but here is the brief and if we can not sort out amicably we will see you in Court and it is going to be embarrassing. I only know one ex IJ and no current ones and seriously doubt he would have any time for this.
