Not something they can do so no. I personally know someone who was gone for 4 months ish and was given a hard time which persuaded him to naturalise.

Usually the question asked is if you can enter the US, assuming you are an Indian citizen you should have no issue entering India.

I have yet to come across a successful waiver for TB. Who would file and the hardships would be very challenging. I speak as someone whose family have a history of TB. As mentioned it would not make much sense as the treatment is quicker than the the time taken to process a waiver.

So he snuck in? To adjust status he would need to have a status to adjust from and he does not. I assume he is looking at ! 130 and I 601a but obviously a case for a Lawyer. -
