    Then - stop speaking to her.
    Then - start cooking for yerself - clean up yer mess after yer done.
    Schedule yer own time to wash yer own clothes.
    If she speaks to you, never, ever respond.
    It seems she's not there because she loves you - and you need to facilitate her transforming into a 'room mate with kitchen privledges' sometime this April.
    Later, after the child is born, have ONE conversation with her - to put the child up for adoption. Once the child is gone, you need to move out of the house, start a new life.
    [wait a mo, is this an April Fools Day post?]

    I have seen this kind of marriage before, she is NOT GOING TO CHANGE. You will needs to fiqure out how to live with this, the child will become a pinpong ball in this marriage. If she doesn't want to go to counseling, then you should go so you +1 can fiqure out how to survive this marriage.

    The income requirements should be at least 200% of poverty level for certain family members. Many classes of visa should be done away with, including the all the K visas. Restrictions need to be tighter on foreign worker visas. The loophole of staying in the country on an expired visa/I-94, etc, while the I-485 is being adjudicated should be eliminated, as should be refiling ad infinitum just to stay in the US. If you overstay, you go home, no reprieve, no waiver, no AP, no EAD.

    alrighty - this is gonna get messy.
    in about 20 days - call into USCIS, ask for an ISO.
    Once you get an ISO (that part was important, btw)
    ask them to review all returned mail pieces.
    Then ask them to go over your current address with you.
    They can't tell you the address that was used to send yer gc to you
    but
    they can tell you IF the address you give them over the phone
    is the same address as what was on the envelope or not.
    then
    ask them to resend all returned mail pieces to you, with the correct address (an ISO can issue a corrected address thingie in real time, btw)
    then
    tape a name card with YER NAME (Name as printed in the green card)
    to the post box where you receive mail, just inside,
    then
    bake 3 batches of brownies. Meet up with the usps postal carrier over a weeks time, 3 times in that week, introduce yerself, give a batch of brownies. They will remember yer name, will KNOW it's your address.

    He COULD follow the I-130 filing by filing the I-129F but it would just slow down the CR1 visa process. K3 visas have not been issued except in very rare circumstances, for at least two years and haven't saved any significant time uniting families for six years. Lots of out of date information out there.
    To the OP. Your sponsorship issues will not come up until several months after you file the I-130. No financial documentation is filed with the petition. If possible for you, you have those several months to get a job or better job.

    I suggest reading the guides and go through the USCIS instructions very carefully. If you made these 2 mistakes chances are you made more.
    By the way they may not send it back to you. They may just send it on the the correct filing location. Keep an eye on whether the check has been cashed.

    No such medical term as "just an exposure" it is, an 'infection.' latent tuberculosis infection AKA latent TB, or LTBI can go on to develop active tuberculosis disease . Infants and children under 5 years of age with LTBI, are at high risk for progression to disease. I'd say that's something to worry.

    My husband hired a lawyer for the entire process (until naturalization). He just did not trust filling up the form on his own when he did the I-797. Fortunately for us... the lawyer was fast and communicate with us very well... although right now that I am here I do not think there is a need, it was evident when we did our change of status coz all the lawyer did was sent the package, I have everything filled up and I even made a table of contents of our documents and when we presented it to the lawyer, she was impressed and sent the package right away the next day. We do not have RFE for both I-797 and I-485, though I-797 took more than six months (not the lawyer's fault).
    It helps also that the lawyer is just a few minutes from where we live... I hate to be engaged with a lawyer miles a way and the only communication available is phone and email. I need to have someone I can talk to face to face if i will have problems.

    Stop calling. They are call center operators not USCIS agents and they have no information other than what is in a 14 answer menu. You are wasting your time. USCIS does not do business by phone.
    Continuing to cll will just incrase your frustration. This is not UPS or Fedex, they do not care, they do not have to, you have no other option. Them's the facts

    a tier 1 csr can give very limited information...
    Tier 1 Customer Service Representatives (CSRs):
    Can
    •Relay basic immigration information to customers through scripts provided by USCIS
    •Answer questions about USCIS forms
    •Transfer calls to Tier 2 in certain circumstances
    Cannot
    •Answer specific questions about a case with the exception of information available through Case Status Online
    •Transfer calls to local offices or service centers where cases are pending
    •Provide legal advice

    as far as the rudeness goes, I've also experienced it with an ISO at the NCSC.

    Manila Embassy can be rough when it comes to cosponsors. Anyone who went through a different Embassy shouldn't be replying here because this is one of those "Embassy Specific" areas.
    The ideal situation is a college student or recent graduate who is just beginning a career as they are confident that there will be income and it will be on the rise.
    The situation you described will probably have a more difficult time with a cosponsor but that doesn't mean it's not doable. The best cosponsor is a close relative like parent or sibling.

    Hate: Just about everything else. Of course, I only spent time in southern Luzon, mainly around Manila Bay. I am liking less and less about the place everyday, including many of the Filipinos I meet that live here.

    OP if you have not done this, you need to make sure you get your child his/her PI passport if you do not your looking at costly fees from the BI (Philippine Bureau of Immigration) exit permit and or late fees, when the child exits the Philippines. One plus is with both US and PI passport your child will have Dual Citizenship, with out hassle of paper work/fees down the road.

    Medi-Cal is not an insurance program. It is a welfare program for the poor. A person must have less than $2000 in countable assets to qualify for Medi-Cal.
    Regular Medi-Cal is a means tested benefit that the I-864 sponsors will be liable for. Regular Medi-Cal is for doctor's visits and regular care.
    Emergency Medi-Cal is not a means tested benefit. The I-864 sponsors are not liable here. Emergency Medi-Cal is usually applied for in the hospital after a person has been admitted - it's to cover emergency care.
    Green card holders should not apply for regular Medi-Cal. If they get it, their I-864 sponsors will need to repay any benefits they receive.
    If you receive regular Medi-Cal benefits, your I-864 sponsors will be liable to reimburse the government. If your spouse sponsored you, then he/she would be responsible for all your bills. That's not insurance.

    Not necessarily. The standard yardstick is described in the I-864 instructions. They use total income if you filed a 1040 or 1040A, and adjusted gross income if you filed a 1040EZ. For many people, their 1040 total income is the same as their gross income. For some, like those with self-employment income, their total income is substantially less than than their gross income. There's a short list of deductions you can take before you calculate your total income on your tax return, including allowable business expenses.
    A consular officer will use their discretion if your most recent income tax return shows insufficient income, and you're trying to use current income to qualify. For instance, if you give them pay stubs that appear to show an annualized income that's close to the threshold then they may conclude that your income is insufficient, and either tell you to get a joint sponsor or deny the visa on the "public charge" determination. They can do the same if your pay seems to fluctuate from one pay check to another. They're even more scrupulous if you're self-employed and trying to qualify on current income. It's very difficult for them to know how much of your current annualized gross revenues is going to end up on line 22 of your tax return.
