Hi I sent in my I-129 application on 2/1/12. I noticed that the passport background picture that I attached for me and my fiance g-325a was not white but dark blue. When I visited the Philippines I and my fiancee asked the photographer for passport pictures and didn't realize the background color was wrong as per I-129 instructions. Should I expect a RFE from the USCIS? I sent my application to the Vermont Service Center.

129 instructions state it needs to be a white background

Hope you didn't mail your application directly to Vermont, the 129 states to mail it to the Dallas lockbox.

I did send it directly to Vermont Service Center and it was accepted when I checked the usps tracking information.

You won't get an RFE for the pictures because your package will probably be sent back to you because you sent it to the wrong location.

Should be white!!!

I suggest reading the guides and go through the USCIS instructions very carefully. If you made these 2 mistakes chances are you made more.

By the way they may not send it back to you. They may just send it on the the correct filing location. Keep an eye on whether the check has been cashed.

I saw that my check was cashed via the USCIS Dallas Lockbox. Therefore my package was rerouted from Vermont to Dallas

If your check was cashed then your petition was accepted. You got lucky. When they change filing locations they will usually automatically forward petitions for a few months, and then they start rejecting them and returning them to the petitioner.

The photo may not be an issue. The pictures my wife gave me were the wrong dimensions, and the background was light blue. USCIS accepted them.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
