    Call your local senator's office and ask them to make an inquiry. Explain what you just posted above and you are concerned about the expiration date in October.

    Whenever I contacted by senator's office, they were more than willing to help me. I had an answer within a couple days each time ( and they were checking on my case every week at the end... they even got our expedite request looked at and approved AND they called the embassy after the approval to make sure they knew it was an expedite ) I should have sent flowers to their office to thank them. Our lawyer was useless. As a matter of fact...the lawyer sent me an email 3 months after my husband came to the US asking me if I had any updates. Ummm. I was so angry ...I never responded. I think its the lawyers job to know these things and inform the client. My lawyer was a waste of Money....

    Don't listen to the lawyer. Please just call the senator's office...explain what you need and go from there. It can all be done via phone and email. Make sure you give them both of your phone numbers and email addresses. Google the senator for your state. Pick one and call.

    Yes, they can still deny your visa. So, if I were you....I would have contacted my local senator's office, explain the situation and get answers that way. Bypass your lawyer.. He doesn't care if you get approved or not. My lawyer didn't do a dang thing so I found out on my own. AP is normal after you send in all docs from the instruction letter. For us it was only one afternoon. Then the visa was printed and they called my husband to come pick it up. Obviously London is different than Costa Rica. Im wondering why you let a year go by without contacting the senator...

    Yes..i agree with the above comments too. Your letter is drawn out and you sound like you're whining. USCIS has access to better stats than we do. You better make sure you can back your claims. Also understand that millions of Americans go to college and end up waiting tables because they can't get a job in their field ( I their own county) everybody ends up doing what they have to do to pay bills. Your argument is very weak. Also....not being able to speak Spanish?????? Trust me...you would get by. And just like cities in the US, there are good parts and bad parts... You're argument is weak for this too.
    List your hardships from highest to lowest. Then list your evidence. Take it to a lawyer and pay to have him prepare your waiver.

    Its too long and notes from doctors may not be enough. Medical records are best. Also, consider what you wrote about you needing your wife to take care of you but you also state your grandfather needs you to take care of him.... If you are able to care for him, they might think you're able to care for yourself. Just the first thing that popped in my head when i was reading it. Out lawyer wrote a short cover letter. Be careful with the lengthy cover letter. The adjudicator doesn't have all day. You want to be short and to the point. Try and find samples of approved waivers on immigrate2us

    They are only asking you allow 2 weeks for them to receive it. Most people send it overnight with tracking numbers and end up calling the day the carrier delivers it. Nothing they do is predictable. I would give them at least a month after its received. Your package isn't anymore special than the thousands of other packages they receive daily. Be thankful you were able to respond to your rfe. Good luck

    I think getting the senator's office involved ONCE is fine. But after that, let them do their thing. Our senator's office contacted the USCIS repeatedly on their own. I think our waiver was a special case since it was approved for expedite but it was taking an unusually long time. Our senator's office even contacted the embassy after our approval to make sure things would run smoothly.

    Yep, I would go with the congressman's answer. The embassy just gives petitioners generic answers. And be prepared for a longer wait time.

    I have a friend who works in the VISA FRAUD dept in Virginia. They do use Facebook and can get access if they want to It doesn't matter if you have it private or not. I have also read on VJ that some consulates look at facebook. Do not think they don't have access if they want it.

    the 10 year ban will start as soon as you leave the US. Your Visa will be cancelled. . You will need a waiver to return or wait out the 10 years and re-apply for a tourist visa. You cannot petition for family members when you are in the US on a B2 visa. Its a tourist Visa. You get to visit the US... that's it.. its not a free-for-all to bring family members here.
    No sympathy from me either btw. You overstayed, you have to go home. I don't understand staying 7 years and now wanting to find a way to stay AND bring your family too? NO NO NO
    My husband overstayed his B2 visa. He had a 10 year ban. We had to fie an I-601 waiver so he could come back. It was expensive and it took a while. I don't see any options for you to even get a waiver as you aren't even married to a USC.

    This is why the immigration system is so fouled up today; people who are taking advantage of the system. Do you realize how hard it is to get a B-1 visa for many countries? And yet, you abuse it like Visas grow on trees. How dare you use this forum to try to assist you in facilitating illegal activities. This forum was designed for people who are trying to get their families, loved ones and business purposes here legally. VJ forum members, the best advise for those individuals who are looking to beat or get around the system, is to do it legally and we are not going to aid and abet illegal activity. What a slap in the face! That is so selfish of you to think that you are the only one with dreams of a better life for your family and only YOUR case matters!

    Hi,
    The 10 years visa became invalid the moment you overstayed.
    It's not true. THere is no way for you to get a green card or work visa by volunteering.
    There are two ways out, 1) divorce your Indian spouse, marry a US citizen, and adjust status, or 2) go home.

    Experience....my husband just arrived in the US 2 months ago. I also have a friend who works for the dept of state. I asked her about the updates and she told me the date changes when somebody updates a field. It does not update if somebody is just viewing the screens..you'll hear something soon.
