shefellfromheaven reacted to mymercy in November 2019 Filer of I-130 for parent
I’ve been off here for a while so I didn’t get to update my Mum’s case status.
She’s scheduled for next week … hopefully it goes well.
congratulations to all those who got approved and passed their interviews … wishing all those still waiting luck and speed 👌👍

shefellfromheaven reacted to Mike E in Husband wishes to leave me now after entering USA on a tourist visa. How can I cancel the IR1 visa which is already at the embassy waiting for the interview?
You need to focus on the high order issue here. Which is that if you don’t act before the IR-1 is issued then you will have a lifetime support obligation to your husband.
Worrying about his tourist visas is putting your financial health at risk.
Did you have a health issue that required an emergency B-2 visa? If you then tell the embassy this visa was fraudulent that can draw attention to you.
Get the I-864 and I-130 canceled and move on.

My mother got her visa and my cousin will pick it up tomorrow. The interviewe went great I just forgot to sent the original of my birthday. So I had to wait almost 2 weeks for it to arrive then CEAC updated the status to issue on July 9th.

For my application, I used a copy of my birth certificate and naturalization certificate. I got an RFE due to mismatch of names ( my mum’s passport omitted her maiden name which was on my birth certificate). I submitted my baptism card , which had her maiden name listed and it was approved. I did not use any affidavit.

Thank you. Yes, they requested the original of all documents.

My parents had their interview today. They were interviewed together by a friendly officer. They were interviewed about 2.5 hours after their scheduled appointment (8am local time).
The interview lasted around 20 minutes. They were asked to provide a new police certificate (which they fortunately had), marriage certificate, their birth certificates, and my birth certificate. They were asked about how I got to the USA, information on my employment history, where my sister lives and why they decided to relocate to the USA and not where my sister lives.
Besides the wait, they had a very pleasant experience and they are extremely grateful that they have been approved.

They also requested for my W2s to show how much I earned ( I filed taxes jointly). I provided the W2s and they were accepted . You just have to provide the documents they requested.

My mother document got qualified.

Review the RFE and it should say why it was rejected. My assumption is they need your tax transcripts instead of W2 and 1099 for proof of income.
but RFE will list exactly why it was rejected

shefellfromheaven reacted to retheem in Wife came to the US and left me 3 days later
She waited for 2 years coz she knew she will be an IR1. Forget about her and move on. On a side note, I have seen lots of cases like that; you will be surprised to know that most of those people never progress well afterwards. Life has a very funny way of teaching one a lesson

Good catch! It just proves that we have to check the status manually and don’t rely on email updates or mail. Hopefully your I-130 will get approved soon. Good luck!

shefellfromheaven reacted to SteveInBostonI130 in I-130, Part 5, Q1: Previous K1 petition
First, withdraw your K1 petition. USCIS will not approve your I-130 while your K1 is active. They will state that the beneficiary has a pending active petition.
Second, the answer is YES. I-129F is also "a petition". On Part 5, Item 5, enter "Withdrawn - K1" Then in Part 9, enter the details of the K1 petition.

I was able to respond with a Proof of Registration of Birth document, Baptism Certificate and Affidavits of Birth.
The cases have now been approved.
Surprisingly, They reviewed the RFE response and approved within 1 day - I thought there was going to be a long wait.

shefellfromheaven reacted to Lucky2Lucky in Help! K-1 wife almost 3 years in USA, haven't filed AOS
It’s nice to hear you have been working on turning your life around. Good luck and keep looking forward and not back- you aren’t going that way anyway 🙂I would highly recommend you enroll in a community college whether for an associates or a certificate program. With your income and family size of 3 I strongly believe you will receive full financial aid. When my income was a tad higher than yours my husband received full tuition for his first year and we are only a family of 2. Maybe there is a drug and alcohol counselor certificate or something in Plumbing, HVAC, electrical etc. even if you take 2 courses a semester you will eventually finish. Fields in plumbing, electrical etc is in such HIGH demand and doesn’t require a bachelors degree. You can also try places like Target which is committed to raising minimum wage to $15 an hour- ask your supervisor at Dominos for overtime or ask your coworkers to call you if they call out and you can work their hours.
Good luck and keep moving forward.

@Dante2019 - I did not attach the mentioned additional evidence since I had all that was required for primary evidence. I hope this helps

That‘s a good idea. I did not give it much thought 😊😊😊like you’ve done since I figured they could get that info ( background checks) or ask for more verification ( should they need it).
