    not true.
    Ice just follow the court order. ICE don't approve or deny the case. its EOIR where USCIS will be represented by attorney and Alien can either go pro se or hire and attorney. ICE only can detain the person if he/she is on flight risk. Hold then till Judge render his decision and then only they do the required steps to remove alien. Of course there will be removal officer assign when alien is detained. He will work side by side to aquire the travel document and permission from the country of origin so he can do his job to remove alien when time comes.

    I'm on here because I've gained a bit of knowledge about this process, and I like to help people by giving advice on interview related issues, red flags, denials- these are devastating issues for people, and they used to take the forefront of the front page of VJ. Now, all that is seen on that front page is whining about "where is my NOA2". Threads upon threads of it, and it's tiresome to see the same basic thread posted over and over again, when there are people on VJ going through serious immigration related problems. Waiting is not a problem, it is an inconvenience.
    Don't get me wrong, I have compassion for what everyone is going through with these extended processing times, I really do. But spamming the board with threads constantly complaining about it isn't going to change it.

    Ok, how about this- if the most difficult part of your process is waiting, just thank God you have an easy consulate. If you don't want to wait, move there. That's what I did. You gotta problem, you fix it. If it's so terrible to wait some months for a visa, take a leave of absence and go. I'm not rich and I did it after I filed, just so I wouldn't have to come on here and ###### and complain.
    Come on here and complain about getting denied. Complain about them losing your paperwork or mistreating you at an interview. Don't complain about the processing time that you KNEW you'd have to wait through when you filed. This board has been taken over by this mess, and it gets old.

    In my not so humble opinion, her chance to "win" her case is 0%. She simply has no basis to adjust, the law spells this out explicitly. Thus, even if the judge is super sympathetic to her, I don't see what choice he or she had in not ordering her deported. The very best she can hope for is VD, and if the judge feels that she might want to stay, which she actually wants, a deportation order is actually more likely.
    So while there's nothing to win, but so much to lose, I cannot think of any reason to wait this out. She should just ask her attorney on what legal grounds he or she feels she has a chance to remain in the US. I would love to hear the answer to this.

    Of course the Attorney going to do their job, isn't she his/her cash flow, I think Attorney loves these kind of cases, They see dollar sign all the way through the departure of the immigrant.

    My suggestion is to focus on one petition, get the stack built and throw away the copies you made. Then, on the way to the post office, stop ad FedEx Office or Office Depot etc and hand them the whole stack. Ask them to scan the entire stack, in order, to a single PDF file, reduce the file size and put it on your thumb drive or burn it to a CD. That way you have a soft (electronic) copy of the whole stack without worries. You can email it to your fiance and upload it to your own computer. If you want to print it, fine. This way, if there are any problems, you'll know exactly what you sent.

    I work with a lot of people who are in their 60's. They might live to be 80, but they're not going to be working till they are 80. Some of them are just hanging in there now.

    So, why are you trying to expedite? There undoubtedly are many individuals who have been severely effected from this catastrophe who are alsowaiting on the USCIS, and you are going to try and jump on the bandwagon? *shakes head* My heart goes out to all those who have been effected - losing homes, loved ones, and life as they previously knew it, in Japan and beyond.
    I'm not all fluffy and going to tell you good luck like others. This seems selfish to me and you are seeking to utilize the misfortune of others to your own benefit. Requesting an expedite due to the earthquake is completely different from your having to wait 6+ months. I do hope you get your NOA2 soon as you have clearly waited your turn and been patient for so long, but really frown upon such an expedite request.

    Mr Longawaiting1, with that type of mouth and attitude I can tell you now, you will have a problem adjusting here in the USA. You should continue with the no problem man attitude, and it will come soon. Good luck on moving forward.

    its normal for stress to impact the relationship... It gets worse if the case gets put in AP after the interview... use the stress to bond together rather than pull you apart... its the two of you together aganst the system.. not against each other...
    Just a note to everyone.. Please DO NOT SET DATES.............. DO NOT EXPECT THE VISA IN A CERTAIN NUMBER OF MONTHS.... it makes things far worse if there is a delay.. Many here had the interview over a year ago and are still waiting...

    Embassies and Consulates will not shut down even in a government shut down. The President by executive order can keep certain departments of the government operating regardless, one of which is the diplomatic corp.
    Other obvious ones are homeland security, FBI, etc.
    Anything to do with security and protection of citizens abroad does not close down.
    Many people here think an Embassy or Consulate is strictly there for VISA or relations with another country, when the actual function is to help American Citizens abroad.

    I do get a kick out of how the Brits always know what's "proper". If the government shuts down because they don't have a budget, that's a shame in many ways for all who are inconvenienced. Certain adjustments need to be made when dealing with immigration matters. Some of them may feel "improper". That's how the cookie crumbles. We've all been through it and understand the emotion.

    Part of your statement is incorrect, my sister got an annulment of her marriage, her ex and her had a child together. there are many different reasons for an annulment.

    In most states, the two general grounds for annulment are incapacity and invalidity. Incapacity means one party is unable or unwilling to engage in marital relations. Invalidity means the marriage was never valid, usually because one or both parties were not legally able to marry.
    If they were both legally free to marry then they can't get an annulment based on invalidity. They have already produced a child, so they probably cannot get an annulment based on incapacity.
    Do you know what grounds your sister's annulment was based on?

    Many VJ members suggest contacting immigration attorney Laurel Scott (http://scottimmigration.net/ ) in your type of situation. I believe that she has weekly online chat sessions as well.

    They dont know anything about it until they start the review.(as I said before. the person on the phone spoke beyond the skope of thier experience and job position) If the adjudicator has a bunch of 'easy' cases then that persons load moves through faster... This topic has been beat into the ground so many times before its ridiculous... The system is what it is and until the new electronic modifications are implemented it will continue this way... The processing dates are estimations/goals and not carved in stone dates... If one adjudicator is smokin through cases and your case is being handled by a sloth, then it will take longer for your NOA 2 than a case going through another adjudicator... All this topic does is cause those who are already frustrated to become more frustrated,... There are very few things that you can do to cause anything to happen to speed up your case. Complaining about the fact that someone got an NOA2 faster than you is like a 3 year old ranting because another kid got more ice cream...

    I'm sure there are actually hundreds of petition approvals every day from each service center (CSC and VSC) but USCIS doesn't report to VJ. What's taking so long is you are waiting for your turn. Until it's your turn, don't expect that anything is happening at all. For the most part, petition processing doesn't take long at all. It's the waiting for your turn that takes a long time.

    All of your outstanding debt will eventually cross- reference itself to you by your address, which will give your brand new spanking SS number. Debt does go away in a year or two, bdebt can stay on the books for 10 to 20 years and smeone will match the two together. So tomorrow you may show no debt, but later this debt will show up in your credit report. Creditors don't just use SS to match up debt, there are other forms of ID used to match you to your debt.

    No, it's definitely not an extension of the visa.
    You're confusing two different things here. The visa allows her to enter the US. That's all. She'll be granted a period of authorized stay when she enters. The I-94 she fills out will be stamped by CBP with the entry date and length of authorized stay. The class of entry will also be written on the I-94 (e.g., B2 in this case). How long she can stay in the US is determined by the dates stamped on the I-94 - not by the validity of her visa. Most B2 visas are valid for 10 years, but CBP never grants 10 years of authorized stay to someone with a B2. The statutory maximum is 1 year, and six months is the most common. Your MIL was apparently given a much shorter duration B2. The consular officer has the discretion to do this if they are suspicious. The other option would have been for them to deny the visa altogether.
    The I-539 is for requesting an extension of the period of authorized stay, or for requesting a change to a different non-immigrant status. It's not for extending the validity of the visa. There is also no need to extend the validity of a visa while the alien is in the US because the visa is used for entering only. As explained above, the visa doesn't determine the length of stay. Once outside the US, an alien would have to go to a US consulate if their visa is expired. Consulates don't usually extend a B2 visa. They just issue a new visa with a new expiration date.
    If the consulate issued a single entry B2 then they probably weren't satisfied that she has sufficient ties to her home country, and suspected she might try to immigrate if allowed to enter the US. They decided to give her a chance and allow her to enter one time. It's highly unlikely she could go back to the consulate now and have the visa changed to a multiple entry visa. The consulate has already basically said "no" to what she's wanting to do.

    The example you cite states "Neither USCIS nor an IJ makes a finding that the Alien was out of Status", I read that as being specific to the example not a general statement that having D/S as authorized stay makes such a fact in your case.
    If the school you attended did as they are required and notified USCIS when you stopped then USCIS would have determined that you are in fact out of status and you would have then begin accruing illegal presence.
