Do you not report this income on your taxes? You better hope you never get audited.
Even with a sponsor, you need some income or assets. You can get denied even with a sponsor if your personal financial situation looks very bad.

This NVC stage is so stressful  it's "only" been 6 weeks for us but other couples with the same timeline and Embassy have already been shipped and were able to schedule their interview so now I'm wondering what is wrong with our case. It doesn't help that the NVC doesn't take phone calls and provides no information whatsoever besides the case number they assign. And the longer this stage (arbitrarily) takes, the longer we have to wait to get an interview...

It's just a matter of a few days from "in transit" to "ready."

The DS-160 is valid for 1 year after submission.  The only reason some (including me) suggest waiting until "ready" is just in case there is some last-minute change you want/need to make.  Hopefully you already filled everything out and are just hovering over the "review and sign" page.

You are close enough to go ahead and submit and pay for it.  It will take more than the advertised 4 hours for the payment to show up as valid.  More like 24-36 hours.

This post is only in reference to the Philippines.

    Hey everyone,

I just received my NVC K1-FTP on May 7th, and I'm eager to move forward with the process. I've heard some conflicting information about when to fill out the DS-160 form, so I wanted to clarify a few things.
Firstly, I checked the status of my case with the provided case number on CEAC, and it currently shows as "in transit." My understanding is that I can start filling out the DS-160 form now, but I shouldn't submit it until my case status changes to "case ready." Is that correct?

Another question I have is regarding the visa fee payment. Should I pay it now while my case is still "in transit," or should I wait until it's "case ready" before paying the fee and scheduling the interview?
Additionally, for those who have gone through the process for the Philippines, I'm curious about the typical timeframe from "in transit" to "case ready." Any insights or experiences you can share would be greatly appreciated.

We've been waiting since March 11th. I have no clue why it's taking so long for us. 3 times longer than the average of 20 days.

Looks like it was more than 60 days after they received your response. You should contact them and possibly your congressperson/senators.

Hello, my fiance is also French and we had our I-129F petition approved at the end of March. The NVC took 4 weeks to ship our case and we received notice from the US embassy in Paris today to schedule the interview. The earliest interview was the end of October though so expect it to be in November for you.

The only notification you will get from NVC is an email when they forward your case to the embassy.  You can request the case status and case number from NVC using the NVC Public Inquiry form: Public Inquiry Form (state.gov)

You should send an inquiry once a week until they assign your case number.  Once you have your case number, you can track it using CEAC: CEAC (state.gov).  Choose immigrant visa.

NVC will take a few weeks to a few months, depending on how lucky you are.

For the Philippines, once you have your MNL case number, you can complete the DS-160 and schedule your interview.  You will probably not be contacted by the embassy, except maybe an email when they receive your case.

Since my wife just went through this I will post our experience.

    1. to move quickly after US entry we applied for a Marriage License in Colorado before going to the Social Security office. The County required her to sign an affidavit stating that she did not have a SSN at the time we applied for the license.

    2. We went to the Social Security office with all the required documents (her Argentine passport with K1 Visa and POE stamp, I-94 form and just in case, her I-797 form from the I-129F submission). All was OK and they approved the SSN request using her maiden name.

    3. We got married, submitted the completed marriage license and waited for the recorded Marriage Certificate to come back in the mail.

    4. We went back to the Social Security office with the Marriage Certificate and requested her name change due to marriage. No problem at all and we got the updated SS card in the mail days later. That was the first official name change document.

    5. I completed and submitted the I-485, I-864 and I-131 using her new married name which should result in an AP and green card in her new name.

Sorry for all my anxious posting. Atleast we are now living proof that you can still be approved despite many weird small things that could have caused an issue and random status updates!

I just figured out a couple days ago that it was possible to start on the DS-160 simply with the case number.  That was probably the most frustrating part of this whole process: time wasted while our NOA2 was sent to NVC, when after two weeks we could've submitted an inquiry for a case number and gotten to work.  A month later, I figured it out and requested the number.  We should be in the caseload sent to embassies this week though!  Our DS-160 is completed and submitted as well, pending passport photos, which we will simply bring to the interview as stated when we bypassed them.

Also, per advice on this site I sent another inquiry to add my fiance's email as beneficiary to the case, just so the embassy can contact him directly (I hear South Africa will send out packets 3/4 by email to him).

    Good luck to you!

There is remote possibility of this becoming an issue in the future.
What's the long term plan? Are you going to have this renter in your house when your fiance comes over to the US? You know USCIS, if they don't trust the marriage, can always knock on the door and check who lives in the house? They are somewhat old school and may be surprised by arrangement.

    Are u muslim ?
According to the traditional interpretation of Islamic law (sharīʿa), a Muslim man is allowed to marry a Christian or Jewish woman but this ruling does not apply to women who belong to other Non-Muslim religious groups, whereas a Muslim woman is not allowed to marry a Non-Muslim man of any Non-Muslim religious group.

and no, u will be considered married under the laws of Islam ,  her family and the country
    and IMAM will register it

    1. You will need to fill out a separate I-134 for each of them if they are both applying for a visa through you.

    2. Correct, she has 1 dependent.

    3.correct, 0 dependents for you.

    4. Yes. I was a bit more detailed putting “provide housing, food, health insurance, and any living expenses”

    5. It’s always better to be over prepared than underprepared. If you’re income is well over the minimum requirement you should be good with the tax transcripts and a few months pay stubs though. I took everything to the interview to be safe and let them decide what they actually needed at document submission.

I recommend taking 3 years tax transcript from IRS website, 3-6 months pay stubs, and a letter from work stating your salary. If you take W2s probably just the most recent year.

My NOA1 is July 31st, so, basically August. I never guessed we would have received it so early. I'm so happy we got to celebrate the approval together and with our families.

In the US, creating images that some consider obscene or pornography, is completely legal and is protected by the 1st Amendment of the Constitution.  There are numerous court cases that confirm this, including the US Supreme Court.  A simple Google search will put your mind at ease about this.  Child pornography is illegal in the US and could get you in big trouble after you arrive, or could cause a denial of your K-1 visa.  If none of your digital images depict children you should be fine.  I suggest that you describe your work/career as a "digital art creator."  The officer doing the interview in Rio will most likely not even ask you about it.  They will be more concerned about the circumstances of how you met, how many times you have been together in person, ability of your petitioner to financially sponsor you, and your past US immigration/non-immigration visa applications/history, if any.

We filled in July. I'm visiting my fiancee in a few days. We might end up getting approved while I'm visiting her! We weren't expecting NOA2 until April the earliest. Crazy to think we could get it any day now.
