    Still waiting on my RFE that was from 8/24.  Coming from California to Wisconsin.  But dang I would have walked it here faster!  Anyone experience such long wait for their RFE?

    This makes me so annoyed lol. Like yeah sure happy that they’re case is moving but it’s so frustrating waiting for 8 months and they get it in 4 like 😣 The officers should only process in order cause it isn’t fair. I know I sound like a child lmao but I’m just so disappointed and disheartened by everything going on and embassies being shut. Curveball after curveball

    We are January 14th and nothing yet. I try to stay positive and not think about it all day, but it is definitely taking over my days...

    On a serious note, when I filed petition for my Fiance back in January I stumbled here on Visa Journey and a lot of the senior members had a system similar to this going in many threads, September, October etc.
     
    So I started compiling data from the case tracker app and typed almost 18000 wac numbers and then separated them based on what they were then created this chart based on what works for me easiest, rest is all excel. It's time consuming, but helps me deal with the anxiety of waiting 😅.
     
    I am hoping our file number comes soon, we are NOA1 on 26th Jan, so if you like my chart send us lots of prayers 🙏 ❤

    I've been obsessively checking the status of my application after seeing the approvals here. I'm so used to checking and exiting the page (multiple times a day), that I almost exited before seeing that I got approved!! haha NOA1 date 01/19 and now NOA2 date 08/23.
     
    To all of you waiting, don't lose hope, you are almost there!

    Hello! We're really happy to update that our case has been approved! Although we didn't post much on this forum, viewing everyone's posts made us feel less alone and less anxious about the whole process. We are waiting for the approval notice but we happened to see that our case has been approved when we checked the USCIS website today!!
    Hang in there everyone!

    It's okay. Logically, it makes sense to ask and with stuff like this, I think it's better to ask than to assume. Yeah, unfortunately, there is no way for anybody to predict the exact dates of your case. You won't know until you get the notifications that things have been approved etc. Even after the interview, it may take a few days for the embassy to say your passport is ready with the K1 visa inside. Additionally, you don't know what other personal things that may come up around that time that you have to deal with it before finalizing your move to the US. So we tend to tell people here, "Do NOT make plans until you have your passport (or whatever documentation/visa etc) physically in your hands." Apply for the I-131 when it's time to do so and make your decisions from there.

    you would not get AP in time to travel back if your visa is approved as you think
    but you could delay the visa process by not scheduling the interview till you're ready
    OR do the interview and not the medical exam (as the approval will wail on exam results )  visa is good for 6 months after medical 
     
    i would not worry untill you know the case has gone to embassy /November may not be likely

    It would largely depend on when exactly you get the K1, enter the US with it and then file for adjustment of status. Advanced Parole is taking 6-8+ months on average (notice the "+" sign, meaning you could take a while...). Mine took 8 months back in 2017-2018, long before COVID. So there is that to take into consideration. You don't need a "good reason" to apply for Advanced Parole if you're filing for adjustment of status. You can just file for Advanced Parole and you should get it without issue.

    Others have said it but I will echo: make sure this is what you really want. Starting all over from scratch will take a lot of time and money if it turns out your issues are workable. Obviously abuse and fraud are one thing, but a lot of times it's just poor communication that's behind disagreements. Have you asked others who know both of you whether they think what's happening is a total dealbreaker? Sometimes hearing a third party's thoughts can help turn down the heat.

    I just realized I haven't introduced myself yet, so hello everyone!
    I'm an Italian postgrad student, dealing with my last exams, the life at my parents' place again after many years alone, and an intercontinental long-distance relationship!
    My fiancé is a purebred Wisconsinite, and he was my very first contact with the US. I am from the very South of Italy, but I lived for 9 years in Tuscany, and one in the UK.
    We met on a penpals forum, started chatting cause I had just moved back to Italy after a year in Scotland and I wanted to keep practicing with English,  and he speaks Italian (he loves Italy and was planning to move here when he retires. I always tell him that he wants to marry me only to obtain the citizenship) but it was getting rusty. None of us was looking for a relationship, but the good intention to stay friends lasted maybe a month, or less haha. 
    So here we are now, with our journey with the k1 visa just at its beginning. We haven't met since late april last year due to the travel ban, but we're looking forward to hugging again, and starting to plan our life together.

    First of all, this is not true.  When you entered the US the last time, I'm willing to bet that you didn't say that the reason was to get married.  You wouldn't have been admitted under the usual 6 month waiver.  They would've sent you home and told you to apply for the K-1.  Therefore, if you came as a tourist, you lied; wittingly or unwittingly.  And this cuts both ways.  Canada would likely judge this situation similarly.
     
    It doesn't matter what you would have said.  You didn't apply for advance parole, we're in a pandemic (so nearly every tourist waiver is void), and you have zero legal status here in the US because you never filed to adjust your status.
     
    Again, they wouldn't have admitted you regardless of your reasoning.
     
    It's called a locksmith, USPS, UPS, FedEx, or Canada Post.  You're not going to be admitted just to quickly grab your things.
     
    There's a saying.. "Ignorantia juris non excusat."  In other words, ignorance of the law doesn't excuse you.  You had plenty of time to do research before you left.  This is an Internet forum.  You should be contacting an actual lawyer, not keyboard warriors like myself.  Regardless, a CR-1 is going to take 7-10 months minimum.  And that, of course, assumes that you didn't have any denials and/or you hadn't previously traveled under the wrong visa type.  You pretty much have 2 strikes against you right now for your "quick trip" to Canada.  You're lucky that the USA is more forgiving than Canada and you're CR-1 will still likely be approved with some headaches.  I've heard that US spouses living in Canada have difficulty getting citizenship.  I've traveled all over the world and the most hostile border I've ever been to is Canada.  I wish I could empathize, but this post is a bit annoying.  So many people on this site do everything correct, submit their paperwork, wait in line, wait again, and mortgage their lives to make this work.  You had it much easier than most everyone on here and you just blew it.  Sorry, not sorry.

    You're not OP, you're playing roulette with OP's status.  Right now they've gotten a strong mark against them.  Maybe they can convince the next agent of the things you say, maybe they get a 5-year ban.  50/50 right?  What have you got to lose?

    She can visit you. And I-130 is the start of CR1. Read the guide already. It provides all the necessary info.

    Your wife files an I-130 to start the immigration process.  As stated earlier, it's 12-18 months for you to get an immigration visa.  Upon entry into the US with your immigration visa, you automatically get a green card.  It's not 3 months, absolutely no way.   You do not apply for a green card within the US.
     
    It doesn't matter that you worked for a Canadian company.  Your visa free entry into the US does not authorize you to work from inside the US.

    Without a work permit, this is in violation of the terms under which you were admitted.

    The wait times are what they are.  Join the queue.  Just about everyone here has had to wait to be with their fiance/spouse.
     
    Did you really do no investigation whatsoever into US immigration when you married an American?
