Awesome.  You two are definitely in the drivers’ seat on this.  You can get her REAL ID as soon as you are married and you can married the day she arrives.

Thanks for this guidance. In my case, we are lucky that my fiance already has a SSN as she previously had a work visa many years ago.

Thank you. The reason I was asking is because I wanted to be entirely sure. I didn't think it would be an issue. On another note, is there a need for you to question my post? If you have an answer, as you did, please just respond with that. Your asking 'Why would it be a problem?' doesn't add any value and comes off as a bit snarky.
Save time and money. Plus you don't have to put on pants, if you don't want to.

There is also a pinned post at the top of the forum that relates to negative attitudes on the forum. I was simply pointing out that asking a snarky rhetorical question is unnecessary and can be interpreted as a negative attitude. If I knew the answer to the question, I wouldn't have asked. Isn't the whole point of the forum that people should feel open to ask questions without judgement and for others to help them in a positive way? So I hope the mods point that out as well.

I just learned that Utah allows for online marriage license applications. Are we allowed to apply for our marriage license before my fiance enters the US as long as we don't actually get married until after her arrival? We do so after she receives her visa and knows her travel dates. Thank you.

Although your photo is very small, it looks like you may be of Asian descent. If that's the case, there are two organizations in the DC metro area that might be of help to you:
Asian Pacific American Legal Resource Center Asian/Pacific Islander Domestic Violence Resource Project

I'm no expert here, but it would seem to me that you did not only not offer up anything that was not asked, but you misled them with this answer. If you were traveling to the US to marry your fiance, then the purpose of your trip was not simply to visit. I'm not criticizing your actions. I am simply flagging this for others to consider who may be thinking about doing the same thing, as it may not always work out well.

Personally, I wouldn't waste money on a lawyer to file a FOIA. I've filed one before with DoS and it is super easy. They guide you through the process on their website: https://foia.state.gov/Request/Visa.aspx

I just kept logging in and click “reschedule” on the left.  You can do that without risking your current position.  It will bring
up the calendar. Two days after scheduling my original appointment, I saw an earlier date appear and rescheduled to that date.

Ok I added more info.  The software does not let me put consulate receive more than two months later.  So I just put two weeks after it was sent.  Also, the embassy now combines packet 3 & 4.  So make sure you see the latest combined for on their website and not use the old form.

My fiance arrived into DTW a few days ago on a pre-existing B2 visa. We received our NOA1 for the K1 many months ago, but are still waiting for a NOA2. She is Thai and when she checked in for her flight in Bangkok the airline made her sign something agreeing to be returned to Thailand if she was not allowed entry. They told her that they had to introduce that since lately a lot of Thai citizens were being rejected for entry into the US. On arrival, they of course took her into secondary. She was there for over an hour, and they asked her a lot of the expected questions. They also searched all of her luggage in full looking for any signs of her intent to stay. One thing to flag that might be of interest to others is that they tried to trip her up a few times, asking her why she doesn't just stay in the US and wait for her K1 to be approved and also why she doesn't just get married now and adjust her status that way. Each time she responded that she has to go back to Thailand and has no intent to stay. She also had a letter from me stating that we have no intent to marry on this trip and that she will return to Thailand before moving here once her K1 is approved. She also showed them proof that she has a condo and a car in Thailand, as well as that she has income and sufficient savings. Since she is staying for just under 3 months, they also asked her why she was visiting for so long. She showed them an itinerary for a planned multi-week roadtrip we want to take (COVID permitting), and that seemed to satisfy the officer.

From this experience, it is easy to see how someone, particularly those from a non-VWP/ESTA country who seem to get more scrutiny, could answer wrong and end up on the next flight home. Make sure that your fiance's evidence is super strong of ties to his/her home country and that they do not fall for any of the trick questions and inadvertently express openness to circumventing the official K1 process.
