You should absolutely get a lawyer at this point. Top dollar to that lawyer because he is your best chance. Sometimes you can just pay 100 dollars to them to get their opinion! It’s called a consultations. I have found them extremely helpful!

I am sorry for the situation that you are in.  The reason you are denied was because of your overstay and illegal status.  They forgive overstays when you marry a US citizen.  They do not forgive it for marrying an LPR.

You need contact a competent immigration attorney at this point.

If her husband is in the US and has overstayed his visa, he cannot adjust status through her. Any overstay, illegal work or any other violations of status make him ineligible to adjust as a spouse of an LPR. She can petition for him, but he will have to go back to his home country to get a visa. If he has overstayed longer than 6 months then he will also have a ban to deal with, best case then is that he gets a waiver (adds more time and money to the process).

It may seem like overkill, however having a negative test doesn't prove anything. You could be asymptomatic or even symptomatic the very next day you have a negative result. That is unfortunate, as the tests are limited in what they can do, and some of them are very much inferior. I know several people that have had negatives from a rapid style test that were certainly symptomatic and very ill, one of them dying in the ICU. Because of the negative results some individuals have taken it as a sign of 100% clean bill of health and have taken risks, leading to family members being infected. There are several working theories as to why the false-negatives happen. Even PCRs are not foolproof and a false negative can happen for a variety of factors.

The CDC has always said if you have a risk of exposure, you should be quarantining yourself for the 14 days, as a negative on day one does not mean you will not be negative on day five. Incubation periods and all that are things people don't tend to think about in this context. It is additionally why, if you are ill, after recovery period and quarantine, the individual should be directed by their doctor to have several negative results over a period of days and not just a single negative result.

jackiegringa reacted to Rocio0010 in I-485 Interview cancelled and status changed to "Decision". What does that mean?
Hi there! My interview was waived, adjusting from F1 to a marriage based green card. I never got an update like that, but I guess that was because the day before the interview (we were literally heading to a hotel where we’d planned on staying the night before) a very nice lady from the FO called me to let me know. My status always remained in “interview was scheduled “ until two weeks after the cancellation we received a letter from the FO in the mail (no online update) asking us to send whatever evidence we were going to present at the interview. We did, and two weeks later we were approved.
