    There's a huge number of N400s still to be processed but it seems like the goal is to make it as close to zero as possible... One can only hope that in a few months when the numbers are down this type of effort is used for other forms!

    Here are some interesting statistics. Seems N-400s, compared to I-751s, are being processed at astounding numbers:
    For the 4th Qtr of FY 2022
     I-751s Received During the Qtr: 40,081
     I-751s Processed During the Qtr: 24,011 
     I-751s Still pending: 270,925
    ----------  
     N-400s Received During the Qtr: 194,819   
     N-400s Processed During the Qtr: 323,793
     N-400s Still Pending: 543,838
     
    There were roughly 10% of the N-400s denied.

    CASE status this morning shows NEW CARD IS BEING PRODUCED. On Feb 6, 2023  we ordered your new card. Woohooo.

    Better use of the waiting time is to get married and file for a spousal visa.  Then, after the bar, you can enter as IR1 and get a 10 yr GC.

    Hello everyone,
     
    I wasn't hopeful my I-90 would be approved as I have filed for I-751 in January - some stories here at VJ where I-90 is denied after ROC. BUT! I got a notification today that my card is being produced!! I did reach out to my state rep back in Nov and got an answer mid Dec, which I think helped both me getting an I-551 stamp and this I-90 process move forward.
    So while it sucked that I had to cancel my family visit and honeymoon last year, at least now I have a 36 months extension and a physical card to show. Maybe soon enough I'll get 48 month extension too, however I'm gonna apply for citizenship as soon as possible so it's all good. It worked out somewhat at the end!!!

    Final action complete- Went to Passport office this morning...took about 10 minutes!!!   We are done!!!

    Nope. Lots of us have not, and I haven't seen a single post from a filer before mid-January 2023 who has gotten a 48 month letter.

    I’m sorry you are in this situation, but it doesn’t come as a surprise to me. We warned you that when they said it was “pending”, they didn’t really know what they were talking about. 
    File a new 751 with updated evidence TODAY, and include an I-129b. With your filing include a letter with a timeline that explains how/ why you got to this point.

    I don't believe she's accruing any unlawful presense. She's LPR until put in removal and judge rules out to take the status away.
     
    But I still suggest consulting with lawyer at this point and probably filing a fresh I-751.

    I'm sorry this is how your case turned out to be OP. Unfortunately seems like what was said in this thread was true - agents didn't know much/made mistakes and now your wife has been accruing unlawful presence since May 2021. I don't have advice for you besides the quote from OldUser above. Please consult a lawyer asap!

    I've read here that it's best to apply for N-400 after the Green card's 3rd anniversary because someone got their application denied but I believe the person was not in the USA all this time living with the US Citizen spouse, something like that. It had to do with the residency requirement:
    "if such person immediately preceding the date of filing his application for naturalization has resided continuously, after being lawfully admitted for permanent residence, within the United States for at least three years, and during the three years immediately preceding the date of filing his application has been living in marital union with the citizen spouse (except in the case of a person who has been battered or subjected to extreme cruelty by a United States citizen spouse or parent), who has been a United States citizen during all of such period, and has been physically present in the United States for periods totaling at least half of that time and has resided within the State or the district of the Service in the United States in which the applicant filed his application for at least three months."     I do want to apply to N-400 as soon as I'm eligible (90 day window) as I've lived in the USA all of this time with my US Citizen spouse.

    Wait a second, I did not say you or anyone else here is "silly". I was only saying that going through the effort to file old tax returns when no money was earned seems like extra effort/stress that is not needed (at least from an IRS standpoint). If others think it would be beneficial to the OP for their specific situation, then that is fair.

    I just couldn't delete everything yesterday.  I had some doubt about getting rid of documentation and evidence.....but, today, I took the bull by the horns....LOL.    We have spent the last 7 years analyzing how everything we did would affect the immigration process.  Now, we are Free at last!!!!!

    I know the OP closed their account, but after re-reading, I read it as she was planning ahead for a future sponsorship of an IR5 in several years.  I only wished more folks would do advanced planning.

    And for four months how did you feed yourself? Drive?
     
    People are literally unable to work, travel, drive despite being issued a gc 
     
    You  would not use your erroneous  10 year  gc to get a DL, unrestricted SS card, travel to see a relative who needs  you?  Even after filing I-751?
     
    Would refuse to use a gc with the wrong birth date, resident since date, finger print, code?

    You’re really putting the cart before the horse with this entire thread.   Make plans to meet in person first, and then come back and ask questions.
     
    When you meet, save every shred of evidence of the meeting, particularly boarding passes, and get passport stamps, hotel receipts with both names, and anything else that clearly demonstrates you’ve met.

    He has the wrong green card, keeping it and using it knowing it was incorrect does not bode well for "good moral character" needed for N-400...
     
    I'd follow @mindthegap advice and try for a stamp - in a best case scenario you get the stamp with the validity of your I-751 extension letter which might even be bumped to 48 months if you can wait for the new one.
     
    If you don't plan to change jobs or travel internationally maybe don't bother. But I would not make use of a erroneous GC knowingly.

    My wife and I now say a "fond" farewell to USCIS....LOL!!
    I have deleted all my visa related emails from April 2016 to present.
    I have deleted all my I-751 and N-400 files!!  USCIS no longer controls our lives!!!!
