I think biometrics are always required. They have been reusing biometrics but If you haven’t had biometric in the US before, I think most likely you will have an appointment. When? It depends how busy is that area where you live. Same thing for interview, it depends how busy your local office is. Some people on smaller towns get their appointments fast while others living in big cities have to wait longer times. In other words it is difficult to guess.

It is definitely bad when something like this happens, and I understand the frustration. Let’s not forget that even if it shouldn’t happen ever, I don’t know the numbers exactly but this agency is processing millions of different kinds of applications at year, each application requires them to send a number of correspondences to each applicant. They are working with less than normal amount of employees and having to deal with the pandemic.
There is this surge of migrants, sometimes during the summer it reaches 100k at month, each applying for assylum, work permits, etc.
Errors as terrible as they can be in certain circumstances, will happen, it is not a perfect system. In a perfect system 0 errors occur.
When errors happen we have to document everything and contact them as much as possible and even involve our congressman or congresswoman if necessary, until the issue is corrected. Don’t apply and go dormant, keep checking online status, on both systems. Sign up for informed delivery with USPS. Check your email and spam email.

We received an RFE in December - asking for more proof of marriage (UGH - we originally sent utility statements, bank statements, vehicle registration, mortgage statements --- all showing joint names).   So we sent MORE utility statements,  several months of bank statements, vehicle registrations, multiple months of mortgage statements, and vacation photos.  All this was sent in early Feb 2021.   We just received confirmation the application was approved (FINALLY).   Greencard is on the way!

I don't think the issue is the length of marriage or the QUALITY of the evidence.
What you have is great and quality evidence. Their issue is timing.
When did spouse get approved for AOS? They want documents from then (since in theory, upon approval, they have everything they need to commingle finances)

I read on VJ before we submitted our documents that too many people were getting hit with RFEs that only show recent bank statements. I think the same issue is what's happening.

You got married in 2018? They expect documents from 2018 (or latest adjustment date to present), particularly on the financial side. You had the Credit union statement from Dec 2018 (which is fine) but they said it is not "actively used" so are there not too many transactions on them? That might be the issue with that.
The IO is basically worried that you made all your 2020 evidence in anticipation for this filing- which sucks to hear, but remember, that's how they see things. It's not really a reflection of reality.

From what you are saying- what you have is what you have. That's when spouse joined those accounts
A possible remedy is the following-
Did you add spouse to lease prior to April 2020? Bring that document. Same with all housing documents prior to 2020 that had spouse's name on it.
Basically- dig as FARRRR back as you can to things where your spouse was added- anything before April 2019 will help.

I know this sucks. An RFE is just a delay. Someone is looking at your case. Don't panic
Send whatever you can back, and an approval will surely come. Good Luck!

Maybe they don’t matter much but is the only thing they specifically ask for in the instructions. The more evidence you have the better.
Most bills they only allow one person and that is ok, maybe electricity is in your name and internet is in his name but show the same address, send a few every year you have been together.
Lease from the beginning of your relationship, Tax transcripts, do not send Tax returns.
IDs showing the same address, costcos or sams cards, car insurance with both of your names, send renewals, also home or renters insurance, health insurance, joint checking account, photos together and with family and friends.
Do not assume they have all the evidence when you guys did AOS, send it again from the moment you have been together.
We are also a same sex couple.
    Good luck guys!

Ecaen87 got a reaction from JoJoJoJo in 751 rejected due to payment info incorrect, but it is correct!
Maybe the bank declined it, maybe the person typing the cc information entered it incorrectly. Regardless of the cause now your application is delayed weeks/months. The safest way to make sure your payment is received is sending a check or cashers check as I did.

My opinion is that if you are moving on March 1st, then wait until you move on that date, is only 10 more days and maybe wait a few extra days after you move to send it, this way you don’t have to change address or explain about the future address. Good luck!

You are correct that MSC and NBC (National Benefits Center) are the same.  It is not the same as Nebraska Service Center.  And you are correct that MSC/NBC does not appear as an option in the dropdown menu when checking processing times on the USCIS website for I-751.     This Processing Times (I-751) for MSC (National Benefits Center) is a thread on VisaJourney  that you may find helpful, as well as this spreadsheet where people are posting their own dates to inform others in the absence of a USCIS-published timeline.   Did you have your first interview for your conditional permanent residency in the US or at an overseas consulate?  If you were interviewed in the US, they may be using your biometrics from your previous application and that's why you haven't heard from them.   If you were interviewed abroad, you should be receiving a biometrics appointment, but availability of this appointment may depend on your local field office, i.e., if they are very backlogged because of the COVID closures, your appointment may be delayed because of that.  I hope this is helpful.

Thank you, this gives me hope! I don't know what service center it was at first, but it got transferred to Potomac in Dec 2019, then to NBC in Feb 2021. Fingers crossed!

MSC is NBC, if you were routed there from the beginning it means that most likely you will be interviewed. Normally those who haven’t had an interview for AOS with USCiS will have one for removal of conditions, and that is the reason for the delay. There are many people in line ahead of you waiting to get an appointment. It also depends on how busy your local office is. Good luck!

They are dealing with delays due to covid19, they process close to or over a million cases at year. Imagine the amount of space they must need to store and process safely all those applications, some of them pretty large. Then if you send it to the wrong place they have to store it and eventually send it back, it takes time! It is probably sent to a shipping office, where they also send other items and mail and there is probably a queue there too. Most of the officers who answer phones must be in a call center and the information they can give you is limited on what they see. At this moment just for them to send the first noa takes in some cases over 2 months. Unfortunately there is nothing anyone can do, just wait and check, double check, triple check everything in your package before you send it.

Thank you! and Congratulations! Check on the history when you sign in, maybe the biometrics update came right before the New Card Production. It takes about 6-7 days to receive the card. I just received mine a couple of hours ago.
