Holy wow I just got approved.

Was really worried we'd get an RFE because we did our letter of intent on one page instead of separate but looks like its okay

Canada and the US are both HUGE countries, I'm not sure why you would say that they don't count as long distance? The few Canada -> US couples I know are separated by over 1500km, some are even over 3500km apart. They don't get any more time to visit than people with B-2 visas, and even then, people have obligations that keep them from being able to visit frequently, like work, school, and family. As others have said, they don't have rights to live in America simply by being Canadian. They still have to qualify to move through work or family. If it were that easy, there wouldn't be hundreds of Canadians on VJ waiting on a K-1 or CR-1 just like you are.

It's not fair to tell other couples that have also had to deal with many months of separation and a visa process that they can't feel hopeless and desperate too. It isn't a competition.

Maybe there's a prize we don't know about -- clearly it's not a speedy visa process, but time will tell!

I think Canada citizens can come to America to live with you anytime, you don’t need worries about the waiting at all, only long distance separated couples are hopeless and desperate. I still can bring my fiancé to mexico to live together but her mom is sick in hospital and her kids need goto schools, what else can I do, I want to find a job where I work from Russia but failed to find, every recruiter said I need work within America

I uploaded to the USCIS site. I think it is quicker than mailing. It has been a month since we submitted the RFE response and a little over 2 weeks since biometrics and we have not heard back yet.

The official instructions state "you must submit a photocopy of your marriage certificate issued by the appropriate civil authority where the marriage took place", so I believe a copy would be fine.

My RFE was only for Part 5 #8, as I didn't have the right browser extension to edit the PDF. I had to fill in Part 5 by hand, but the auto-filling filled out #8 as "1" and I forgot to correct it.

Your issue is also very common. You are correct, Part 5 #3 should be "0", as you do not have a spouse NOT included in the petition.

Not sure if this will help. I picked up my birth certificate from the Registo Civil at Campus da Justiça (Building J) without an appointment. It's mostly in Portuguese but there's a translation key on the back. Then, I walked to building E to get it apostilled, also without needing an appointment. Did you fiancé get the birth certificate translated by a translation company and then notarize that copy? If not, then he can get his birth certificate without an appointment (despite what the security people may tell you at the entrance to the Registo Civil). He can show up, give his name to the security workers, and wait (I waited around 2 hours on a Monday morning).

My fiancé was approved! He was told the visa would be printed today, and he'd receive it "very soon".

    1. What arrived at the embassy is not an approved K-1, it is an approved i-129f, as the K-1 is not approved until the interview.

    2. If I'm understanding your post correctly, your case has only been at the embassy for 4 business days. This is NOT very long at all. It often takes 2 weeks or so to hear from any embassy after they receive the case from the NVC. In my situation with the Paris embassy, it took several weeks to get a welcome letter/interview date.

    3. It is way too premature to contact a congressman. Even if you did get one to write a letter, they'd get the same response as you would -- be patient.

The only advice anyone could give right now, including the embassy, is be patient. They haven't forgotten about you, visas take time. There is no reason to be concerned yet.
