    As above, she is your mother AND lives with you, so she qualifies to be YOUR CO-sponsor. She will not qualify to be a joint sponsor for those reasons so if you mistakenly fill out an I864 and they see she is your mother and living at your address, you'll get another RFE.
    JS=I864
    CS=I864a

    Verification of benefits letter.

    Again, assets are ONLY used IF your income doesn't meet the guidelines.
    You are not padding. You are meeting only.

    If she can prove her individual income PLUS* yours meets the poverty guidelines, then your dad doesn't have to have anything to do with this. Does she have proof of her individual income?
    Can you dad provide for himself?
    I always recommend in these cases that the non-sponsoring spouse who is jointly included on the ITR of a sponsoring spouse provide their own proof of income to show that they are independent and of course, explained as such in the additional information section of the original I864 as to WHY you are submitting such document.
    I always recommend EVERYTHING that could be concluded as confusing or as to why you are submitting something that isnt required is explained in the additional information section. If you don't follow instructions or submit something useless and don't explain it, you can good as well expect them to not accept your I864 entirely because you sent them a bunch of useless documents that prove nothing. They aren't going to figure, interpret or exponentiate anything for you.
    (*PLUS because co-sponsors are eligible to ADD their income to original sponsors income on their I864. JOINT Sponsors cannot. JSs have their own household).

    Only one pay stub is needed and you would calculate your current income based on the gross for the pay period times the number of pay periods in a full year.  It's July.  Your current pay stub probably shows your year to date pay also.  The six month instruction for pay stubs is an artifact from at least two decades ago.

    I suspect the issue is that you only just became employed again after a couple years of income below the filing threshold.  Joint sponsor time.

    It does not mean that.  Your current income is derived from calculating gross pay from your pay stub, if you are employed.  Were you self employed in the past?  The total income line is the number you put in the tax section of the form.  Has nothing to do with current income, if you are employed.

    The key here may be simply that your affidavit of support is not completed correctly, but impossible to know from the minimal information you provided.

    No, you submit one packet. Everything together. My packet was prepared by a lawyer and I got approved.

    No, you will get RFE for missing pages. Submit all pages for all evidence. Yes, it's expensive and bulky. My AOS packet was well over 300 pages.

    Cover letter first (one per packet), followed by all forms on their own, followed by pool of evidence. No need to duplicate evidence for each form, no need to write cover letters for each form.

    I'd include it to speed up processing. Your interview may get waived.

    If your current income (gross pay for a pay period times the number of pay periods in a full year) is clearly sufficient, I would leave your parents out of it completely, as you qualify as sponsor on your own.  Become an A-Student of the I-864 instructions and the form itself, and you'll see I'm right.

    If you qualify on your own, don't unnecessarily contractually obligate others.

    Let's clear up some terminology.  There are no "co-sponsors".  There are joint sponsors and their are household members.  Just because your "relatives" live in the same house does not mean they qualify as household members, and the need not count in YOUR household anyway.  What's the relationship to you?

    If you qualify and they also qualify, you don't combine income.  Let's clear this up before going forward.

    Then they need to get a better copy from the records office of their birth state.  Or provide a copy of the bio page of their unexpired US passport instead.  Other options: passport card, CRBA, certificate of citizenship, certificate of naturalization.

    The I-485 must be filed with I-864 (unless your beneficiary has 40 qualifying work credits in the US).  I-485 without I-864 will likely be rejected.  No fee for I-864 filed with I-485.

    As your wife is the US now, the interview will happen at your local USCIS office.

    Because I-765 and I-131 may get approved before your I-485. Often, you will get EAD and AP within 6-8 months, but GC will take 12-18 months to get approved. At least you could start working on EAD and have an option for emergency travel under AP.

    I-131 and I-765 are free when filed together with I-485.

    You could file for advanced parole if your significant other needs to travel while waiting for their green card. Not sure what the form number is off the top of my head. However you can file the i765 online, after your partner gets to the USA. We did ours the day we arrived.

    That's insane. I only got it so fast because we filled out the form the very first day. I hope you guys get approved soon.

    KevinA74 reacted to maria22 in Process for Venezuelans Timeline and questions!
    Ohh. No, under this process the beneficiary only receives a Travel Authorization to seek parole in USA. That Travel Authorization document would state when would be the expiration day, which is 90 days from the moment the beneficiary gets approved and receives the document. The parole you refer to is granted at POE.

    Edit: The earlier they leave, the better. We don't know how the 24.000 cap works.

    Individuals granted parole under this process generally will be paroled into the United States for a period of up to 2 years, subject to applicable health and vetting requirements, and will be eligible to apply for employment authorization under existing regulations.

    No impact on the I-130. It’s unusual but you have a chance to get her here faster.

    If she is granted entry , she will be paroled in . The parole will be sufficient as evidence she was inspected at entry .
    Once here she files I-485 Adjustment of Status ( green card) based on the pending I-130., along with I-765, I-131 and I-864.
