Hilde got a reaction from Icedamericano in Rio de Janeiro Interview
Hello Friends,
My husband´s visa has been issued. Can hardly believe I am writing this - after such a long and tortuous journey here. Our interview was scheduled for 9:30am. But the day that he went to have his fingerprints done (a few days before the interview) they advised him to get there at 8. So we did. We waited in line outside and after security check etc we were given a piece of paper with the order that they wanted the documents. It went something like this: Proof of DS-260 Passport Birth certificate + copy Marriage certificate + copy Military record + copy Police certificate (state and federal) Medical (had already been sent directly to consulate) Proof of financial support: (below is what we provided) -864 -bank records -401k We were called and they asked us to turn in the documents. They looked over it, asked when we got married (to which my husband got the year wrong because he was so nervous) and told us to wait for the interview. We waited like 15´ and got called. My knees were shaking and my heart was racing. The officer was VERY friendly and I could tell she was smiling even with a mask on. We took the oath to tell the truth, she asked us 1) where we met and 2) how old our daughter was. She entered a few sentences in the computer and THAT WAS IT. She congratulated us. Our case was VERY straight forward (we have been married for 10 yrs, we have a daughter and own an apartment in the US) - I was nervous nonetheless. I think the IR1 visa is VERY document dependent. So if your story is real, if your documents are all organized and updated, you should be good to go. I thank every one of you here for your support. You guys have helped me more than you know. This is a wonderful community and I will stick around here and there to try to help others the same way I was helped. Good luck everyone! -

Add this case to current experiences
A lot of people working overseas are in this situation. What OP did is exactly what you should do to get home.

Many people, especially returning expats, ask this question here. Your experience helps.

I had my interview and was approved. I had NOT put my 401K in my original 864. But then I got an RFE when we were DQ´d saying that I don´t meet the minimal financial requirements. I went ahead and got a joint-sponsor just in case.
But on the interview I presented the exact same 864 but updated it with my 401K information under assets.
We were approved without any questions regarding finances.
Maybe it made a difference. Maybe it didn´t. I am just happy it got approved.
I ended up not using the joint sponsor information, bc they didn´t request it.
So happy everything is done.
Thanks everyone for the help!

I didn't submit the joint sponsor to NVC. I had it as a backup for the interview but ended up not using it, since they accepted my updated 864 (which included the 401k info)

Hilde reacted to pushbrk in Assets (401k?)
Kind of. As long as the asset can be converted to cash within a year, "without doing harm to the sponsor..." that's liquid enough. The issue here is HOW MUCH of the money is available after paying taxes and withdrawal penalty.
Assets are not INCOME, so for a spouse you need 3X the income requirement in liquid assets. (Really three times the income shortfall but in this case that's the same number.) Depending on household size and the amount actually available in cash, it could be tight. Does it "help"? Yes. Is it enough to avoid a joint sponsor? Not so clear.

Possibly. It depends on the amount in the 401K, how much is vested, and the liquidity of the funds.

For everyone: I requested expedite last month and got denied.
So it seems like they are moving along non-expedite requests and DQ dates are up to May 2020.

Hilde reacted to HKS in Vaccine connundrum
Yeah idk. Maybe they will tell him to come back for vaccines. You dont absolutely have to have medical complete before interview.
-
Hilde reacted to pushbrk in Vaccine connundrum
The medical facilities contracted do not simple redo all possible vaccinations. They apply their knowledge of local vaccination procedures and rely on verbal and visual information from the applicant. (visual, like observing a small pox vaccination scar, etc.)

Probably. But there were some on the dept of state list that he didnt get.
