New public charge rule [merged threads]
JeanneAdil replied to JeanneAdil's topic in US Immigration News and Discussion
It's a long read and i am only part way thru On August 14, 2019, DHS issued a different rule on this topic, Inadmissibility on Public Charge Grounds Final Rule (2019 Final Rule), which is no longer in effect. This rule implements a different policy than the 2019 Final Rule. https://www.federalregister.gov/documents/2022/09/09/2022-18867/public-charge-ground-of-inadmissibility -
Confused with NOA 797
JeanneAdil replied to Imili-Aksil's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
fill out the I 824 (always read the instructions for filling out a immingration document) You married 6/2022 and when this i 824 is submitted , it will add a year to the process to get to NVC So, your case will turn into IR1 and a 10 year green card spouse visa never does AOS in USA if CR1, it would be ROC to remove conditions of the 2 year green card -
Green Card dates and right to Apply for Citizenship
JeanneAdil replied to edaesq's topic in US Citizenship General Discussion
they haven't gone up yet -
Marriage 3/16/2022 you would need to enter after 3/16/2024 if getting the 10 year card is important , reschedule and do medical sometime after beginning of January giving u 6 months to fly in from date of medical hope the embassy does not reschedule u for after April 15th as that would require 2023 tax returns

too many unknowns for any of us to say and it would be only guessing but u need more quality time together check your income beside the poverty guidelines how much is health care insurance in Illinois? any kids to claim? any divorces? big age gap? Do u have a joint sponsor if embassy says u need one? we don't need to know the above but u do At the petition stage its all up to USC to prove the relationship At the interview stage the bene must prove he knows u well enough for CO to say yes

One important thing is to realize that the authorities have a tough decision to make in a short time. The more you, as an applicant, can do to recognize and allay their likely sources of doubt, the better the odds that your case will be approved./ Authority in this case is the CO in embassy who interviews and makes the decision to approve or deny a petition Important factors 1. non citizen is from high fraud country 2. Income 3. Time spent together 4. Ages 5. Divorce(s) 6. Being able to support the beneficary for AOS process and while waiting for the EAD so he can work which includes buying health care insurance 6. Any of the red flags / a good list is on following site https://www.nolo.com/legal-encyclopedia/red-flags-that-make-uscis-suspect-marriage-fraud.html Most Co's in high fraud countries do ask "when were u last together ?" and many of us try to be there for emotional support for interview even when we can not attend / the non citizen can say "she's here now" If you have not been able to afford another trip to Nigeria since 2021, CO is going to wonder how u can afford the $1225 to AOS here in the US and pay for his upkeep for a year or more and purchase health care insurance (u need to check the cost of this in your area)

Supporting Documents
JeanneAdil replied to Jalan's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
if u are the beneficary and children are overseas, each child needs his//her own if translations are done by a certified translator , no need for notary no apostle needed for any of the documents -
this may interest u not sure either why marital status needs to be on the certificate at all but yours should say single since u applied under 5 year rule even the word annulment is not needed https://www.uscis.gov/sites/default/files/document/foia/Data_elements_on_Certificates_of_Naturalization-Ballout.pdf
