Optimistic1986 reacted to bold in VAWA, Part 15
Hey all, I got approved for my Green Card on the 14th of August. I have applied since Novermber 2017.
Had I601 - inadmissible.
I got that approved and got my Green Card too.
Question now is: how do I file for my kids whose names where part of my vawa process and who live abroad?

Just an update. I went to my i485 marriage based interview today. My husband was already there when I got there and he requested to talk to the officer in private first. The IO called me separately after an hour and asked me questions about the relationship. I showed him the i360 and prima facie and proofs of the abuse. After the interview, he told me that he believes it was a genuine marriage and that I was abused, and it’s very rare but he will still approve the petition. He said my story looks more accurate and believable than what my husband told him. He said I should get my green card in the mail in 1-2 weeks. I thought that was the end of it. I was crying and praising Jesus that moment.
I got a call from him 2 hours later, he said that there was a judge ruling in 2018 that says they cannot approve adjustments if the affidavit of support is withdrawn. My husband withdrew the affidavit of support. He said that he will put the case under Administrative closure. It's not approved, not denied but I'm not under removal proceedings or anything like that and still valid to work.
He said just wait for the VAWA adjudication and based on my story he doesn't see any reason why it will be denied so just be patient.
Hopefully, some more good news soon. I’m still thankful to everyone who prayed for me and especially to God. Prayers move mountains.

Good morning to you members, am grateful to God this morning for the gift of life! Now I got a question? In October last year I sent a renewal of my work authorization which was from the i485 that was denied before I filed the new one, so last month I raised sr, and it went through, am not sure why I did raise it but anyways I raised it and it was worked on it. This morning I just got an update that they transferred the case to my local office, my question is do local office approve work authorization? Am kinda scared 🤥🤥

This is the continuation thread for
https://www.visajourney.com/forums/topic/709304-vawa-part-14/
which has been closed because of its large size.
It was wonderful to see so many approvals and so much progress in so many cases in Part 14.
I personally hope that everyone who posts in this new thread will enjoy the same.

And also concerning your EAD, do not under any circumstances work if your i485 is denied by any chance..it automatically nullifies your permit! Doing this will jeopardize your chances adjusting status in Trump's America! Be guided!

Guys... another update here!
My interview is scheduled on 8/15/2019
Odd thing is it is my birthday.....😆
I feel like they kinda intended it as a best birthday gift ever. Lol
I did not expect it this soon so I was empty-minded for a minute or so and started crying, called my mom🤣🤣
My attorney emailed me today letting me know of the interview.
my attorney started calling me from july 29 and I never could reach her back when I return the call. So I emailed her FIRST saying that we can always communicate here few days ago and then today I got a reply that my interview is scheduled so go ahead and get medical ASAP.
Yes that is my lawyer.....lol
they really give short notice now.
Because I just went to her office few weeks ago to get EAD under c9 and she did not have the notice till then.
She started calling me on july 29 so I assume they give 2weeks notice to get medical and prep for interview now.
I need to get everything done in time and meet up with attorney once before the interview to prep.
Guys!! Never ever lose hope.
It may take time but it comes at the end.
Just trust.
I am in Dallas, Texas
filed in sep.26.2017
RFE for GMC in oct.2017
sent and received in nov.2017
VAWA approval 4.5.2019
No updates at all
now attorney emailed me for interview on 15th this month.
Thank God and thank you VJ members!

Hi @FeDaniela, I want to piggy bank on @Trizzle's comment. I received my Greencard after approved VAWA back in 2016. I didn't have an interview (back then it was possible that the interview gets waived when you have a strong case), so I'm unable to state if an IO would give you weird looks for still being married. But what I do know is, that a divorce proceeding doesn't have to be started to receive the greencard. In fact it has no impact whatsoever (NYC Office back then).
My attorney back then actually advised me to wait with divorce filing after the entire process is complete - for two reasons.
1/ Less paperwork for the IO to go through
2/ You can apply for WAVA up until 2 years after your divorce. This means if you are not sure if you have a strong case, and you are divorced by the time you file WAVA, a potential denial could be received after the 2 year window passes. This would prevent you from re-filing (which is often recommended over filing a motion to review a decision). If you are still married (not divorced), there's no "cut-off" date for VAWA eligibility.
Having that said, for some of us it's more stressful to remain married to the abuser, for others it's more stress to deal with a divorce. We each should do what works best for us, and not let the paperwork get in our way of a stress free life.
I hope this puts your mind at ease.

WOW am glad to see you here. I didn't see you lately answering questions on the VAWA thread. Folks Villanelle is the VJ member who knows about VAWA more than anyone, and she knows about immigration in general as well . She is a VJ menber for at least 7 years.
