I also received my appointment for biometrics yesterday! I’m very excited that the process is moving along. My case is in Chicago so the appointment is in Chicago south. The case tracker apps and the website didn’t notify me; neither did the live agent from USCIS that I spoke to yesterday.

Congrats! When did you file for AOS and what is your NOA's date? Your Timeline is empty.

Entering the US with the intent to adjust is Visa fraud.   Plus it is very hard for military aged Pakistani males to get a student visa or any other visa to the US.

Is submitting I-130 considered to be AOS? I thought that I-485 is but not I-130.

In general, I think OP can come as a student (provided he can get a student visa) but he cannot AOS (even with an approved I-130) until his immigrant visa number becomes available.

  3. My friend, a U.S. citizen divorced with the father of her child for 20+ years hasn’t seen him for that long also. Yet they kept contact and good relationship through all those years via phone calls. Her ex-husband lived in Uzbekistan. When they decided to re-unite, she filed for K-1 visa for him. Her application was denied on the basis that the 2 year meeting requirement had not been met.

Approval of I-360 has no relevance on approval of I-485.  It is the same as a K-1 approval.  You have an approved visa that allows you to Adjust Status.  There are those with an approved I-360 that did not get their AOS approved based on Fraud and did not receive a Green Card.

Right. And there are those that successfully AOSed based on approved I-360 despite of the « fraud » allegations AND an annulment  of marriage with a US abuser. All I am saying there are precedents if either out there. It depends on the circumstances of each case, I guess.

Stay strong! Sorry to read your story!

Off topic :  do cops arrest the abusive partner without a proof ? What if the call is made for revenge ? How can the wife prove that she was threatened if in the house there is nobody else except her partner ?

In situation like that there are often no witnesses. It’s mostly “he said, she said”. Normally the parties are separated by the cops and interrogated individually to see if their stories match. The cops are experienced and trained to see the signs of fear, distress, physical assault, destruction in furniture, etc. Rarely, yes it happens that the arrests are made based on erroneous conclusion. Sometimes both parties get arrested. But in most cases the real perpetrator has been deducted correctly.

  6. OP, sorry to hear what happened. It is up to you what to do next but if I were you, I would do the following:

    - get a restraining order against your abuser ASAP

    - if he's still in jail I would NOT let him return home. You can do it if receive a call from police/judge answering "No" to the question, "Is he welcome back home?"

    - call Domestic Violence Hotline and ask them for resources to victims of DV in your area

    - locate local WIC or other social services agencies providing help for women with small children

    - apply for food stamps with DES (many states allow green card holders to apply, some even for state medical insurance)

    - file for divorce as soon as possible

    - look up special housing programs for women with kids and apply for a subsidized apartment

You must be at a juncture where you may feel overwhelmed and lost. Do not worry, help is out there. You just need to know how to look for it.

Whatever you decide to do, PLEASE PLEASE do not allow yourself to forgive him and get back together! He is dangerous, and you may end up dead.
