    Get the parents doctor's note (translated into English if necessary) and file for Emergency I-131 with your local USCIS office. Good luck!

  2. You can AOS with her married name. This way her combo-card and green card will be in her married name. SSN also (if apply I-765).

    Until then she can only use her foreign passport as her ID document (with her maiden name).

    The last question, Yes in the future she can travel with her foreign passport and combo-card (or green card) even if the last names do not match. She can always show a copy of her marriage certificate as a proof.

  3. So, you left the US before you got your conditional green card? and before your I-131 was approved?

    If yes, you are lucky to have got a tourist visa (hopefully, you told the truth on your B2 visa application).

    Answering your question, you cannot apply for I-485 based on your son residence in the US. You cannot re-apply based on your marriage, either as the marriage ended with divorce.

    You cannot AOS from the tourist visa, either.

    You can fight for the custody of your child but it's a family matter not immigration.

    Service centers do the initial case review and they don't ever deal with the public at anytime.   Field offices do the final interviews, which hasn't been happening because the offices have been closed to the public.   So that should be actually extending the time to process not shortening 

    And what about those I-485 where the field offices never re-opened? In Tucson where we live it is still closed. Does that mean even longer wait for my husband’s GC to get approved?

    first one : 6/15/2020: I’m applying as a widow, so they received my I-360 and sent me a receipt via mail at my lawyer address. 

    - I called USCIS on 6/13/2020 the agent told me there’s a rejection on my I-485(I was devastated and started crying) and told me they sent the mail to me on 6/11/2020 to my address ( I do have an attorney). I started calling them almost every day since 6/13/2020 because I didn’t receive any letter from USCIS as they told me it would come to my address and not my lawyer address. 

    -6/16/2020 I called USCIS call center the agent told me my case has been marked sensitive informations and she can’t give me more informations and they no longer have info about my case and it has been transferred  to Vermont. ( I was very surprised of a sensitive informations since I’m not a VAWA ) She gave me the Vermont address in case I want to write to them.

    - 6/17/2020 I called USCIS call center the agent told she  only sees a receipt for my I-360 on file and maybe the previous agent made a mistake as she doesn’t  see any rejection on my profile. 

    -6/18/20 my lawyer finally received the rejection letter from USCIS. Apparently we need to include I-944. I’m still waiting  for I-765 and I-131. 

     

    I hope my timeline would help some of us. If I may add a comment I think it’s useless to call USCIS call center and just wait as some of the agents do not even know what they are talking about. Good luck to all of us. 

    OP, as I-360 self-petitioner you are exempt from filing I-944 or I-864. Your attorney is right. USCIS is known to make mistakes. And yes, all I-360 petitions are processed by Vermont Center. You need to answer RFE with the explanation letter. Good luck!

    So the I-693 is the report of medical examination and vaccination record. Since this can be turned in at the interview, I think we're on the right track, right? Especially if this is all the USCIS has sent us so far? Maybe it means everything else currently seems to be intact? 

    You received a courtesy letter re: I-693.

    Next step will be to get an appointment for biometrics as soon as those centers reopen.

    It's even worse than that. If a "mixed" couple filed jointly (MFJ status), with the foreign spouse missing a SSN, both receive ZERO. We are one of those "victims".

    About next year, I heard that yes, the couple can claim the 2020 stimulus on their taxes next year (provided both spouses have SSNs).

    If I were you, I’d check with the credit card customer service. The amount is large enough to trigger an alert or something (in case USCIS tried to charge the card) and the decline as the result.

    Call USCIS or chat with Emma. Ask them if your case is in the system.

    Emails to Lockbox are practically useless. We sent them twice, and got no reply. We learned our NOA case numbers through chatting with Emma. Good luck!
