    Yes I've traveled 4 times while pending 751. 2 of them with just the expired GC and the extension letter. 2 of them with the stamp on the passport, without the GC nor the extension letter

    I plan on bringing my expired conditional green card, 18-month extension letter, unexpired passport, and marriage certificate.

    2. A lot of information on the Internet saying to get a stamp on the passport even though having an extension letter. But my local USCIS, Detroit, is one of the testing local office that eliminated online Infopass appointment and one can only schedule Infopass appointment by calling customer service. I called customer service several times before and they all told me that I could only schedule an appointment for the stamp one month prior to the expiration of the extension letter. So I do NOT think the stamp on my passport is a must to come back to US in my case. Am I understanding this correctly?

    No need for a stamp. All you need is your expired GC, Passport and the extension letter. No need for your marriage Cert. either

    ICE raids are serious. I thought you were talking about regular police or local authorities. As for ICE, You need to know that the stamp or the receipt notice or whatever you get from the USCIS is only a proof of status not the status itself. As for the status, You are permanent resident until a judge says otherwise. So for an ICE raid they can't detain you even if you don't have anything to show them, because with a small check on your name they will find that you are PR. I would try to walk in to the nearest field office and show them that your Green card will expire very soon and that you need a stamp for an emergency travel or something.

  4. Well, Police and local authorities don't have anything to do with your legal status, even if your're arrested. If you talking about driving, that's different story. All the police need to see is a valid DL which you get from the DMV by showing your legal status, if this is the case then a print put from your USCIS account wouldn't work. If you've been waiting a long time for the NOA then your best shot is to get an infoPass and get a stamp which will be good for a year and during this year you'll get your 18-months extension for sure or worst case scenario is to get another stamp for another year. If I were you I would go and get a stamp in the passport to renew your DL and have a proof of a legal status for a year.

    It's not that complicated. I would respond to the RFE which is a must. Get your old lease and whatever evidence you have. You only can submit what you have. I would also send them a letter explaining what happened and that you guys now are separated and going to file a divorce soon. File a divorce and whenever the divorce is finalized submit a copy to the USCIS. Don't waste time and money on filling a new petition. Just amend this petition and switch to waiver and you'll be good.

    It happened to me before. Basically the reason was that I still had my 751 pending. Do you have any other case pending beside the N400 ?

    When I went I took literally everything I have (originals), Of course he didn't ask for half of what I took, but I was ready for anything he can ask for. As far as I remember he asked for the original of the lease of the apartment and some photos and some other evidence. Plus of course anything new that wasn't submitted in the filling of the 751. My advice, just be ready with any and everything you have proves the marriage. You only get one shot at this, so make it count and don't give him a chance for any doubts.

    Same thing happened to me. I switched at the interview. My 751 was pending for 4 years. During that time we got divorced. They scheduled me for the jointly filed 751 and at the interview I took everything with me and asked to switch to the divorce waiver. He asked me to sign a paper stating that, which I did. It wasn't an easy interview since he's asking me only and he has to take my words for everything he asked but it passed and I was approved a week later. Just go and take all the originals and be prepared for any question and take anything jointly between you and your EX and you'll be fine. No need to re-file or pay again or the most important wait another at least 15-20 months to be adjudicated.

    it happened to me too and 2 months later I got an interview notice. So you are correct, it means that somebody is working on your case.

    Oh, but nothing is official yet. What about the online case when she tracks it ? what does it say ? Anyways, she can't do anything until she gets the denial letter to see what was the denial based on and fights it from there. Lawyers won't be able to tell or do much either unless they see the denial letter, so tell her not to waste time or money talking to lawyers until she gets the letter first. I know the frustration about the situation, I wish her all the luck. Keep us updated please when she gets the letter since she can't join VJ herself.

  11. I don't believe that there will be any RFE sent. He already denied the N400. The denial letter should list the grounds for denial. Now you can use these grounds, correct them and appeal the N400.otherwise, like everybody thinks, they might move to revoke the LPR status . In this case they have to send her NOIR (notice of intend to revoke) and the basis for the NOIR. I believe she will have 30 days to answer to the NOIR. If she covered all the grounds that they mention she's good and she can re-apply for the N400. If she fails to do so, then they will move to revoke her LPR and issue NTA for removal in front of immigration court, where she can defend herself again. Again, they won't go through all that trouble, unless they have something solid. So only she knows the truth and the whole truth. I, personally, don't think an error with the dates can cause all that. Why don't you tell us what was on the denial letter for the N400 so we can have a more clear picture of the situation.

    I would get an info pass appointment and get your passport stamped for proof of status instead of wasting your time calling them to send you another receipt notice.

    I have a friend in Chicago. We applied to I-751 same time. She got her green card last week. Do you know why my case transferred to Nebraska from local office?

     

     

    Did you apply for N400 ? Sometimes the N400 moves the file for possibly a combo interview

    We are not divorced yet and might file soon. Any suggestions guys what i should do ( i didn't get the letter yet). 

    my advice is to submit a letter stating the situation and that you guys might file soon for a divorce and if that happened that you'll be submitting the final divorce decree. Wait for the RFE and see exactly what they asking for and go from there.

    make couple calls to the 800 number and ask for a tier 2 officer plus you can make couple info pass apts. basically they had 120 days to give you an answer. Unless the interview went bad.

    Every time you call for update, what did they say? Everytime i follow up they just day they couldnt make a decision at this time. 

    my home visit was right after I applied for my 751, 4 years later I was asked for an interview. Then I was approved a week after the interview. During the 4 years I did apply for N400 but it was pending for 3 years, then I was asked for an interview for next months. I'll keep u updated.

    1) You have to notify the USCIS with your new address within 10 days of your move, regardless of what you think is faster processing time. You have to report you new address so you don't miss any important mail.

    2)You need to file a change of address within 10 days of your move to the new address. you do that by filling form AR-11 online. If you track your case online, you'll find the link for changing the address.

    3)The government shutdown has nothing to do with processing cases, plus the government is open for now.

    4) I don't know about San Francisco, but normally it takes a year, give or take.
