Under the 5 year rule, the applicant still has to show that they are eligible, but they can review the entire history of the applicant. The difference is the burden is on USCIS to show it was improperly obtained, instead of the applicant show that it was properly obtained. So it's not unusual for them to ask about it, but rarely does it impact the result (I have seen a couple cases where it has raised concerns, mostly if the I-751 was approved jointly but they divorced before approval and never reported it).
I agree with you. Since the N400 is the last stop with USCIS they have to review the whole history of the applicant. But it's frustrating some times when you think about how many times you need to prove yourself to them. Specially when the 751 which is not easy was approved with an INTERVIEW not just sending the card and again they ask about proving the bonafide marriage when you apply for the N400

Wow. That's so weird. If they have doubts about the marriage why would they approve the 751 and if they approved the 751 why would they still ask about the marriage. Under the 3 year rule, I understand. but why would they ask you to prove the marriage when you apply under the 5 year rule ?

Filed n400 again in sept 2018 under 5 yr rule, had interview in 3/2019 and got RFE again in 4/2019. Now still waiting.
what was the RFE about in both times ?

I agree with Cryssiekins. I would wait to see what is going to happen in the relationship. If you get divorced or even stayed separated without a divorce. you won't be eligible and it will be a waste of money, time and energy. You will be eligible again in 2 years. Now I would put all my time and energy to get the 751 approved.

I'm in the same exact situation with different details. I had my 751 pending for 4 years which I applied for N400 before it got approved under the 3 year rule. Got my 751 approved in January 2019 ( No actual card was sent) then had my N400 interview in march 2019 which was denied because of the divorce. So I applied for I90 in march 2019 as well as N400 under the 5 year rule in march as well. both cases are pending till now

Don't even bother with the walk-ins specially in the Philly office. They want you to call in and verify that you really need the stamp and your status will expire within 30 days not more then they will schedule you over the phone. No more online appointments

That's exactly what happened to me. I applied under the 3 year rule and when my interview came I was divorced but I was eligible under the 5 year rule. He denied me and recommended me to apply again under the 5 year rule. Check my timeline under the signature part

it's not gonna cause any issues. It happens all the time. During my 751 I changed the address and after 2 years they were still sending me notices to the old address, luckily my friend was still living there. but it didn't cause any issues with them. Don't worry, good thing you called and got the new address on record

The question asks about any arrests or citations. The speeding ticket is considered as a citation. It's confusing because it also says any citations or fines that exceeds $500 which rarely happens in a case of a speeding ticket, but better safe than sorry.

No she doesn't have to be there unless you have a pending 751 and that might be a combo interview. In this case yes she will have to attend with you. If you already removed conditions and now this is a normal N400 then she won't have to go with you

I thought she had her N400 filed and that's why it took only 4 month for ROC. I really don't know, but the 4 month period for an interview for 751 doesn't happen a lot these days. As for not approving you right away, it can be a lot of things. It can be that the officer was new and needs higher approval from a higher rank or a senior officer or something. It can be that he found something that triggered him and didn't want you guys to know it and he's gonna do some investigation and then approve you application. I wouldn't worry about it if you know that everything is good with you guys and your evidence was enough to prove your marriage. It's all about the wait game unfortunately. Good luck to you guys

My husband is in the Navy and we didn't live together due to he's moved a lot (4 states in 4 yrs) and I need to secure my job for our better finance (he will finish Navy in 1-2 yrs), wonder if he has to fly back home for our interview coz we both have no more day off since we all spend it for our last visits.
I think they'll be understandable about the moving a lot due to military service and I don't think it will be a problem if he didn't fly back for the interview due to military. They have a lot of understanding and respect for the people who are serving the country. That's my personal opinion not a professional one

my N400 was pending for 3 years. During these 3 years I got divorced. So when I got my interview for the N400 I got denied because I was divorced. Even tho I was married when I applied and even tho I was eligible for the 5 year rule at the time of my interview.

You can file a law suit in a federal court and you will have an answer within 60 days of filling the Law suit. It's not guaranteed to be in your favor, but it's guaranteed that you will have an answer

Affidavits can be from USC or GC holders. I believe they're helpful but they have to be supported with more evidence

I really didn't mean being lazy as a bad thing. All I meant was like if you're busy with everyday life things and just postponing getting divorced, so You should make it your priority. That's all I meant

If you don't mind me asking what is the point of separation ?
Are you guys working your problems out and there's a chance that you get back together ? If yes, so I would try to work everything out quickly and explain to her the immigration issue and that she needs to be supportive in either case (you back together or still separated at the time of the interview)
Or you guys decided you're not getting back together and too lazy to get a divorce ? If yes, so I would go ahead and start the divorce process ASAP and notify the USCIS and switch to a divorce waiver and try to get the 751 approved by yourself and no need for her.
The 751 being pending for 4 years is not normal so probably either there's more to the story or you're under background check more than normal for a reason. So I wouldn't risk being separated (not married and not divorced either) in the rest of your journey of the 751.

No, You only need a visa to enter not for the layover, unless it's something new. Last time I was in Germany was in 2016

I really don't think anyone can answer that question. eSpecially nowadays normal cases taking more than usual time so think about when they have doubts. I wish you the best luck. I would call them and ask bout my case and if they give the BS answers I would call the congressman to try to push it
