    I'm sorry to hear that. That's a little odd but I believe that's stupid from them to do. They had your wife right there to get all the answers from her instead of the RFE. The only other reason I can think of is that the 751 didn't make her way into the local office at the time of the interview, other than that I don't know to be honest.

    I would say give it a week or 2 and you gonna see your case status changed to approved. It happened to me and exactly a week after the interview I was approved.

    It took 2 hours and she asked alot of question and I answered with all my honesty. At the end she let me review all my answers and told me she will process my case before my extension letter expires. Now I just need to wait and see what will happen next.

    Nothing you can do. Not approving or denying the case on the spot is totally normal specially for a divorce waiver filer. You just need to wait and see what will happen. What impression did you get from her towards the end of the interview ? How was her attitude ?

    That's not correct. The extension letter actually works from it's date. The letter contains a date and you can count the 18 months from this date, it has nothing to do with the stamp. In your case it looks like a glitch from them. I would ignore the letter and just work with the stamp(s). If nothing happened before September (the expiry date of the stamp) go get a new one.

    NBC is the one that handles the N400 not your local office. The local office is just for the interview. I believe that now both of your files (751 & N400) with the NBC and probably they will adjudicate  both cases at the same time

    Did you take your wife with you to the interview for a chance of a combo interview ? Probably you didn't and that's why they issued a RFE for the marriage.

    I would send them a letter explaining the situation. They might issue an RFE for you to send in the divorce decree. Or you can just wait till you get your interview and explain your situation there on the spot

    I had the same situation, which Was applying for the N400 under the 3 year rule and it was pending for a long time and when I got my interview, I was divorced already. At the interview which was conducted till the end including going on question by question in the application and the civic test. Then I was told that I couldn't be approved since the marriage was terminated and I'm only eligible under the 5 year (yes it took that long that I already became eligible for the 5 year rule). I tried to argue your point that the law says that I need to be eligible at the time of filing not the interview and the 3 years pending of my application was their fault not mine, but I finally got the denial letter and it says that THE PETITIONER IS NOT ELIGIBLE IF THE MARRIAGE WAS TERMINATED BEFORE OR AFTER FILING THE APPLICATION. I'm sorry for the bad news but I didn't want you to get your hopes up. I end up filing another N400, wasting another $725 and a year of my life waiting.

    Have you got your official approval letter in the mail ?

    I had my interview in January and I was approved a week later and got the approval letter, but never got the actual card yet. When I went back to the USCIS, I was told to file I-90, so I did so and waiting. I also got the stamp which will be good till 2020. Definitely you can work and travel with it with no problems or headaches beside going into secondary check when you come back to the USCIS

    Finally the biometrics and the photo during the infoPass is a new mandatory thing they came up with to make sure you're the person you're claiming to be

    The lawyer step I believe has passed already. The lawyer in the interview is useless since only you can answer the questions the lawyer can't answer them for you. As for evidence you only can show what you have. So you can show them text messages, FB messages before, during and after the marriage or whatever you have. Emails if you have any. Anything from the mail that you were getting at the claimed marital address that proves you were living there and so on. You need to go with confidence, tell the truth, explain how and why the marriage ended. Show some tax returns if you have any. I had a waiver interview after 4 years from filing and it was fine, lots of questions, but it went good.

    I wouldn't do that. After the RFE you have a chance to be approved without an interview. If you filed the N400 they'll wait till they schedule you for an interview, big chance it will be a combo since the N400 you will have to have an interview and lose the chance for approving the 751 without an interview. It's totally up to you and of course you can apply for the N400 while waiting if you're eligible for it. But if I was in your shoes I wouldn't do it and wait for my luck with approving the 751 without an interview after answering the RFE.

    Let me tell you my story. Maybe not the whole story is relevant, but you can take whatever is relevant from it. I applied for 751 in 2015 jointly, then N400 based on the 3 year rule in 2016. The 751 was stuck, the N400 was processing normally. in 4 month I got an interview letter. 6 days before the interview it was cancelled. I called 100 times and I did multiple infoPasses trying to figure out what was going on. Finally I figured that the N400 got stuck also because of the 751 which I believe happened to your case. Now don't take what they tell you is true 100% about background and name checks, because they just tell you any BS to shut you up. You're 100% true about the checks before the interview, but there's something else is going on. Obviously you don't have any criminal problems which cleared you from the background and the federal checks. I believe that they thing that there's something going on with the marriage. That's why they sent you the RFE about the marriage and also didn't conduct a combo interview or approve the 751 without an interview. You need to figure this out. Figure what is going on about the marriage with them and fix it and this is how you can get out of your situation. There's also the hard way, which is the law suit. Now by law after the interview specially the N400, they have 120 days to make a decision. If they don't you have the right to file a lawsuit to force them to make a decision, but do you really want to force them or not ? only you can answer that. But it's an option and a right which is available to you. Just keep in mind that the N400 will never be approved before the 751, no matter what you do.

    Online or paper filing are the same time for processing. It all depends on the field office not the way you filled.

    I didn't deal with the specific field office that you're asking for, but I would take my wife with for the interview if I were you. You wanna have a chance to adjudicate both cases. The only way for a good chance is to have your spouse present since you have 751 pending. Again I'm not familiar with the field office, but it's just my thought.

    Well, I had my first 751 filed in 2015 and was adjudicated in 2019. It's just ridiculous. The late was from them not me and then all the sudden I'm not eligible because while I was waiting because of them not me my eligibility changed

    If not, this is crazy. Don't apply again, spending hundreds of dollars and another year at least. Ask your local Congressman/Senator and the USCIS ombudsman to intervene first.

    There was no other problems with my application specially the N400. The whole thing started with the 751. They had it pending for 4 years and this is when all starte, but finally the 751 was approved. He said as for the old N400 I was not eligible as I applied back in 2016, so hopefully it's just about another year and another application fee, and there's nothing else hidden that I don't know about.

    unfortunately he couldn't approve my N400 because when I applied in 2016, I was applying under the 3 year rule when I was married. Now I'm not eligible under the 3 year rule but I am eligible under the 5 year rule, but he didn't want to amend my application and do it 5 year rule instead of the 3 year rule. He told me to apply again instead. I was so annoyed because I will have to pay the application again and wait another year. But it is what it is.
