  1. Hello all,

My husband (the beneficiary, K1 visa holder) and I applied for AOS on April 2019. USCIS received our pocket and sent us the receipt by mail on April 10th. Then on May 20th, my husband had his biometrics done. He also got a social security card saying it’s valid for work only by the permission of DHS or something( I don’t know how valuable it is). Now we still haven’t got the employment authorization card. My questions are:

1- can he apply for a job using the social security number he has?

2- how long does the employment authorization card take?

3- can he get a Driver License ( we are in Nashville, Tennessee)

4- I couldn’t get him with my employer benefits (health insurance) and we can’t afford buying one, is there any way he can get a health Insurance (Other than the government benefits)cuz he needs an urgent medical care and we’ve been in the ER twice and imagine the BIG bills!!

    thank you in advance!

I've heard "ready" means it's leaving the NVC, and I've heard "ready" mean it's arrived at Embassy.   Not sure which is correct.    Let's say it's leaving the NVC when it says "ready".   Then, you can use the DHL tracking to see when it arrives at your Embassy.

Just a tiny mini note if you don’t mind,

when it leaves the NVC to the embassies the status changes to “in transit”, and when it shows “ready” it means your case is arrived and ready to schedule the interview date. If you’d guessed I got this info from Greenbaum, you’re absolutely definitely right! :))

very thankful and greatful to Greenbaum for his help.

I sent our RFE in last Saturday and according to USPS tracking it was delivered on Monday. Hope it's enough proof for them and that we hear something soon. This past year apart was almost the death of our relationship. Glad we stuck with it but we're both tired of waiting and being apart.

Totally understand. We went through all of the waiting hardship and we’re still going through it now. Being apart is sucks😔, but every day is going through, we become closer to each other.

    Best luck to you guys!

I have never hear of a lawyer attending an interview. I'm sure there has been one or two but no one has spoken that theirs has attended. I think it would be cost prohibitive for most to have the lawyer attend especially if they are not located in the country where the interview will take place. Besides I think a CO would not want a lawyer as it would only delay the process let alone the conversation between them and the beneficiary. JMHO

I don’t think it worth it to get a lawyer in an embassy interview unless it’s a complicated case I guess. Because it all about few questions about you and your partner so all you need is to be honest and relaxed 😅

I got REF -Request for Additional Evidence-- Beneficiary's -INTENT TO MARRY  on January 2nd. I pondered  with request and USCIS received my REF response on January 9, 2019.

How long does it take to wait for my approval?

I’ve got RFE too. They received my mail December 20th and got approved December 28th.

    No worries, you’re almost there!

    Good luck!👍🏻

My strong recommendation is not let the fact that you have an attorney lure into a sense of complacency. Not saying you are but just a reminder. :) They make mistakes, and they don't know everything, so double check everything, and make sure you understand what are they doing and why. And don't be hesitant to ask question "Why" and cross reference their word with what official websites tell you. I am curious, do they let attorney attend Interview?

    It’s so kind of you!

Im definitely gonna check everything before he submit the application.

I don’t think so, Some embassies don’t even let the petitioners to attend the interview with their partners. But I’ve never heard of an attorney had attended a visa interview with an applicant 😅

No. You don't really do anything until it gets to embassy. This part is confusing because when you put in case number into CEAC site it tell you need to do stuff, but that is artifact of the nature of K-1 visa. See K-1 visa technically is non-immigrant visa, BUT for most of its life NVC treats it as immigrant visa, which is why I had to flip setting to "Immigrant" on CEAC site in order to find it. Normally for immigrant visa you file DS-260 (not DS-160) and appoint agents etc all those things that NVC site tell you to do. But in case of K-1 since under its immigrant clothing it is still just a non-immigrant visa you do not do any of that. You just wait for it to get to embassy and then file DS-160 as you would with any non immigrant visa.

Great info, thank you so much!

I have an appointment with my attorney

tomorrow afternoon, he asked me yesterday to bring all the required documents to get the visa application and the sponsor stuff ready. I think he wants to save some time and to get what’s needed ahead of time.

Update: Got my case and invoice number, I believe they were actually issued yesterday. Got it after calling. Still no e-mail updates of any kind. Was able to check https://ceac.state.gov status under Immigrant visa. Status: At NVC. Now hoping it will make alleged next week shipment to the embassies.

Will they wait for you to do ds-160 and pay the visa fees before they send the cases to the embassies?

    Mini update:

    NOA1: Aug 08 (old) Aug 13 (New)

NOA2: Dec 27 (Notice date, received in USPS mail Dec 31, no updates to either website to this day)

No notification of any kind in either e-mail or postal mail despite updating AskNVC website.

Started calling to NVC Jan 10 (on 2 weeks mark)

Today finally was told  case arrived to NVC today

    NVC Arrived: Jan 14

Moral of the story: Do not count on them to update via e-mail, calling seems to be the only reliable way to get updates. Call while having your WAC number  ready.

My Noa2 is Dec 28th, so hopefully it was with the same patch of approved cases as

yours that’s arrived to NVC today

Ill call them tomorrow to find out if they got mine as well. Thank you for your update!

After 195 days since NOA1 on 6/28 (and 7/2 on new), We've got an RFE today... Discouraged for a moment but I tried to think positive. At least they looked through my case.

No mail yet but I checked USCIS new web site and it showed we got REF on 1/7. I have no clue what's wrong with our case though.. I thought we did it right. it's another waiting game.

I hope it won’t take long. We got an RFE after about 193 days of waiting. We got it done and sent it back on the 18th of December, they received it on the 20th, then we got approved on the 28th. The rfe means they have done with everything accept for that part they requested. Don’t worry, you almost there 😊
