  1. I did it am in happily settled here now with a CR-1

     

    As people in this thread have previously said be honest with the border officer. 

     

    This is just my own opinion but don't volunteer any information at POE. One word answers. 

     

    Reason for your visit? Holiday

    How long will you be staying for? 2 weeks

    Where do you work?  Unemployed

    How much money do you have? *****

     

    As soon as you start volunteering information it's only making their job harder. They just simply want to tick the boxes and move onto the next person. 

  2. This is somewhat relevant, it's a discussion forum afterall. 

     

    I know in the UK (until I think) 2005  British Citizenship status could not come through the father unless the parents were married. 

     

    It's a recently new thing (in the past 14 years) to recognise an unmarried father as having parental rights. 

     

    What previously happened before 2005 in the UK but after 1983 was status would be passed on through the mother. Before 1983 if the child was born abroad status had to come though the Father and the parents needed to be married for the child to be a British Citizen. 

     

    Edit: and between 1983 and 2005 if the child was born abroad, the mother was born abroad and the parents we'rnt married the child would not have an automatic right to British Citizenship. 

     

    In all cases (of no automatic BC) the child would have to register(naturalize) as a 1(3) BNA 81 and it would be at the discretion of the state if the child would become a BC. 

     

  3. From what I understand it won't matter now as no documents will be going to your old address. 

     

    All that'll matter is her address and when she enters she will need to confirm her address in the states. 

     

    My partner changed address from my interview date to arrival date. I just told the officer at POE my new address. I'm here on a CR1 though. I don't think your partner will need to deal with USCIS again until you file for AOS, then you can confirm the address. 

  4. Guys something just came to mind today and I thought i’d post about it as it may help people.

     

    when I went into the social office for my number they initially couldn’t find me on SAVE.

     

    For example my name is Forename: Joe - Middle name: Billy - Surname Bloggs

     

    At the social office when they entered Joe Bloggs they couldn’t find me in the system. The girl that was serving me called someone over and she told her to enter my first name as Joe Billy and that worked, they found me on SAVE.

     

    Wonder if that’s part of the reason people are having problems being found on SAVE?

    Good, get the SAR and work from there. You can even get it online and have it emailed to you if you want rather than waiting on the post. 


    If it were me I'd also start the process of getting all the court records (extract of conviction) together for the times he appeared in court. Hopefully they have them and they're not destroyed. If they are destroyed (the court records) then he should do an affidavit for the offences and get details from the court confirming why the records have been destroyed . For example in Scotland in terms of Statutory Instrument 1009 no.106 (2.8) the disposal of court records (scotland) regulations 1990 the court are only required to hold the records for a period of 10 years in summary proceedings. I'm sure it'll be the same in England but I dont know what it'll be. 

     

    I know a bit about the Scottish court system based on my day job not from an immigration standpoint. 

     

    Also if it were me I'd lawyer up, I know it's expensive but it's gotta be worth it for your family. I understand you can't advertise lawyers on here but hopefully an experienced member on here maybe able to point you to a good one.

    Sounds like @mindthegap knows what they're talking about. I would do as he/she asks and list a clear breakdown of his history including type/details of the offence, date found guilty and age at time of offence.

     

    I know that everything should be taken from the SAR as the police certificate will have less details and may not include all history.

     

    I know its also true that if you have been convicted of multiple crimes (anything over 1 and even if they don't involve moral turpitude) and the combined maximum potential sentence is 5 years incarceration then that makes you inadmissible.

    There is nothing you can do about it. You can't just pull things like that from thin air because of resistance requirements.

    You're applying for a cr1 overseas right? You and your partner have never held the same residence?

     

    You're going to have to move forward with what you've got. 

     

    File the form i130 and wait. If you get an RFE for more evidence so be it, but I doubt it. You'll have about 6 months from filing to potential RFE, if you're in either country before then you could try and arrange some bank stuff. 

     

    Good Luck! This is a simple process for people from low fraud countries, stop making it complicated for yourself.

  8. You'll struggle to get Life Insurance in Denmark now if you don't already have it, due to residency requirements

     

    Stop making this complicated for yourself. What we sent:

    1, Photos together and with family 2, Passport stamps and tickets 3, Partner as a beneficiary of my pension 4, 2 pages of stubs/receipts/attractions we visited

     

    You can send Affidavits (supposedly they're worthless, we didn't bother) 

     

    Use something like Word or Writer and compile all your photos, stamps and tickets into one document. We sent 3 pages of photos, 3 pages of passport stamps/plane tickets and 2 pages of stuff we did together stubs/receipts etc.

    2. HMPO will accept your child's American birth certificate but it must show their parents details on it (no short birth certificate)

    3. If you're in the UK you can make an application for your child while you're here. 2 Benefits: Cheaper and faster.

    I'm already aware of both and yes it does show that the preconceived intent is zeroed out by virtue of the relationship with the immediate relative relationship itself.

     

    But it's still in both manuals? The 30/60/90 was updated to align with the DOS manual in only 2017?

     

    You can't deny that it's not there and shouldn't have have to be considered.

     

    USCIS could still hall your ### in front of a judge while you're waving both of your hearings at them.

    The card I got at interview said 'Please allow 7-10 working days for your application to be processed'

     

    10 days would be the 25th from your interview. You should stop worrying!

  12. This might be personal and I’m sorry in advance.

     

    If he’s never worked in the US in any job that’s going to definitely take a tole on him mentally. I understand the amount of work he must’ve put in to get his PhD, but sometimes you’ve gotta start at the bottom. If he’s never worked maybe you could steer him to try a lesser position for a while and see how he feels? Especially with all the complications of starting a new family.

  13. Always use a checklist. 

     

    You won't get anything to take to the medical. Actually I tell a lie, I got a vaccination department of state form. I put it in the folder with all the rest but they didn't ask for it. Basically if they gave you anything at Knightsbridge take it with you but they probably dont need it.
