  1. Status changed to RFE today 🥴

Filed April 2021, stuck on Biometrics since July 2021, no idea what they could be asking for and to be 100% honest, at this point I don't know if I have any additional evidence that I haven't already sent them. I filed under a divorce waiver and have been separated for almost 2 years so I don't know what to expect. You could argue that we didn't have enough financial co-mingling, since we didn't have joint bank accounts, but we were both in our twenties and had very different job situations, so merging our finances wasn't a decision we wanted to make until later in the relationship, had it lasted longer. Otherwise, we shared health insurance and our names were on credit cards together, that's all I can think of.

How long does it usually take for LIN to take action on a RFE once I send them what they're asking for?

  2. I had my interview around three weeks ago, it didn’t go as smooth as the ideal interview as I have some unauthorized work in my background.

I didn’t get an approval on the spot and my case status changed to “Interview is completed and case must be reviewed”, which at first wasn’t very concerning but as time went by I was obsessively checking the status multiple times a day so I had to stop worrying about it before I went insane.

Checked it again yesterday and it changed to “New card is being produced” so that’s an approval!

I’m relieved and and happy to say I’m done with this endless immigration process for at least two years.

  3. After an RFE and the hassle of having to find a co-sponsor, we finally got our AOS interview scheduled as of January 10th.

Still waiting on the notice, though I'm expecting it to come in the mail this upcoming week. Keeping an eye on Informed Delivery.

Exciting stuff, I'd love for the interview to be still this month but I'm not sure how long the gap is going to be.

Was your J1 visa already expired when you filed the waiver?

    Yes

    Hi @Buhr

My fiance has the same timeline until USCIS process. However, we have been waiting for almost 3 months and we did receive anything from them yet. She applied based on NOS.

Do you have any recommendation on contacting USCIS? I tried the Customer Service number but they just basically cited the status update on the website. Also, did your case appear as "Case Was Received At Another USCIS Office"?

    Thank you!

You can ask to speak to a tier 2 but they might not be able to do much. You can also contact your Congressman or file a Service Request with USCIS.

I thought I just can check if without creating an account. Did you have a lawyer to file your case?

You can on the old website, on the new one you're required to create an account to check the status.

I did have a lawyer for my fiancé petition but I filed the waiver on my own.

@Buhr hey dis you already got your waiver from USCIS? They received my case last April 2nd and haven’t heard anything from them. Thanks!

I did. My NOA1 letter took forever to arrive because they sent it to my address in Brazil and the postal service sucks, so I eventually called them to get my case number, they had had my case for like a week. It got approved a few days after I got the case number. They sent the NOA2 to the US address. It took 16 days total from Received to Approved.

Edit: make sure you check the new website because they often won't update the old one. My case still shows as Received on the old system.

A visa is "affixed" to one of the blank pages in the passport. It has an adhesive and is applied to the passport.

I know, I just wasn't sure what was the right word so I just used the generic "stamped" :jest:

Embassy's do not send email's to inform you of the status of your visa. You need to check your P3 letter where most times it will explain "what's next" answers and check CEAC for current updates. Once the status goes to "issue" within a day or so it's in the hands of the delivery company.

It's probably different in the Philippines, but in Brazil once the passport is ready to be picked up at the ASC, they send you an e-mail to set an appointment to pick it up. I think it's different for every country.

A birth certificate from the beneficiary wasn’t required so I did not include it which is why I think at the interview stage it would be denied

I wouldn't worry too much. If anything you'll get an RFE. Reasons for denial are mostly due to ineligibility. I had my interview yesterday and I overheard at least three people with documents missing and they were just asked to email whatever was missing.

Wonderful news! Congrats again! LOVE does out last this process :)

Thank you! Love really does outlast this nightmare. It's draining, stressing, lonely and miserable and has the potential to ruin your relationship but in the end you both are stronger and love each other more than ever, it's so worth it. Now I'm counting the days to be with my love.

I hope your process goes as smoothly as mine did. Do you have an interview scheduled yet?
