He is not a citizen nor a resident of the USA as such by law he is required to purchase a round trip ticket. Airlines operate on this premise as they were given instructions. They can also deny boarding as they have that right to do so.

My advice is to marry the person and after 120 days have passed then file for CR1 include plenty of pics of both sides of family at wedding. Also take another trip before the actual filing and document that and submit. Included the necessary chat logs Skype logs. You know the drill. They can't refuse you if you marry then wait because you are saying to them by choosing to get married and waiting that the marriage is no sham.

I wish you well on this very frustrating journery. You and your loved one will see the light at endnof tunnel.

MzJan got a reaction from Mary Lou in Received an RFE from NVC :( confused on what steps to take now...
Your are being asked to do the following:

    1. Send birth certificate proof to NVC.

    2. Take affidavit of support form and supporting document and explanation to interview.

The steps are clearly layed out.

Honestly if I were you I would hold off on visiting Syria right now until you at least have your green card in the future. This is all due to the political climate going on and what people may think about you visiting Syria. Are you a man or woman? If you were a man then I would say definitely not go to Syria especially because they might think you went to help fight there. If you are a woman then it is up in the air but probably would not go at all. If you do go and they find out during the interview stage or at any time they might put you in additional processing which could take up to 1-2 years.

Invest in English classes. This will be a good way for her to learn. And seeing that having her citizenship is so important then taking the classes need to be a priority. Also inform all family members to only communicate in english. You can start by labelling items in and around the home in english. Get flash cards. She needs a full emersion for her to become good at it. Hope this helps.

I feel your pain. I just checked VJ processing times and Nebraska has been moved back to October. 10 steps forward 5 steps back.

On June 26th will be my 5 month mark. I am frustrated now and feeling depressed this morning. Never knew going about things the legal and right way would be sooooooo difficult.

We are all winners no matter how long this takes because we did this the correct way but my God USCIS needs to improve this is inhumane to have families torn apart for so long.

    Hi Jan,
I think the evidence we will send is quality and strengthens our cases. Yes great minds think alike!! Our case got sent to NVC yesterday! Yay!!
November filers have faith, there is no rhyme or reason with immigration or the Nebraska hell hole, that's why we have each other for support.

Hi Mary Lou that is what i plan to do as well we filed in January and i have made three trips to USA since being married and my husband about to make his third at end of month to visit me.  So i plan to include the boarding passes or emails confirming bording for both of us plus recent pics. I will include my stamps from passport. Hubby is USC so doesnt have stamps and when he visits he uses the kiosks he hates stamps. Thought was gonna overdo it but i see great minds think alike.

Your given names would be first name, father’s name and grandfather’s name. Just going off observation and what we use on this side of the world.

If the plan initially is to stay 2 months then just say that your visit is for 2 months and explain you are on vacation or whatever else the reason is and ensure you have proof.

If CBP realizes that on this trip you misrepresented yourself be prepared on your next trip to have your visa cancelled and they will state that you are not a true visitor.  That is the trend now when they check and see that persons stayed longer than declared their visas are being cancelled.

It is always best to be truthful.

    That is a misconception.

You are on a visitor visa and not a resident or citizen. Hence you are not expected to stay 6 months. Staying 6 months indicates that you live there or you were working there. It is best to limit the time.

All countries by virtue of treaty have agreed to give geniue visitors a 6 months landing but you are not expected to remain for the 6 months.  On your next visit you will be required to explain yourself and you better have a good reason. Such as fell ill and was unable to travel and have such proof from a doctor. Times have changed.

MzJan got a reaction from velrich in Declare Arrest on Tourist Visa Application [split topic]
This shouldn't even be a question because once you submit application for immigrant visa a background check is done either before interview or after and if you have lied they will simple deny or cancel visa at port of entry.
I am speaking from a LEO perspective and i work within aviation and i have heard so many stories and when i ask why lie the response is always the same thought they wouldn't find out. Really the US not finding out. Most persons are unaware that checks are carried out after the issuance of visas.

You will be contacted in due time. Because your husband is a permanent citizen you will have to wait until your priority date becomes current and a visa is available for you before NVC schedules an interview for you. I am speaking as it relates to you having been contacted by NVC. If they havent contacted you then you still have to wait and if they have and you have submitted documents then you still have to wait until your date becomes current.  Hang in there it will soon be over the hardest part has been completed.
