Did you bring your children on a greencard /LPR status to the US? How did you become a US citizen?

Assuming you naturalized and had children on a LOR status when you did, the kids automatically become US citizens the day you naturalize.

If you were a US citizen before and the children received their LPR status later, they automatically become US citizens the day the activate their greencards by entering the US.

You could file for their US passports now but I would simultaneously file for their N-600‘s (as you are already in the process of). As for section 6, I printed out the forms and mailed it off.

I am assuming you mailed your naturalization certificate off when you applied for your passport. I would file for your child‘s N-600 right away and apply for her passport as well.

You do not need father‘s permission/consent to file for a certificate of citizenship but do need his support regarding any passport application.

If I recall correctly, Warsaw is handling some of Moscows operations now. I would reach out to their visa section. Also, US Consulate in Frankfurt is very responsive. They may be able to point you into the right direction.

Given the ongoing war, I believe Moscow reduced their activities significantly. But US citizens have been targeted for a while and I would think this is a valid argument.

I filed a mandamus for two N-600’s after our cases got stuck forever. I was very concerned about possible pushbacks but it caused the cases to finally get adjudicated.

Of course he did.  He had to.  Whether she kept a copy, we don't know.  Assertion quoted refers vaguely to it, but does not actually mention it by name.  That's why I think the court does NOT have a copy.

I say often "Words mean things."  It's also true that words not used, mean things too.

Referring to the I-134, the wording of the earlier statement from the court refers to papers filed to get her here.  THAT would be the I-134.  The I-864 was filed to keep her here.  She may not even know about that one.  Any good immigration attorney would pick up an that verbiage, and any good divorce attorney would advise against volunteering information.  Like many decisions by judges, it could come down to which lawyer has (really "presents") the most persuasive argument.

Yes.  Both the divorce and Immigration Lawyers can collaborate to fight this but it's still the judge's decision.

I'm not either of those things but my first question would be to see her copy of the I-864.  I doubt she has it, but it could be demanded in discovery motions.

You say the I-485 was denied.  A properly filed adjustment package would have included the I-864, but it would not be enforceable by immigration related means, if the I-485 was denied.  Why was it denied?

There ARE cases where the I-864 was used as grounds for spousal support in divorce cases though.  You signed a contract I-864 with the government though, not with your wife.

R&OC reacted to JeanneAdil in Online I-130 - We have taken action on your case
the action would be that your documents have been fed into the computer system
now,  u just wait till an officer opens the case and starts a real review (6 to 12 months from now)
further updates (if u get any) may also say actively reviewed
this happens when an officer reviews paperwork to ensure all documents are there,  all are signed properly and if anything is missing an RFE is sent (RFE is really nothing to worry about )
when officer gets any document(s) the case is actively reviewed again to download new document as the computer generates the "actively reviewed"  notice

The N-600k establishes citizenship and N-600 confirms it. Two different perspectives. You need to file the N-600 not N-600k unless State insists and USCIS confirms the error made back when son got his first US passport.

If I were you, I would retain an attorney and immediately peruse the legal route.
1.) file the N-600 as soon as possible
2.) challenge State Departments decision by providing the necessary documentation.

Given you have more children (younger than your son?) you may want to ensure this is getting resolved as soon as possible.

I do not believe this can be fixed anytime soon.

This is interesting because I have seen 3+ cases on this and the other big immigration forum raising this issue. You are not the only family who is going through this right now. The N-600 would be the correct form to apply for. Do not use CA if possible as wait times are ridiculously long. We waited over two years for my children‘s N-600 and they have a similar case.

I am surprised State Department revoked the US passport. The day of receiving the citizenship NOT your continued residence matters.

Zonga, I am pretty sure you need to file N-600 because you already have a US passport for her. The new proposed N-600 forms will accommodate an international address field. Being „in“ the US is a pretty confusing phrase and hence, the new forms will accommodate this.

My children’s N-600 finally got approved but it took two years in California.

Your time together will probably carry the day, but I was asking about things she's done that would be clear evidence to a Consular Officer, not just to you.  I'm optimistic.

I hope you'll note that it is wiser to make your decision based on something other that "majority rules".  Just because opinions vary, does not make your decision "democratic".  The guide doesn't mention what you're doing because it presumes the visitor visa has been obtained for "visiting".  Your partner will use it to "visit".  That you will marry during a visit, is not relevant.  Once married, you follow the applicable immigration process.  The visit and visit visa are not part of any immigration process.

It is a problem because you are not married to your second wife. Meaning if you like to bring your wife along, she wouldn’t qualify as you guys are not legally married.

Congratulations to your kids! Nothing to worry about with regards to online status - unless you're still in an immigration journey, it's best to forget about the USCIS from now.

I just looked at my GC online status from back in 2017; I'm still scheduled for interview.

    Online status means nothing.
It's very common for it to be out of date'

With n-600 in hand and US passport, there's nothing to be worried about as far as I know. I would think online status is not the same as internal USCIS database.
