Yeah, when I filed it was 5.5-7.5 months, we're now at 9 months with no further communication! It's just messed up but hey what can you do except have patience 🤷‍♀️ Sending you prayers too!

Me too! I was so happy it ended up at TSC. And then slowly but surely everything changed. And your right, all we can do is have patience. Because at this point someone else has a little control of our own life’s. 😫 after I told my husband about the transfer, he is now freaking out. He is imagining the worse.

Yeah, I was going to say, nothing surprises me anymore with how things are going. I'm well, just crossing my fingers after sending that case inquiry! Let us know when you get an update, hopefully by tomorrow. ❤️

Right! Yes, hopefully after the inquiry, it did something. I was thinking the other day, how unfair it is that they continue to change the processing times. It should only apply to individuals filing after a certain date. Priority dates should be grouped together. Anything filed before 2019 should still have the same processing time as originally stated when priority date was assigned. It just makes better sense. How can you tell someone their new processing time is now 10 months when it was 5 when they originally filed? The new filers should have the 10 months, not the ones thst have already waited 8+ months like us. I just have a feeling I won’t know anything until I receive the notice in the mail. Sending lots of positive vibes your way! ❤️

Hey, just saw your post. That's weird that they wouldn't tell you where it is being sent? Maybe they don't know themselves. Hope it's being sent to NVC and they just pressed the wrong status!

The gentleman at USCIS was very nice, he looked in three different areas and couldn’t find where it was sent. He said because they barely sent out yesterday, there system hasn’t updated with location yet. Oh how I wish it would be thst a wrong status was chosen. We will just have to wait for the notice to arrive in the mail. I just have never heard of care transfer after RFE. But with the amount of petitions they are receiving, it somewhat doesn’t surprise me.

    How are you?

Guys, just tried again and managed to successfully submit a case inquiry. Someone from August on FB got approved right after they submitted an inquiry.. Hoping for the same luck 🙏 But really don't understand why USCIS is now showing they're working on 1st September when I can see on the app there are tons of untouched August cases.. ?

Did you see my news above. I’m over here waiting for an approval after sending the RFE response and I received an update thst they transferred my case. I called uscis this morning and they wouldn’t tell me where it always transferred or why.  I’m assuming because if workload? I don’t think I’ve ever seen a case transferred after submitting RFE response.

Our attorney said not to worry that it is because of being overloaded. We will see what notice says once received.

You will get your approval soon! Just wait and see!!

Hi thank you so much for your reply. I looked over the 601 waiver and it only covers a single offense of marijuana possession under 30 grams (my interpretation of that is that you must have a criminal offense). I do not have a conviction or any criminal charge relating to marijuana as I had never touched it again after that day. That is the part that confuses me 😥

But alas you are correct the only way to tell is when I have my interview which is coming up on May 22nd. I do hope this isn't as big of an issue as I'm making it out to be.

Your welcome. Hopefully since there is no criminal conviction, you will be good. Less than a month away for your interview. Good luck!

Hello All... it's me again back at it worrying about the same issue..

I'm trying to keep my head up and see the positive in all of this but it still lingers and causes me much stress and anxiety. So my reason for creating this post today is I'm wondering about your opinion if I'm going to need a waiver (I-601) for the following issue:

I had been sent to secondary and received an I-275 8 years ago (December 2, 2011- My car was searched and they found a small leaf that tested positive for marijuana (yes very stupid I know, I did not realize it was in my car...seriously huge lapse in judgement...the biggest mistake I have ever made and also learned a lot from). The border officers had me sign form I-275 Withdrawal of Application for Admission, recently I got a copy of the documentation from FOIA.. it also states I had admitted to smoking marijuana 3 hours prior to attempting to enter the states.. I was young and very stupid and very naive to the rules/regulations of the United States. I look back now and realize that I could have really screwed up my future because I didn't use my head when I was younger. After that issue I have never touched marijuana again.. honestly I was so scared of that situation it really deterred me from ever wanting to touch it again. I am now almost 31 years old, no criminal convictions, and a hardworking Accountant (just to give you some insight on who I am as a person)

Prior to attempting admittance in 2018 I had done my due diligence in the beginning of 2018 and went to the same Port of Entry (Peace Bridge) to confirm if I am still inadmissable to the United States and the border officer I was speaking with asked me a couple of questions and then told me that it has been a long time since I have tried to re-enter and that I was now Admissable. Since then I have gone to New York every other weekend with no issues at all.

So I would gladly appreciate if any of you amazingly knowledgeable people are able to tell me if I'm going to need a waiver? Are there waivers for this sort of thing? The reason I ask is because upon receiving packet 3 there was a note on the copy of the I-129F that read "bene has inadmissibility issue." Upon reading that I immediately got very sad and disheartened that this will be the end of my journey to spend my life with my fiance.

Thank you for your time and any comments/advice you give. I do appreciate it more than you know!

Have you attended your interview? If not, once you do, you will get your answer there. If they are questioning the inadminsibility for the marijuana, yes you can file the 601 waiver, from what understand. Hope this helps.

  9. Hello,

i am currently waiting to hear something from uscis after sending off RFE response. When 130 is approved 🤞🏼 I am going at this alone without my Lawyer. It’s been nothing but delays in getting things done. I can go quicker alone. I’ve heard that once the 130 is approved and gets routed to NVC, they send case number directly to lawyer. How do I get them to send to me since Lawyer will not be representing me at that point?

    Thank you!

I am sooo happy to see this post!!! I have asked the question if uscis updates Case when they receive response. I haven’t gotten any updates If they received. Lawyer ticked me off, sent response via us regular mail instead of express where it can be tracked!!! Now I’m in limbo! How did you find out they received?

Oh and 90% of the time they usually approve 2 weeks after receiving response.

    Hi All

For Texas, how long does it take on average for them to decide a case once they received RFE response?

We filed Aug 15, got RFE letter and responses April 12 (they got it April 17).

    Thank you!

  12. Same situation here...

    1. you file petition,

    2. file the solo 212

Best thing is to file 212 once your petition is approved. If it is a spousal petition you file the 212 with local office that has jurisdiction over where the expedited removal occurred. It is very rare they ask for a 601 if there was no misrep/fraud/Overstay. As I read in the above replies, it is correct that you have no way to track a pending 212 when filed with local office. 212 should be all about the hardship the us citizen faces without spouse here. The steps are simple but with lots of paperwork. You’ve received some pretty good advice here from individuals who have been through the immigration process for quite some time.

     Good luck!

My husband contacted the Senator in his state and he said the Secretary replied to his email saying USCIS responded to their query and imformed them that June this year they will be starting to process the cases of August filers. I hope though that's true.  Nebraska isn't really moving, seems like they are still stuck while Potomac is now processing 2019 cases.

All this time, I still can’t process in my head how the petitions get distributed and why the service centers don’t work at the same pace. There is a major lack in management going on here. How can a petition be approved from 2019 at one center and a Aug petition has to wait until June? In my opinion, once these Nebraska petitions are approved, they should be expedited right past NVC. It should be an actual mandatory thing since they made everyone wait so long. I am here to waiting for an update on my RFE response. Fingers continue to be crossed for everyone especially NSV filers. 🤞🏼🤞🏼

I’m visiting my husband soon. If, God forbid I get an RFE will they notify me of the reason by email or case app? Or would I have to wait to get home to see the letter?  If I’m missing anything, i want to send what they need right away instead of waiting to get back.

You will have to wait until you receive the actual RFE in the mail. When they update your case on the website. They list a date thst you can calll if you haven’t received it. Maybe sometimes, the person you get on the phone will tell you what they want. But if you call before thst date, they tell you nothing. It’s terrible.

Ah I see, thank you. I will phone the court tomorrow to arrange for an extract again. The one I sent was the original decree absolute that I had received from the courts to confirm my divorce 🤔 I'll see maybe they'll give me some cover letter or signature like with yours. Fingers crossed yours will be all OK once you get it translated!  🤞

The one thing you should try and get is something with the judges signature that finalized the divorce. There is nothing more convincing than a decree with that signature. Thank you and good luck to you as well 🤞🏼

    Hi Peeps

I have finally got the RFE. What they are asking for is a divorce decree signed by a judge or magistrate or recorded. Submit evidence that the divorce decree is final and was recorded in the appropriate civil registrar. I am a British citizen and sent them a copy of my decree absolute. Decree absolute does not in itself have a judge signature but it does confirm that the marriage is dissolved. I am a little confused as to what they might need. Thoughts?

Hi!! Well well...I got the same exact RFE. My husbands divorce decree in Argentina. The one I sent originally was the same exact thing you sent. Which in itself is valid because we would have not been able to get married there if we didn’t have that. He went and requested and its in Spanish so I don’t understand much of what it says (too many legal words). This one unlike the one we originally sent, is signed by the judge. It’s with our translator right now and we will send off on Monday. Mine didn’t day submit evidence that it was recorded in the civil registrar? I wonder if because the one we sent them was from the civil registrar? Who knows. Did you already have the decree or do you have t request?

Yeah I saw that too... I hope this is not for real..

Also I am wondering: does it really go faster filing as a permanent resident?? I thought it goes faster if the petitioner is a citizen... I am so confused lol

A long time ago I asked the same question. The only reason a permanent resident petitioner filer would get approved is because their spousal visa is not considered priority through NVC. They have to wait much much longer in the NVC process for their PD. As a USC, Our visas as they receive, we don’t have to wait. So if a permanent resident gets approved 1 month before you vía USCIS, you will be at the embassy doing an interview and they will most likely still be stuck at NVC
