    My wife came here on a K1 from South Africa, we got married in March of 2018 and she received her work permit/combo card thing in August of 2018.  We have since built a life around both of us working and just waiting for this green card interview.  Today I was mailed a denial telling us that on March 17th they sent us an interview date that we never showed up to.  Well.....we never got that notice....we have been here patiently waiting and even calling the customer service line asking when it is and they said just to wait etc.....and today we were denied and she is ordered deported in 33 days along with her work permit cancelled...so now we have to move from our home if this isn't resolved....it was all a mistake...we were waiting for the damn interview and they never informed us.  We also updated our address with them to ensure it was correct because we moved mid process.  I'm surprised this letter actually got to us and the address had typo's in it and fortunately our mail man got it to us or the next thing would have been an ICE agent at the door....ffs......does anyone know what happens next?  I know there is this form we can fill out saying that something is wrong with the decision but any personal experience with this? 

    Honestly, I’ve seen this happen already way too much. They also sent my RFE to my old address even though they uodated my case history with the address change. RFE was addresses to the correct address, the envelope had the old address. It’s makes you wonder if a robot is stuffing these envelopes. 

     

     Hire an attorney to fight that denial due to an error on their part. It can be done. Most immigration attorneys will now do payment plans. Call Lizz Cannon, she’s in Florida. But she is one of the best fighting immigration attorneys out there. I am so sorry this has happened to you.

    Yes, I’m seeing this happen more often and recently. It makes you wonder. At least send them certified so someone has to sign for it. I moved, updated my address with uscis, saw that they updated it and they sent an RFE to my old address. Luckily, my friend still lives there and let me know. But what if she didn’t? Our 130 would have been denied for something sent to the wrong address, an error on their part since they updated the new address. And when I called them and told them, all I got was attitude as if it was my own fault. It’s really getting ridiculous at this point. Sorry had to vent about this. Poor guy...it’s really not fair!

    So you just have to wait? Why do you think their going to send NOID? I think they will also request an interview from me, but I’m okay with that, I have everything including all the paperwork from when they expedited him at the airport. I Just don’t understand why they didn’t ask for anything with the RFE they sent me originally asking for a copy of something thst had nothing to do with our marriage.

    Found out last week, our case was transferred to NBC, so I may be called in for interview. I don’t have an issue being interviewed as I have every proof of our marriage and all his expedite paperwork when he was sent back. Have you contact congress to see if they can get involved?

    Do you still not know where your petition went after transfer? This is ridiculous.

    Hi, I just hung up with uscis. Our case was transferred to National Benefit Center. Most 130 that get transferred there are set up for local interview for petitioner....all I can say is bring it on..:they can interview me a million times, nothing to hide. Ugh...

    Not sure if you’ll see this. But I am wondering if the same thing is about to happen to me. Husband was expedited at airport and tourist visa revoked 4/2017, they saw a picture of him on his phone at a machine shop and he told them he was helping my uncle move his shop, they said that was considered working. Inadmissible  212a7aii. Fine, done. I moved to his country with my daughter, lived there 10 months, got married. Came back and filed 130 on 8/8/2018. TSC. Received RFE, responded and received by uscis 4/24. On 4/30 case updated that it was transferred. However, we have not received the notice so we have no idea where it went. Hopefully it was just for work overload. But I am fully prepared if they want to interview me honestly. There is nothing to hide. Where is your case at now?

    I am certain it is on the notice but you know how it goes when you call uscis, they don’t tell you much. You might get someone nice who gives a little more info. I called twice both times same answe, “I can’t see where it was transferred to and if you don’t get the letter by May 30th, call us back.” Not much help.

    We’ve been at TSC for 9 months. Received RFE, responded and now they transferred, waiting to find out where it went and why. Weird it transferred after they received RFE response. 🥴

    Hoping this has happened to someone else and they can give me some insight as to why? 

    We responded to RFE and TSC received 4/24, then received update on 4/30 that case was transferred. Have not received notice as to where it went or why. I’ve never seen a case that was transferred after the RFE response is sent in. Thank you.

    Yeah then wait for the response to the inquiry. After that write congress. I’ve seen a lot of approvals go through because congress was involved. It also depends on your states political status, as odd as that may sound. I have no idea where my petition is or my RFE response is. It’s very ridiculous as this point. And on my status update says if I haven’t received the notice of the transfer by May 30th to call them. I mean come on, may 30th??

    I know it’s not fair. It is definitely a challenge to our mentality. At least me, I start thinking of the worse scenarios in my head when I see all these people getting approved and here we are. Especially when someone else on here responded to their RFE in Texas and got an approval 10 days later. And then mine gets transferred. I think you should involve congress at this point. I can’t because of the RFE, the 60 days clock started on me as of 4/24.

    We received an update that our case was being transferred to another uscis office. This was 5 days after they received our response to an RFE for another copy of my husbands divorce decree. I can’t find information anywhere of Another case being transferred after uscis receives an RFE response. I just find it odd. Our attorney says, they most likely transferred because of work overload. However, the update doesn’t say where it’s being transferred, I called and was told we have to wait for the notice to arrive in the mail. Did you guys find out where it was transferred on the notice thst was mailed? Thank you!
