    We're going through RV as well and they also tried to make us get a co-sponsor. We wrote a letter to USCIS that RV put in our package, because the tax transcript for 2018 doesn't show all of my partner's earnings. It feels like they're doing this to make sure to keep their perfect success rates, so we decided to take a chance on this one.

    You can keep your name or take his name. It doesn't make any difference. He can also formally change his name to yours, if you wish. Or you can both double up the names so you both have both names. It's your choice. It won't cause any problems.

    I recommend filing for the K-1 when you're physically together in the US. We did that and it was very good for both of us to be part in putting the package together, both of us knew exactly what was in it meaning I knew exactly what documents and info the embassy had about us when I went there for my interview. Then they get wet signatures too even if it's not a requirement, and easy to take US standard size passport photos for $5 at Costco.

    Yes of course I was talking about filing while in the us but going back home before the 90days !

    You can file the I-129F regardless of physical location. You can fill out the DS-160 for the K-1 from within the US. But the K-1 processing (including the interview) will be at the selected embassy. Being in the US at the time of filing doesn't impact the petition or visa application.

    Spreading the trips would be the way to go, get a good job in France, let him visit you and you visit him, no need to run the risk.

    My suggestion is to just make short trips using your ESTA to avoid any problems in the future. If you still want a B1/B2, start working towards acquiring evidence that could prove your ties and financial ability.

    Welcome.
     
    Your past visits to the US should help. As long as there are not frequent, long trips, it probably won't be a negative factor.
    You don't really have any ties to return home, which may become an issue.
    You cannot sponsor a tourist visa. Each individual must prove their ability to support themselves in the US on their own, and to return home after visiting. The lack of a job, existing funds, and the inability to work on a tourist visa may be a factor as well.
    The fact that you are coming to the US to visit a significant other is a tie to the US, which makes proving intent to return home harder.
     
    The only way to know how all the above will play out is to try. France is not a high fraud country, luckily, but you do have a bunch of factors working against you. Gather up whatever ties you do have to return home, save some money, then go ahead and try.
     
    Edit: @KULtoATL's suggestion is good. Short, spaced-out trips via the VWP would be preferable. The general rule of thumb is to spend twice as long outside the US than in it. So if you visit for 3 months, wait 6 months.

    I agree with the other posts.
    The officer at the airport might want to see proof that you have a job and an apartment in your home country. And they normally don't really care how many times you have been in the states.
    ESTA is valid for 2 years and is only $14 compared to a tourist visa which is much more expensive and like I said, they officer might want to see proof and as of right now it would be difficult for you to apply for a tourist visa.
    Try to find a job and save some money if you really want to stay longer than 90 days so that you can proof financial independence and a letter from your employer saying that you work for them.
