SkruDe got a reaction from Nj flier in November 2017 AOS
I technically am a K1 AOS filer, I didn't realize I posted in wrong thread.  But I update the K1 AOS Progress thread to say I got my text late last night too!

Don't worry about the Case Tracker saying it does not exist.  I've seen multiple people say it could take up to 2 weeks before the Case Tracker works.  Don't worry.  Text is the most important part.  It tells you that A.) You filed correct papers and fee so package won't be coming back to you; and B.) You'll be receiving paper NOA1 notice soon.  Which is your legal proof of (pending) status.

I understand the point of this proposed bill.  I see what they are trying to accomplish.  I see and understand that there may be no other way to achieve the immigration reform and security the country needs to succeed into the future, I see all that.  I agree we need reform, but.... when you and your family is on the line, a lot gets thrown out the window.  Family is family.  Blood is Blood.  To tell me I can't bring my parents to live with me, when I can prove I can support them, when they speak fluent English, when they are in good health, when I need them when I start a family of my own, when they are unsafe in their current country and live in fear..... well, then it's a different story.  I disagree with the current form of the bill banning all parents.  I think it just needs to be "reformed" as promised.... NOT eliminated.  That was never the deal.  The people wanted Immigration Reform.  Not Immigration Elimination.

It's easy to tell other families that they are SOL.  That they can't be together.  But damn... when it's your family.  Your work.  Your waiting.  Your patience.  Your life........  It's a different story.   Okay, get rid of the diversity lottery, that is literally a luck of the draw lottery for people with no credentials, it's from a different era of US history.  I agree with that.  Build the wall along Mexico, anything to stop illegals, I agree with that.  Make immigration vetting more intense to weed out fraud, I agree with that. But let's not be so knee-jerk drastic on parents.

But If this bill passes, in it's current form that is, then I feel very very sad for the heartbreak and sadness it will bring to US citizens all across our nation.  Regardless if I understand the reasoning behind it.

You are good with computers and I'm sure excel.  What I did was basically make a duplicate of my wife's original birth certificate using Excel.  Custom made all the fields, translated wording, etc... everything in excel.  I had a translator sign and date it with address and phone number using the translation stamp visa journey provides:

PS.  It will be funny to write in that the translator is fluent in the "English" and "English" languages.... haha

SkruDe got a reaction from mkr1990 in Applied for AOS considered overstay on K1 visa? *URGENT*
Your K1 Visa expired the moment you arrived in the USA and went thru immigration at the airport.  You got married within 90 days.  At the time of that marriage your K1 Visa requirement was met and now no longer applies to any time frame or deadline.

If you go back before AP it is not considered overstay on Visa.  Because you are legal with status while your AOS is being processed.  That status is a "Pending" status.  Going back and leaving the USA before AP simply means you abandon your AOS process.  So, you'd have to start from step one again, which would be the I-129F.  No overstay accrued.

SkruDe reacted to AdamSkee in Tip for EAD service requests
For anyone who has been waiting longer than 75 days for their EAD (work authorisation) and is thinking of putting in/has put in a service request:

Double check that the person you speak to on the phone flags your request as "beyond regulatory timeframe".

I put in a service request 30 days ago. Didn't hear anything.

On day 29 (yesterday) I called to follow it up. The lady I spoke to said she could see it on the system, and could see that no one had picked it up, but that she couldn't do anything to expedite it because it had not reached day 30.

So I called again today (day 30). The guy I spoke to couldn't find it on the system. Turns out the person who had entered it had flagged it as "other" rather than "beyond regulatory timeframe" (even though they had made a note in the system that the request was due to a wait of more than 90 days).

So the guy opened a new service request. He seemed to think that, this time, someone will jump on it more rapidly as it is now flagged correctly. However, it could still take another 30 days.

Very frustrating situation, but hopefully someone can benefit from this insight into the opaque workings of the USCIS system.

Working without an EAD is a good way to sabotage your AOS process and get deported.  It doesn't matter what the hospital says to you, they can NOT protect you.  Even if they say you can work, DO NOT.  They don't make the rules.

Simply put, don't work till you get your EAD or you could end up regretting it and living with the consequences for the rest of your life.

You need to treat each application as completely seperate from the other.

2 pictures for each application = 6 pictures.

I don't send in just a huge stack of papers.  Take the time to seperate them into folders, with a cover sheet.  Make it neat, organized, and easy to understand.

It's very common. The official notice says to wait for the letters in the mail before you check your status online, but mine took almost 3 weeks to even show up. But don't worry about it. As long as you have your NOA1's, you're all set.

As for Page 4 Part 2, Underlying Petition.  You are going to get different responses for this.  I did when I asked this same question.  What I ended up going with is Yes, the underlying petition is your I-129F and the receipt number they ask for is your WAC number.  The priority date would be your NOA1 date.

SkruDe got a reaction from julieandgreg in NOA1 addressed as maiden name, not married name. Help!
You should be okay, because during your in-person interview you can bring it up to the officer to have your married name put on the green card and he/she will do it.

AOS Green Card timeline depends highly on your local office.

You get 90 days to marry, then file AOS.

Once you file your AOS and get your NOA1, you gain status as "PENDING".  You will be legal while your AOS Status is Pending.  And your proof will be your AOS NOA1.
