    Definitely. IMO, if OP wants to be a LPR then OP should be in the U.S.

    We received my husband’s 18 month extension after we applied for ROC in June 2020. Just a couple of weeks ago, we received the 24 month extension as his 18 month extension is about to expire. We’re hoping to get the 10 year GC before the extra 6 months is up.

    I had my combo interview on Friday at the Milwaukee FO. I was only scheduled for the N-400 interview but my husband went with me and the officer thankfully decided to do the I-751 interview at the same time since she had the file. All went well, the officer was super nice and professional.

     

    She asked for our IDs and then she went through the basics of the application (names, DOBs, addresses, etc.). She then asked my husband and I a few questions:

    • How did we meet?
    • Where did we get married?
    • How long did we do long distance for?
    • What is in our future as a couple?

    She also asked if we had new documents that we wanted to submit so we gave her our lease renewal, updated insurance and more recent utility bills. She then escorted my husband back to the waiting room so we could do the N-400 interview. 

     

    Since my N-400 application was recommended for approval, the officer said that I would not receive the 10-year green card and will just get the oath ceremony letter in the next month. I am now just waiting for the formal approvals for both applications and online status changes!

    tier 1 agent told me I can write a letter for them to open it but who knows if that will work. Anyone have any advice?

    Did they send your packet back?  Did they cash your check?

    That’s good. I see you had biometrics in March of 2021?  On our case, my husband did not have to do biometrics. They used fingerprints from before. Well, one good thing is we can now renew his DL when it expires once again in March. How about you?  Also, did you have a interview for AOS?  We did in Atlanta back in September 2018.

    We have been waiting for interview since October 2020. Today, we received our 24 month extension without even asking for it.  Our receipt # starts with MSC, which I believe is Missouri.

    IMO, I think it would get the ball rolling on your ROC. At least that’s been the case in other cases I’ve seen. We won’t be doing N400 and have been waiting for interview since October 2020. I did send in a inquiry last week, as it is now outside the range for normal processing.

    There is often a huge time difference in timing between the petition being approved at uscis and the priority date being current for family based petitions (F1, F2, F3 and F4). A visa is not available if the priority date is not yet current. Plus, all these categories were banned for about a year under Trump adding to the delays/backlog.

    This thread was for info purposes and if anything we can do . Not to grill me about my job. I am very comfortable $ wise . I dont feel i have to explain every detail regarding my work or training. 

    What i do know is i have alot on certs and qualifications .

     

    We think only option is to give up all i worked for . The time scales etc we can not do .

    I havent seen my 2 older kids since before covid . They were in the UK  with their dad. Now aged 18 and 15 .

    My brother a civil servant and in a matter of weeks he managed to sort a few things and dont know fully how . 

      i now have my kids with me . One in school although he does have some learning disabilities . The older one doing online college work and working part time  legally . 

     

    We are prepared to leave all this and come back to the uk .

    Which having now spoken to my other half again today . we are going to marry before March either way . 

    We dont think there are any work arounds viable for our situation .

    Family is more important than a green card etc . 

    Yes we know people visit on esta . Marry and file AOS. Yes its illegal but it happens . 

    Would we have tried this route if we didnt realise the error in his application .

    I dont know .  

     

    The main question raised was if he came and we then tried AOS with the current info and all roads lead to leaving the USA . File for spouse visa . By time it came through we would prob be leaving then any how back to the uk . 

     

    We just trying to find the best way of us being together for 2 year max in the states.
