SalishSea reacted to OldUser in n400 withdraw form that we didn't request
This might have been a mistake. It's always best to wait a few days before applying for N-400 when eligibility window opens. Perhaps withdrawal is better than denial.

It does seem like an offer to withdraw was made... @Hmmehanna has to learn more from wife. What exactly happened at the interview. I think @Hmmehanna should have tried attending the interview since it's based on marriage. Good chance he wouldn't be allowed in, but it was worth trying. Was there I-751 and was it still pending?

SalishSea got a reaction from mam521 in Is it advantageous to get married twice: Philippines and Online Utah Marriage
Sounds like you need to spend more time getting to know someone before just deciding to marry them….almost makes it sound like finding an American to marry is essentially a vehicle out of the Philippines.

SalishSea reacted to appleblossom in Help urgently required!
And that's my point - if somebody else can look after him in her absence, it's not much of a tie. By all means use it, but I just wouldn't assume that will count as a strong tie.

I'm not sure your grandfather counts as a tie if she is supposed to be his sole caregiver but can leave him to visit you. How long would she want to come for? And when is her interview?

SalishSea reacted to Daphne . in Is it advantageous to get married twice: Philippines and Online Utah Marriage
People have to meet in person after an online marriage, that is required by USCIS. They don’t get married twice, it’s just to meet the requirements from USCIS.

What will you do if there is an emergency back home and you need to leave the US? The entire process will be abandoned and you’ll be subject to all new fees.

I don't think of it as a guarantee. More like would that stop him from marrying someone else in the US. Im overthinking a lot.

SalishSea reacted to Wisa in Is it advantageous to get married twice: Philippines and Online Utah Marriage
My partner (27M American) and I (27F Filipina) are planning to get married in the Philippines this coming Nov. My mom has been scaring me with "what if's" like what if he doesn't come back to get me or does not push through with the petition. Would it be advantageous if we also get married through the Utah online marriage?

i haven’t filed for travel and does the i485-a cost extra too?
also i thought the i765 cost was halved if applied with an i485?

SalishSea got a reaction from Cathi in Divorce while on conditional GC
There is a certain demographic of aged petitioners who seek out young, primarily Asian brides. Some of the country-specific subforums are chock-a-block with them.

Yes, you do. That plan is 100% fraud.

SalishSea reacted to Timona in Don't know Pont Of Entry for I-90 renewal
So she's never renewed a GC since 2003?
I'm certain she should have renewed to get a 10 year GC in 2005 or 2013.

SalishSea reacted to jan22 in Waiver approved but still can be denied?
Did she have a visa for her entries? Was she admitted to the US at the first entry when she was fingerprinted? The answers to these questions are needed before it can be determined if there may be a problem or not.

SalishSea reacted to Family in Longer evidence packet = longer wait time?
You are right on the age alert. .fot the I-864 , sponsor must be 18. ..so even if processing is lightning speed, no AOS til OP is 18.
‘The I-129 F at USCIS stage won’t have a problem as there is no requirement.
At consulate …seems like it could be roll of the dice …as I am assuming OP is a student and likely dependent on parents. Beneficiary can try scouting some employment offers from US companies around the time of interview and OP parents can do an I-134 as well

c. (U) Public Charge, Evidence of Support:
(1) (U) A K visa applicant and any accompanying children must meet the public charge requirement of INA 212(a)(4) like any other visa applicant. While evidence of support is usually requested, there is no absolute requirement that an affidavit of support or other public charge documentation be presented. It is only necessary that you conclude that the applicant is not likely to become a public charge. It would not be unusual, therefore, for a healthy applicant of working age, applying alone, to establish eligibility during the visa interview without the need for substantiating documentation.
(2) (U) Form I-864, Affidavit of Support Under Section 213A of the Act, cannot be required. Applicants may submit a letter from the petitioner’s employer or evidence that they will be self-supporting. Form I-134, Affidavit of Support, may be requested when you deem it useful.

SalishSea reacted to SneakyPete in Longer evidence packet = longer wait time?
100 pages sounds like too much for I-129F. Entirely unnecessary at USCIS stage.

SalishSea reacted to SneakyPete in Longer evidence packet = longer wait time?
Burden of proof of what? MAin requirement is intent to marry within 90 days which is satisfied by 2 letters of intent and a single face to face meeting within 2 years. Which is usually satisfied via passport stamps, photos at known landmarks, or I-94s if it is beneficiary the one visiting.
