  1. I wonder what South Korea does if someone who is ‘visiting’ for 12 months commits a crime? Surely there must be a record.
  2. Read the guides. I am trying to tell you that you do not need to ‘decide’ or ‘know’ which consulate he will interview at this early in the process. You can select one on the form, and yet you won’t know for sure until later. Anyone is free to ask for an expedite, but I have yet to see one be granted to a Russian who voluntarily left the country to avoid military service. good luck.
  3. Yes, you seem to be greatly misunderstanding the process. You have to adjust status (get a green card) after arriving and marrying on a K-1. That in itself is taking 1-2 years. Because it takes so long, after properly filing for the adjustment, you can file for work authorization, which is taking 8 months. If working upon entry was important to you, CR-1 visa would have been the way to go, as there is no adjustment of status and the green card is immediate.
  4. Are you asking if you can abandon a pending K-1 process, marry and then be petitioned for a spousal visa instead? If so, yes.
  5. I don’t see how you’re going to get out of providing a police cert for a place she lived in for over a year. Tourists go on vacations- for weeks, maybe a couple of months. But over a year? That is actually residing there.

Russia is the aggressor in the ear, and it is not occurring on Russian soil. it is premature to worry about the embassy, since you’re at least two years away from that. Since the Moscow consulate has to close, the default consulate for Russians to interview at has been Warsaw. He could potentially get permission to interview at a different embassy, but again- you’re ages away from that. He won’t be ‘submitting a green card app’ at an embassy anyway; you will be petitioning him for a spousal visa via a lockbox located in the US. He will not be issued a US visa without a passport. I recommend you educate yourself about US immigration and the spousal visa process by reading the guides. Becoming informed can save you time and money, and even a possible denial.

Obviously something has made them doubt your bonafides. When they separated you during the interview, what questions were you both asked?
  16. Once you have a pending I-485, you will need advance parole in order to return to the US. It may take up to 8 months to get it.

  18. Was this interview for a visa, or for removal of conditions on a green card? Having bills, a lease, and buying a home with someone who has not yet come to the US would be highly unusual.
  19. You may be in for scrutiny, especially if she is from Iran. We had about 10 trips back and forth over a period of a couple of years before even filing. Personally, I don't understand how people can be sure about marrying someone they met once for a few days.
  20. Funny, I suggested this months ago on the Montreal DS-5535 thread, and that idea was swiftly shot down. As was my suggestion (also mentioned by others in this thread), that the abuse of visas with overstays by citizens of certain countries make it harder for others from same countries to get visas.....
  21. Without meeting in person during the immediate preceding two years, you’re not eligible for a K-1. Period. An online ‘wedding’ does not count as the in-person meeting, just as FaceTime, Zoom etc do not count.
