    While I was on a K1 I used my AP three times. Never had a problem. As long as you keep it a short trip you shouldn’t have any problems (not two months like one of the previous posters said). After the first time you use AP they give you a big stamp into the passport saying „paroled in until XY(one year later)“ so you won’t have to go through second inspection the next times you use it. These CBP encounters belonged to the most pleasant ones I ever had at LAX🙈 I also used AP to cross the border to go to Mexico multiple times. One time I had to explain the CBP officer at the border what that card was... he didn’t know what it was but other than that even then I didn’t have any issues. 
     
    Edit: oh and I should mention that all these entries were pretty recent. Late last year so already under current administration. No problems.

    For sure! Also in the thread you opened one of the people who posted confirmed what I wrote yesterday. His local office is Los Angeles and he had his AOS interview after 5 months. These new processing estimates are just soooo far off (10-24months for L.A.). I don't know which data USCIS is using to display these numbers but they are poorly chosen.

    It's so hard to believe that this is accurate... I compared the AOS processing times of my field office to Los Angeles. Most of the people from Los Angeles that were in my AOS thread including some friends received their interview within 4-6 months (with only very few exceptions). This page says 10-24 months?! That is a huge discrepancy. It's a known thing that Los Angeles City office processes the applications fairly fast. Compared to that San Diego is supposedly 6-18.5 months and thus a lot faster even though everywhere else San Diego is always around the 9-10months mark (which was accurate for my case). 
    Also, that is a very broad estimate that they are giving with an entire year difference?! Could be 6 months or also 18 months????
    I'd follow the data here on VJ to be honest as it always seemed the most accurate to me.... I feel like this new processing time table wants to prevent that people keep on bugging USCIS with the excuse "hey it says online that you are currently processing cases from the date XY but you received my cases two weeks prior to that date. How is that possible?"

    I didn't say that it will be approved, all I said is that the current B visa is invalid and that he would have to get a new one. Apart from the I-485 filing, B visas are rarely granted after a denied B visa extension.

    Without knowing much about the EB1A and being able to adjust status so fast after approval (what the heck?! how can you go from being a tourist showing no immigration intent to trying to immigrate so fast??) I hope you know that your B visa extension was set up to fail from the beginning on. I extended my B visa successfully and therefore know which documents you had to submit. You tried to prove to USCIS that even though you will be staying longer in the country that you have no intent to remain in the U.S. nor that you have intent to work here in the U.S. (pretty much that you will keep on doing what you did before....being a VISITOR).  
    By concurrently filing another visa that has dual immigration intent, your B visa was automatically denied without even giving it a chance. You are pretty darn lucky that both of your applications didn't get denied immediately because that is what often happens when people on a B visa file for the extension and then file for a H1B visa (which is pretty much the same scenario as yours). 
    I hope you can see how a IO at the AOS interview will give you one heck of a hard time considering what a big mess you got yourself in.
    I went home after my B visa extension because I knew it was the right thing to do. I would consider doing what your lawyer told you as well and go home. 
     
     
    EDIT: Your B visa is invalid now that your extension was denied!!! You need to get a new B visa at the consulate in your home country!!!

    The problem is that you can't just pack your bag and show up at another country's border and say you are immigrating now (unless you are a refugee, some countries grant asylum then). You have to have grounds to do so. Unless you have close family ties to the U.S. (U.S. spouse or U.S. child over 21) you won't be able to immigrate to the U.S., I'm sorry.

It's probably a long shot and pricey (but hey the money will be going to 50% to him anyways so why not spend it) but is there no way to have a detective find proof of that?? Obviously it must be done in Iran bc that is where he is from. Maybe I watched too many movies and it's probably just wishful thinking that hiring someone would be successful but I can't believe that he's getting away with that. This is scary. If you could prove that this is true it would be material misrepresentation with a lifetime ban.

    Either way if the box is checked that your medical is complete you don't have to get a new one... you're adjusting from a K1 visa so whether it's been a year or not doesn't matter. Chances are slim you get a poorly trained IO who's going to ask for a new one. As long as you entered the US within 6 months of having your medical done and did your AOS before the 90 days entry period was over you're good. I had my AOS interview 7 months after my medical technically had expired. It was fine, no one asked for a new one.

    If you had your medical already in your homecountry and you filed AOS within one your of the expiry date of it (which it seems you did) you won't need a new medical

    Yes, I'd wait a month because if they send out a letter during that time, you'd still be within the 60 days frame (since they schedule an appointment usually 4 weeks in advance). If you haven't received anything by then, make an infopass appointment for sure!

    If you have time make an infopass appointment and talk to someone at your office. My case is a longer story but I was scared that they messed my case up (bc after rescheduling it, they denied it by accident) so I went for an infopass appointment just to see whether everything has been sorted out and to ask when I can expect my new AOS interview date. I went with my hubby and the IO looked at our papers and then said a bunch of stuff about how it's an easy case since I came on a k1 blabla and all of a sudden asked "Would you guys be interested to do the interview today?". We ended up not taking him up on the offer to just quickly do that interview that day bc we both had to get to work and haven't had any papers for the interview collected yet. I don't know whether this was an extreme exception but maybe you will get as lucky as me and just randomly get it offered earlier if you go for an infopass appointment. So far I always thought the IOs at the local office has been huuuuge help in the process.

    From what I've been told by an IO at my local office, they generally try to reschedule within 60 days of the original interview date. That being said it's just a general timeline and it can also take much longer. It took them a little over 3 months for me to reschedule but that was also because of other events happening during that time... it would also help if you had a local field office specified in your timeline... helps to estimate how busy your office might be.

    oh and I forgot to say, yes, safe to say that they are happy with your RFIE if it was transferred to your local office. You can still get another RFE if the local office thinks that there is something else missing though.
    Also, just realized that the interview letter must come from the local office. If you have documents missing they sometimes just write that in the interview letter to bring instead of giving you an RFE...

    It is somewhat reliable... In my AOS forums it happened a few times that the Tier 2 said that it was transferred to the local office and then it turned it that this wasn't the case. You can call again and ask another tier 2. If that officer gives the same answer chances are pretty good that it actually is at your local office.
     
    I think my interview letter came from the service center and not my local field office...not sure though

    It's your decision and no one else can tell you what is the right thing to do. I was thinking for a while whether I should even reply to this.... you are in the typical denial situation in which women find excuses to why her husband is treating them shitty instead of accepting the truth.  All of a sudden the entire reason he has treated you bad and threatened you is because of the influence of his family?! You said "If i dont give him money for weed, he calls me i am a fraud, he is gonna sign an annulment, he argues with me"... this is not his family doing this...this is HIM. This is just the beginning of the marriage and he already treats you like this... once you guys move out and you can't make up the excuse that it's his family influence it'll be something else. It already says a lot about what kind of person he is if he gets mad at you not giving him money when he can't get his own butt up to work. Anyways this was my last two cents to this as I know that nothing anyone will say to you will help. My sister was in the exact same situation as you and never wanted to listen either, there was always a perfect explanation for why he was treating her bad instead of seeing the truth that he was a shitty person... she said the exact same thing that she had already invested so much into the relationship (also moved from Europe to be with him)... he ended becoming abusive two years after. Shouldn't be news to you but you will invest even more time and effort and then sink even deeper with this thinking. If he verbally abuses you as you say so early in the relationship, trust me it is highly unlikely it will get better. I really hope you can build up a support system around you. Join social sports club or international FB meetups around you and make friends, that'll help you a lot.

    You can let her stay with a good conscience as long as she has a pending case (the husband hasn't pulled the support yet meaning he has cancelled the I-864 or divorced her).

    No jail time otherwise the prisons here would be full of people with overstay. So you never applied for AOS, thus were never able to work?! I'm surprised.
    Anyways more than 180 days out of status triggers a 3 year ban. Any overstay lowers the chances of ever being permitted into the U.S. again just keep that in mind. I'm surprised that doesn't bother you. In the end it's your husband's home country with his family living here. 
     
    If you don't apply for AOS within the 3 months of entry with the K1 you have to file the I-131 plus the I-485 instead of just the I-485 from K1, so that means you pay a lot more to adjust status. If you don't mind having a ban and an overstay on your immigration records, I guess don't worry about adjusting.... I'd play safe and adjust status and wait it out because you never know what might come up that you end up wanting to move back here or even just come to visit...

    I’d advise to adjust status. You don’t want trouble behind you. I also don’t see how you lived all this time without adjusting status. That means no job, no leaving, no driver’s license in some states. No AOS means you are living in limbo and every time you try to apply to something you hit a road block. I don’t get how you didn’t figure it out. Also, you should have done your research on the K1 process even if you used a company to process it.

    I remember your posts from the beginning...so if I remember correctly you're pretty young without university degree or similar working at McDonalds with no friends in the U.S. I don't want to sound heartless but just go back home to Turkey. You have a brighter future there. You can go to school there and get a degree without paying a fortune for it, you have friends and family there. I know it seems like you're giving up but that is not what it is. You're making a smart move by going back home if you have no support system in the U.S. What is holding you back? If my husband had been threatening me like that and his family would've not been supportive I would've left long time ago. Have a little more self-esteem and don't let people treat you like that.
