  1. He says he is almost always right. He is a constitutional scholar.
  2. Sounds you overstayed your I-94, AND your child is a USC. Your options are to either proceed with ta fiance visa or marry, meet, then apply for a spousal visa. Good luck in your journey.
  3. Alan Dershowitz, who is certainly no Trumpster, disagrees with you. Article 5 specifically says "The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article."
  4. Thanks for the update. Congratulations!!!
  5. I see no reason to renew your passport unless you just want to. There is no need for the immigrant visa to remain in your possession after receiving a plastic Green card.
  6. I'm not sure how it works in California, but that seems like a low MOOP. I would expect the premiums to be sky-high....if they can pass underwriting.
  7. ****Similar topic questions merged*** *** Topic moved to Adjustment of Status from WST Visas****
  8. The 14th Amendment is allocated to Congress....not the states. Case closed. This court has made a grave error.
  9. Why were you denied?
  10. Every couple has their own priorities, and each couple must decide which visa is better for their situation. K-1 More expensive than CR-1 Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork) Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months) Spouse can not work until she/he receives EAD (approx 6-8 months) Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period Spouse will not receive Green Card for many months after Adjustment of Status is filed. A K-1 might be a better choice when 18-21 year old children are immigrating also In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice A denied K-1 is sent back to USCIS to expire K-1 entrant cannot file for citizenship until after having Green Card for 3 years. Once an I-129F has been approved, delaying the case is difficult to impossible if the need arises. CR-1/IR-1 Less expensive than K-1 No Adjustment of Status(I-485, I-131, I-765) required. Spouse can immediately travel outside the US Spouse is authorized to work immediately upon arrival. Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport. Spouse has legal permanent Resident status IMMEDIATELY upon entry to US. The clock for citizenship filing starts immediately upon entry to the US. A CR-1/IR-1 case can be delayed indefinitely at NVC if the need arises.
  11. You can file for one or both. They are 2 separate cases. I assume they want to adjust Status via an I-485.
  12. Very possibly, yes. That's why a good tax pro will run the number for multiple scenarios to help determine the better strategy.
  13. Maybe...Maybe not. There are multiple factors such as the country she is from, tax treaties, foreign income exclusion, how much income she earned, etc. I always advise new immigrants (especially those with significant income) to seek the help of a competent, experienced tax advisor the first year. My wife and I filed "Married- Filing Separately" her first year for the very things you are concerned about. My accountant ran the numbers for JOINT as well as SEPARATE returns. and if she files, the FBAR needs to be done, too.
  14. Meaningless. Processing could be a few weeks or a few years. That's the reality.
  15. Yes. That is what my wife did. It bumped the I-751. Both were approved at the same interview.
  16. Don't forget about the FBAR.....
  17. You can choose to file a joint return. If you file a joint return, she must report all world-wide income for the entire tax year. There is no need for a source document for her income unless you are audited. It is simply listed on the 1040. I have a great accountant here in Dallas.
  18. I agree....but I see the plan I listed as their only hope. Dems have no one else....no one.
  19. Harris has really hurt them....big time. 1. Biden resigns 2. Harris takes over, and picks MO as her VP. 3. Harris resigns. 4. MO takes over, then runs for re-election. They better get off their rear ends soon.
  20. Is this decision election interference? I think so.
  21. I asked the OP a simple question 2 days ago- "Why did you think you needed a partial exam?". I am still curious....I thought I might lean something.
  22. Typically, a few years is probably more accurate. USCIS will automatically send an extension letter which extends the expiration date of the conditional Green Card by 48 months.
