  1. Very possibly, yes. That's why a good tax pro will run the number for multiple scenarios to help determine the better strategy.

There are multiple factors such as the country she is from, tax treaties, foreign income exclusion, how much income she earned, etc. I always advise new immigrants (especially those with significant income) to seek the help of a competent, experienced tax advisor the first year. My wife and I filed "Married- Filing Separately" her first year for the very things you are concerned about. My accountant ran the numbers for JOINT as well as SEPARATE returns. and if she files, the FBAR needs to be done, too.

  6. You can choose to file a joint return. If you file a joint return, she must report all world-wide income for the entire tax year. There is no need for a source document for her income unless you are audited. It is simply listed on the 1040. I have a great accountant here in Dallas.

  14. That is standard procedure in Wisconsin as seen below. Texas has an agreement with Taiwan (as does Wisconsin), but here, in Texas, you would been required to surrender the foreign license. My wife just got a new Taiwan license on her last trip back to home country.
  15. If you mean going from a conditional Green Card to a 10 year Green Card, the answer is: $$$$$$$$ for USCIS. The I-751 (Removal of Conditions) is a cash cow.

  19. That is talking about the initial NOID. You are failing to see the rest of the statement which says "and we mailed you a notice affirming our original approval. Please contact the Department of State directly for any further information on your case." It is clear that DOS has your case now...not USCIS.
  20. There isn't much difference between K-1 processing and spousal visa processing times ( on average, a couple months as reported by other VJ members). I have seen a LOT of people who chose a K-1 later regretted that decision. I have seen exactly zero people who chose a CR-1 say they should have chosen a K-1 instead. Every couple has their own priorities, and each couple must decide which visa is better for their situation. K-1 More expensive than CR-1 Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork) Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months) Spouse can not work until she/he receives EAD (approx 6-8 months) Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period Spouse will not receive Green Card for many months after Adjustment of Status is filed. A K-1 might be a better choice when 18-21 year old children are immigrating also In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice A denied K-1 is sent back to USCIS to expire K-1 entrant cannot file for citizenship until after having Green Card for 3 years.   21. It says "Case Approval Was Reaffirmed And Mailed Back To Department Of State" DOS is NVC. It also indicates that DOS has the case. I think you are OK for now.
  22. 1. I suspect most sputum cases are done to rule out Tuberculosis. Unfortunately, that is fairly common practice in PI. 2. I think that is standard practice in Manila. Congratulations!!! Sounds like you have overcome a major hurdle!!!!
