  4. The civil surgeon and the consulate are the authorities who would have the info you need. They made him wait a year because they want him to be clean for a year. Currently, he is inadmissible. Now, he needs to PROVE he is clean for a whole year. That is why the consulate will likely require periodic (maybe even random) drug tests over the next year.

  12. A petitioner must submit either tax documents for the most recent tax year or a valid explanation as to why he/she was not required to file taxes. No way around that requirement....even a joint sponsor will not overcome it. Perhaps the petitioner's income was below the threshold for filing. That can be explained easily enough.

  15. You need to read the K-1 guide here on VJ. It will answer a lot of questions.
  16. My calculations say 21 since they want 24 hour days. That means the day of departure and the day of arrival back in the US are not counted as outside the US. I think the online N-400 application counts them for you. Chapter 4 - Physical Presence | USCIS "USCIS will count the day that an applicant departs from the United States and the day he or she returns as days of physical presence within the United States for naturalization purposes.[3]"

  18. In your case, the extension letter itself, is of little use since it must be used with an expired 2 year Green Card. A decision for Removal of Conditions could take up to several years. I have seen cases take almost 4 years. At the end of the 3rd quarter FY 2023, there were still more than 217,000 (I-751s) still pending in the system. They are processing only about 30,000 I-751s per quarter. I would file an N-400 as soon as eligible. The sooner you file, the sooner you will be rid of USCIS. Good luck.
