Not saying or implying anyone or USCIS is at fault here. Just voicing my frustration. I'm merely getting a feel for how I should proceed. The frustration is of the process in which everything is capitalized by fees. And I did my research that's why I came here to post before proceeding with my plan which hasn't happen yet if you have read my post carefully. . While I sincerely appreciate your quick reply, your judgemental undertone , however, is not appreciated. Thanks for your help.

The earliest you can file for ROC is 90 days out from your card expiration date. You will then get a letter in the mail saying that your status is extended for 1 year for processing of your ROC. There is no extra documents you need to file on top of ROC.

The biggest challenge you have to deal with is biometrics.  That means you have to do biometrics before you leave bc if you don't then more than likely you will have to go while your gone.

You can travel on a pending ROC and expired green card. You just have to bring with your your expired green card and the extension letter. My wife did it and there was no issues at all.

Quick note to add. DO NOT travel outside the country without the extension letter in hand to go along with your expired green card.

Once you file for ROC you should receive an extension letter stating that your GC is now extended for one year. Don't assume that simply sending off the documents for ROC will somehow reset your current GC with no other items needed.

    Just a friendly clarification.

Once you get your one-year extension letter you are fine for traveling outside the US.  After her GC expired and after we received the extension letter I took my wife to Europe for vacation.  No issues anywhere.  French consulate granted visa with the extension letter and my wife had no problems re-entering the US.  Apply as soon as possible, like exactly 90 days before expiration.

Generally it takes a couple of weeks... but USCIS is ridiculously backlogged, so your best bet is to apply as early in the filing window as possible, and then you have the whole of the time between applying and your green card expiring to get the letter (before you need it).

Pretty much. I really do think it's the nukes that have kept them at bay all these years. An odd thing to be thankful for, but when was war ever a sensible thing?

Nuclear weapons have done more to encourage peace between major nations than anything else ever could.
I could be wrong, but isn't Russia's economy in the toilet at the moment because of low oil prices and some sanctions? That's always their favorite time to threaten America because it boosts nationalism.

Absolutely what Teddy said. I live in Russia (USC here) and it's insane what the government/media here say, it's near laughable sometimes how exaggerated it is.
The Russian government like to use the US as a scapegoat to blame all their problems on them in order to bolster Putin's image. Not going to write too much about this here because I'm in Russia and yeah....freedom of speech is limited. That said, America loves to ride the propaganda train, too. It's a very mutual relationship.
You are absolutely right about the nuclear winter/holocaust, though. That is the end game between these two countries if they go to war. Russia can obliterate US cities within a matter of minutes, and the US could do the same to Russia. It's a terrifying thought! You should watch Dr. Strangelove: Or How I Learned To Stop Worrying and Love The Bomb for some comic relief if overthinking the idea gets too worrisome.

As you will obviously need your passport for travel it is fine to remove it from the plastic pouch however you must not open the sealed envelope containing all your documents for entry into the United States.
    Good Luck

MADDEN reacted to LoveAlways2 in How did you 'Organize' your package?
I organized my package in 5 different tabs, I tried to organized it from (according to me) stronger evidence to less strong evidence (using my own judgement for this, I may be wrong lol ). Here is how it was:
Tab A- Tax transcripts, Banks and Credit Cards
    2014-15 Tax Transcripts
    Joint bank statements
    Joint Credit Card Statements
    Joint savings account statements
    Credit card copies
Tab B- Retirement Accounts, Life and Health Insurance Beneficiaries
    Retirement account beneficiaries form
    Life insurance beneficiaries documents
    Benefit enrollment forms
vision and dental insurance dependents forms
    Tab C- Household Documents
    House Deed
Notice of Assessment of Land and Structure for 2016 for our home with both names on it
    Property Tax documents
Home insurance listing insured names on it
    Apartment lease from 2014-2015
    bills
Tab D- Car Documents and Driver Licenses
    Car title copies
    Car insurance statements
Current driver licenses and old driver licenses copies same address
Tab E- Other Loans, Bills, Mail, Travel Itineraries and Pictures
    loan applications
    Veterinary bills
    Travel itinerary for family trips
    Pictures from family vacations

Here is a picture of how it looked. I just printed five pages with the names of the tabs and used mailing labels to create tabs on the bottom of the pages. I used Acco fasteners because it is what USCIS recommends but I heard a lot of people do not use them. As long as you can make it easy to go through you will be fine.

Correct. However, forcing a spouse to take on an unnecessary financial and emotional burden is also not good. They are a married couple on opposite sides of the issue. As an example, a husband buys a $60,000 car with a 6 year loan over the objections of the wife that creates a huge financial burden and lowers the couples' quality of life. Should the wife be OK with this?. Bringing a sister into the country does not stop with the arrival. It keeps going on for years and years. I suggest they seek some serious counseling about this. I'm not going to make a judgement as to why the husband is refusing. We don't know anything about the background of this story. We're not family counseling.

There is no problem to book your ticket in your maiden name if that is what the name in your current passport is under, these names must match.
My issue was on my first marriage many years ago I was flying from London to Spain and had my ticket in my married name, passport was in maiden name, at check in when questioned about this i produced my marriage certificate but was told that unfortunately the names must match and a marriage certificate wasn't proof that that was actually me (don't figure)
If you have a GC in your married name then make sure you have your marriage cert for re-entry into the USA.
    All the best.

I agree with the above posters.
What your ex did was morally wrong.
However, at this point it is water under the bridge.
Additionally, infidelity and having a child out-of-wedlock with another woman are signs of a lousy marriage. Not necessarily signs of immigration fraud. Calling the child XXXXXXX is a really underhanded move. It's not her fault.
You should move on with your life.

MADDEN reacted to Ash.1101 in fiancee US Citezen death before i attend to my interview..
This is an open forum where anyone can state their opinion as long as it's mostly civil and not laced with curse words. Here, you'll most likely find "our condolences" and then a lot of "our condolences... but.." because a lot of VJer's see red flags in your post, and A LOT of people post things where they say one thing and then immediately change it when they realize that they probably shouldn't have said it. It happens A LOT here, person says a red flag statement, someone picks up on it, person backs up and tries to make it so the first statement doesn't matter or that we all misunderstood.
I'm going to try to take your post at face value and mention some things:
First, since you didn't attend your interview TWICE, the case will be sent back to USCIS to expire. You don't need to do anything. It won't affect you if you do apply for another visa in the future. So, in short terms. You simply have to do nothing. You don't need a death certificate, you don't need anything. Just go mourn and live your life how ever you see fit.
BUT, there's something for you to remember. First, the embassy stage is something that is more on you than the USC. It's on YOU to know your interview date and to attend, not on the USC. Next time, if you do this, I recommend that YOU are the one who receive the interview date, don't have it sent to the USC because if they don't see it, then it's YOU that miss the interview. You need to stay diligent and make sure to inquire about these things. Watch other peoples time lines, if people that were approved after you are getting interview dates, then this should raise some questions. Stay on top of these things, so this doesn't happen again.
The embassy did exactly what they were suppose too. You have no path into the US without a fiance since you were doing a K1 visa. All they can do is close the case and offer condolences. If you expected anything else then you were mistaken. Your case was also most likely closed on your interview date, since you didn't attend it the second time. Chances are, they didn't close it when you emailed them, they closed it in June.
This is assuming you talked to the laywer AFTER your interview date had passed, if you talked to the lawyer before your interview... well then you talked to a laywer within 10 days of your fiance dying and that is probably why a lot of people are calling this thread as trolling because no one's thought 10 days from a loved ones death is "HOW DO I FIX THIS VISA ISSUE".
If you're mad because they took so long to approve your case and you would have had more time with your fiance, this is understandable. But also remember, it's rare for a 26 year old to have a heart attack and die, there were def some medical issues there. Chances are this was going to happen at some point (not to be rude, I'm truly sorry), you may have made it to your green card interview with no wife in tow. You'd be exactly where you are now, as you'd again have no path into the US.
Second, if you're wanting another visa in the future for what ever reason, I don't recommend you do it anytime soon. Give it a while.
Overall, the answer is do nothing. K-1 cases are simply sent back to expire. They can see the K-1 visa was applied for, and if you apply for anything in the future, just be honest. Your fiance died, so you didn't attend the interview which caused the case to be closed and sent back to USCIS to expire.
Note: The reason people are jumping the gun is because you're assuming that you MAY find a USC woman. The concept that there's a chance you will find a USC woman again that you may want to marry usually alludes to the idea that you like to talk to USC women. Stop worrying about who you may marry in the future, stop worrying about how it affects you, probably try not to talk to any women for a while to avoid rebounding.

All of your posts have been insensitive and rude. She didn't mention in her post anything about wanting to abandon her marriage or her husband. She didn't mention cars or jobs being worth more to her than her husband is. In fact, you can probably infer from her post that she is thinking about moving back to Indonesia WITH HIM. Being in the US isn't the end-all-be-all to a marriage to a US citizen.
In fact, I can relate to OP. I am currently going through the homesicknesses and missing Canada more than anything. I love my husband very much and he IS my #1 priority in life. I could not imagine my life without him - but that does not mean that I can't miss my home.
It's definitely normal to feel this way, OP. Moving to a new country is always difficult. It may be hard to feel like you "fit in" or it may be difficult to get used to seeing new things and seeing people act in a different manner. It's also very difficult to adjust to a new quality of life (especially if that quality of life is lower!).
My advice would to be sit down with your husband and discuss what you both value most in life and try to determine which country would better suit your values. Or to wait it out and see if your situation will improve. Adjusting takes time

If she can get through, that's great. But if things don't get better and she is honestly not happy where she is you suggest she just suck it up and accept an unhappy life/marriage? That's not even fair to her husband, let alone herself.
It seems like you lack the understanding and empathy to grasp that.

I am trying to meet new people everyday. I came to some business networking events and some job fair events.
I will work on my feelings, I hope things will get better pretty soon.
Thanks for the response, its good knowing that this "homesick" feeling is common for new immigrants.
Yeah American dreams, I need to pursue that and start swallow that my life is where my family live which is here in America now. Kinda hard though to move on from the previous life that we had..

This is the 3rd I want to go home home thread I read just this evening.
I was also an immigrant and frankly can not relate to any of it.
Marriage is about commitment not feelings. It is about making a life together.
If cars, jobs, friends and family mean more to you than your husband then do him a favor and move back
and divorce so he can find happiness with someone who makes him a first priority.
It is normal to 'feel' homesick to some degree but this is about being an adult and not summer camp.
    I just don't get it.
That's a little harsh don't you think. Marriage is about commitment but also about love which is a "feeling" Let's help each other along this path not make them "feel" worse.

My wife is really into personal information security. She wouldn't be happy sending the numbers uncovered. I don't think its so much about the government being able to get the info if they wanted, its more about just not putting full access to your financial stuff out into the world. Just good practice I think, no?

MADDEN reacted to aaron2020 in What is Material Misrepresentation
A material misrepresentation means a misrepresentation that would have altered the decision.
For example; a married person presenting himself to be single to get a K-1 visa.
Would knowing that your parents were illegally in the US have altered the decision to grant you a non-immigrant student visa? I don't think anyone can answer that.
Being married to a USC and adjusting status gives you a leg up in adjusting status. Personally, I don't think you have a problem with this strong tie.
    Best of luck.
